HomeMy WebLinkAboutC2007-362 - 10/11/2007 - NAMONITORING WELL PERMIT AGREEMENT THE STATE OF TEXAS§ COUNTY OF NUECES§ That the City ofCorpus Christi ~hereinaer the "City"}, acting by and through its duly authari~ed City IVlanager, George ~, Noe, far and in consideration of the sum of Pive Hundred Dollars ~5a0,OD} to be paid in hand by Ceo Strata Environmental Consultants, Inc. ~hereinaer the "Permittee"} of 4? l S ~altege Park, fan Antonio, Texas, does grant, upon the conditions hereinafter stated, unto said Perrr~ittee, a n~onitarin well permit far the right to install, operate, maintain, and ren~ave two ~~}monitoring wells, approximately 2-inches in diameter, l G-feet in depth, with a lacking cap and 1 ~-inch concrete pad and steel saver mounted with a 1 ~- inch square Bushed mountedtraffic-rated well vault, for approximately a Z4 month period, both wells to be located within the Aquarius street public right-of~way, one ~l}well will be located on the east side ofAquarius Street, just south of South Padre Island Drive, and one ~ l }well will be located on the west side of Aquarius Street, just south of Ambrosia Street, in the City of Corpus Christi, Texas as shown on the attached drawings marked E~rhibit "A". TD HAYS AND TO H~I~D the carne unto Permittee, its successors and assigns, together with the right and privilege under the conditions and terms hereof, at any and all times to enter upon the above described right-of way for the purpose of constructing, operating, rnaintai~ing, and removing of said monitoring ~ve11s, and it is further understood that the foregoing monitoring well permit is granted upon the following conditions. A, This rnonitaring well permit may be revoked at any time upon the giving of ~o days notice in writing by the City of Corpus Christi's City Manager, or designee ~"City Manager"}. B. PERMITTEE, ITS HPFICER, MEMBERS, PARTNERS, EMPLHYEE, AGENTS, AND LICENSEES THEREINAFTER CALLED "PERII~ITTEE"} SHALL FULLY INDEMNIFY, SAVE AND HHLD ESS THE CITY ~~ CHRPUS CHRISTI, ITS HFFICERS, EMPLHYEES, AGENTS, LICENSEES, AND INVITEES ~`~INDEMNITEES"} AGAINST ANY AND ALL LIABILITY, DAMAGE, LHSS, CLAIMS, DEMANDS AND ACTIHNS OF ANY NATURE wHATSHEYER HN ACCHUNT ~~' PERSHNAL YNJURIES INCLUDING, wITHHUT LIMITATIHN HN THE FHREGHING wHRI~ERS~ CHMPENSATIHN AND DEATH CLAIMS}, HR PRHPERTY LHSS HR DAMAGE HF ANY KIND ~VHATS~E~ER, WHICH ARISE ~~JT OF ~R IS IN ANY MANNER CHNNECTED wITH, HR IS CLAIMEII TH ARISE HUT OF HR BE IN ANY 1~AY CHNNECTED wITH, THE PERFHRANCE HF THIS PERMIT, INCLUDING SAID INJURY, LHSS HR DAMAGE CAUSED BY THE HLE HR CHNTRIBUTHRY NEGLIGENCE ~~ THE INDEMNITEES HR ANY OP THEM. PERMITTEE SHALL, AT ITS HwN EXPENSE, INVESTIGATE ALL HE SAID CLAIMS AND DEMANDS, ATTEND TO THEIR SETTLEMENT HR HTHER DISPHSITIHN, DEPEND ALL ACTIHNS BASED THEREHN WITH CHUNSEL SATISPACTHRY TH INDEMNITEES AND PAY ALL CHARGES HF ATTHRNEYS AND ALL HTHER CHTS AND E.PENSES HF ANY KIND ARISING FRHM ANY OF SAID LIABILITY, DAMAGE, LHSS, CLAIMS, DEMANDS AND ACTIHNS. C. Pern~ittee must have and maintain commercial general liability insurance pertaining to the Monitoring Nell Permit Agreement and the activities authorized by this Agreement, in the minimum amount set forth in the attached and incorporated Exhibit B, The insurance policies must name the pity as an h:1..,1gen1ag0']Imon-welllgeast~ata.agr Page ~ of J ~~~~'~~~ ~~~~~~~~ G ea St~'`d~~ EriVIC, ~~I1S~llt. additional insured, The insurance policies may not be canceled, renewed, or materially changed without 30 days advance written notice to the City's Director of Development Services, ar the Director's designee, The Perrnittee, or a representative or contractor of the Permittee, may not perform any work authorized by this permit until the Ferrr~ittee has presented evidence of the insurance coverage specif ed in Exhibit "B", sufficient to satisfy the Cit}r's Risk Manager, Upon request of the Cit}~s Risk Manager, the Permittee shall provide copies of all insurance policies to the Risk Manager, D, Except as otherwise provided herein, all work proposed will equal or exceed the Texas Commission on Environmental duality ~TCE~~ and the Texas VL~ater V~ell Drillers Board rules, regulations, and requirements far the installation, monitoring, and removal of monitoring wells. ~. At the time of removal, the Permittee is required to backfill the monitoring well. At a minimum, if the well falls inside existing asphalt pavement, the top 10-feet will be filled with 3000 psi concrete and remaining depth with bentonite, The City may elect, however, to fill the top 2-~ feet with soil, the next 1 ~-feet with 3004 psi concrete and any remaming depth with bentan~te, The alternate elective applies primarily to those n~onitar wells which fall outside of existing asphalt pavement, F. All applicable