GRANTEE} the receipt ofv~hich is hereby acknov~ledged,has conveyed, and daps convey unto the fty of
carpus Christi, Texas, a Texas Home Rule municipal corporation, its successors and legal representatives,
the free and uninterrupted use, liberty, p~.vilege, and easement of going rn, on, over, under and along a
certain tract of land situated rn Nueces Jaunty, Texas, and being described as follov~s:
A neap shoving the location of the Terr~porary construction Easement by
shading is attached and lncorparated as "Exhibit A",
Together Frith the fine ingress, egress and regress to and for the pity of corpus Christi, Texas} for the
purpose of constructing a road extension on the adjoining property.
PEIAL PR~vI~~l~~:
1. The existing storrr~water culvert will be removed and backfilled within an area shown by
cross-hatching on attached Exhibit ;`A".
2. grantee's contractor agrees to repair fence and replace the survey stake between grantor's
property and the adjoining its of corpus Christi property line.
3. Upon execution ofthe Temporary construction Easement, grantee agrees to backfi~l and
compact an eroded area between the grantor's property and the adjoining pity of corpus
Christi property as requested by grantor.
4. All construction is to be done in a prudent and workmanlike manner.
. To the extent allowed by Texas Laws grantee agrees to fully indemnify, save and hold
harmless the ~rantor~ ~"Indetnnitee"} against all liability, damage} foss, claims, demands,
and actions of any nature whatsoever on account of personal injuries including, without
limitation on the foregoing workers' compensation and death claims}, or property lass or
damage of any kind whatsoever, which arise out of the use of the right-of-~vay ar
construction, installation, operation, uses maintenance, repair, restoration, or removal of
the improvements pursuant to this agreement.
TO HAVE AND T~ HELD, ALL AND SINGULAR, the rights aril privileges aforesaid to the pity of
corpus Christi, Texas, its successors and legal representatives, for use as a Temporary construction
Easement and Right-off day for a period of ninety ~~a} days beginning December 10, ~411~ and
terminating March 14, ~ooS.

C