Federal, State, County, and pity laws and ordinances shall be complied with and all necessary permits shall b secured from the appropriate agencies prior to obtaining this permit, Copies of said permits shall be pra~ided to the City and attached hereto far all purposes as Exhibit {`~" ~Io public street, or any portion. thereof, shall be closed or barricaded to use by the public far the purpose of installing, repairing, or maintaining the monitoring wells until after the permittee or its contractor has filed with this office an approved traffic control plan from the pity Traffic Engineering Office. H, All City utility departments, AEP ~Arnerican Electric Power}, ATT formerly Southwestern Bell Company}, Tirne~Varner, and Grande Oommunicatians and any other companies that may be affected by the monitoring wells must be notified ~S~hours prior to construction.l-800-DIC-TESS, lone tar~lotification Center ~1-800-G~9-S344) and Southwestern Bell Telephone ~1~800-8~8-517} numbers must be notified ~8 hours prior to construction for existing utility locations. I. Construction plans and specifications for all work proposed will be submitted to the Department ofEngineering for approval prior to beginning construction, The plans must show the depth and location of the proposed construction and distance from the existing water, storm, wastewater, and gas lines. J, Permittee will repair or cause to be repaired any damage to any landscaping, sidewalks, curb and gutter, driveway, street, sanitary sewer, storm sewer, drainage facility, underground lines, wires or pipes owned by the City of Corpus Christi or holders of any franchise frarn the City, resulting from or caused by xeason of construction, operation, maintenance andlor removal of said monitoring wells. ~. A City Inspector may request a utility line to be uncovered to verify its depth and~or location. All backfill and repairs ofany kind will be made according to City standards andlor City ~nspectar's request, All work and repairs will be at Permittee's ar its contractor's expense, ~,, If a City ~nspectar is required at the j ob site, the Permittee shall pay a daily rate of $3 41,E 1 for each day spent inspecting construction, maintenance, repair, replacement, relocation or remavai of the rnonitarin wells pursuant to the monitoring well permit, Any time in excess of eight hours per day and any time an Saturday, Sunday or holidays shall be calculated at a daily rate of 5G,49 per hour. The Permit~ee andlar its Contractor gill not clean equipment or material on site. ~, Monitoring wells will not protrude above the existing natural ground elevation, and a sealed covering will be provided to prevent surface water frorr~ entering into said monitoring wells, , Permittee shall adjust or relocate the above described monitoring wells at its own expense, if necessary for the present or future canstructian of any public utilities, ar change in street grade ar pattern oI1 the streets or far any other reason of the City stated in writing to Permittee. The construction of the monitoring wells and the use of said area hereby granted shall in na way interfere with the construction ar operation by the City ar any of its franchisees of any existing or future proposed sideways, utility lines, ar other uses, or the maintenance thereof, If City for any company with existing utilities located inaidright-af-way} needs access tatheright-af~way cant~ining the monitoring wells, Permittee shall be responsible far either repairing the monitoring wells to their original condition or removing the monitoring we11s at which time this Monitoring well Permit shall terminate immediately. . The rights ofcanstruction conferred herein shall not be assigned by Permittee without the prior written consent of the City of Carpus Christi, T, The 1Vlonitoring Nell Permit remains in effect during the Permittee's investigation and assessment of possible petroleum contamination, However, the 1Vlonitoring well Permit expires ~4 months from the date of issuance, Upan completion of the investigation and assessment the rraanitoring wells will be removed in accordance with the then current requirements of the City of Carpus Christi and the Texas Commission an Environmental duality, or its successor agency in Austin, Texas. Provided, however, that ifat the end of said 24-n~anth period, the TCE~ requires additional monitoring of the well, then the City shall grant to Permittee an additiona124-month period in which to perform the work under this permit provided Permittee pays an additional $0.00 far each rnanitoring well to the City far the ~4-month extension. The Fermittee shall notify the City's Department of Development services, ATTN.: special services Engineer, 48 hours prior to removal of said monitoring wells. U.
