HomeMy WebLinkAboutC2007-440 - 12/21/2007 - NAAMEN~~IENT N~. ~~ ~NTR~4T F~~i ~NCINEERIN ERVICE The City of Corpus Christi, Texas, P,~, Box 9277, Corpus Christi, Texas ~S40g~9217 hereinafter called "City" and HDR En in~rin, I~e~, 2~~ 1 youth IH35, uit ~4~, A~,stin, Texas ~~4~ hereinafter called "Engineer", #~ereby agree to the following amendment to the contract for engineering services as approved April ~ 1, 2000, ~liotion No. 2800-~ ~ ~ , amended January 30, 2001, Motion 2001-040, and Larch 13, ~~~~ , Motion 2001-1 gG, administratively amended June b, 200, and administratively amended July , 2D01, and August ~ , 2801, Motion 2001-320, and November ~ 8, 2003, Motion 200 -410 and administratively approved March 10, 2ggb, and administratively approved April 21, 200G, and Motion 2007-043 approved February 13, 2807, and adrninistrativelyepproved November 14, 2007: Section ll, SCOPE ~F SERVICES, PHASE II, shall be modified by the addition of Section II.B,10 to Additional Services - Rinon Diversion Pipeline, BASIC SERVICES to read: B ~ Additional Services II,B.17, Construction PhaselCertification ServiceslAdditianal Meetings ~ Rincon Bayou Diversion Project Pipeline and Pump Station. Construction Phase; • Stop Logs - it was discovered that the stop logs did not fit in the guide channel ~a combination of the channel being too narrow and the stop logs too wide}. Review, evaluation and response to contractor's proposed several fixes to the problem. • odbus R The SARA consultant requested additional inputs beyond ghat were called for and requested that a I~aBU unit be installed to pick up all PLC inputs This unit was specified and a change request subr~itted to contractor. Contractor did not immediately respond and then the price was greater than anticipated, The unit gill be purchased and installed through the SCADA contract. • Check Valve -The 4'" duck bill check valve at the nutlet structure was dislocated during a test run. The manufacturer was determined to have submitted the wrong installation procedure, Consultant evaluated and provided response to repair procedures to determine an acceptable procedure. The contractor did not follow the agreed to procedure resulting in additional procedures being required, • ARV Vault Cover ~ The contractor provided cast in place ARV vault cavern rather that the pre-cast specified. The opening for the vent piping could not be sealed as specified requiring design of a modified design of a sleeve to accomodate the seals and the piping. • Landscaping and Seeding -Many of the trees initially planted did not survive, The contractor requested substitutions in both size and species. Consultant evaluated and approval solicited frorr~ the adrr~inistrators of the conservation easement, The seeding mix applied did not conform to the specs or the subrr~ittal. Several different 'versions" of what was applied were submitted. After evaluation, it was decided to treat this as a warranty item since there is a coverage requirement after one year X007-444 ~~121147 ~~~~ ~ ~~~ H~l~ ~n~neering ~G~N1Pipe~inelAEAmd~~Dp~~at~~gPlan.hoc • Valve Actuator Replacement -During the flooding of July and August, the water level rose to the point where the valve actuators were under water for 4-~ days. The submittal indicated that the actuators were waterproof to ~' immersion for l2 hours. • Vllater entered the actuators causing them to be inoperable. consultant coordinated with the contractor and the manufacturer to replace the actuators with the additonal cor~panents to made them v~raterproof. amrnisioning Services - contract provided for one round of certification testing and training, The training occurred, but the tests were not successful Three additional certification tests were required as the contractor performed minimal testing relying on the certification tests to discover problems. Final certification test discovered one flaw which was subsequently resolved. coordination with the contractor was required to resolve the problems and to develop courses of action for correction Additional Meetings - contract did not provide for semi-monthly meetings with the contractor and the Director of Engineering Services to discuss project progress. These meetings have continued, but on a more infrequent basis with fourteen X14} of these meetings since February. There were also several progress meetings held with ~IVater Department representatives. UVe also held several meetings and conference calls to resolve the issues discovered during the certification testing. Several additional meetings are anticipated to close out the project and resolve the liquidated damages. FEE FAR SERIIIES AI~TH~RIZED The pity will pay the Engineer a total fee not to exceed ~,B~o,7o for providing all services authorized by the contract. Engineer will submit monthly statements for services rendered. The pity will make prampt mon#hly payments in response to Engineer's monthly statements. For services provided in Section II.A, payment will be made based upon the Engineer's estimate of the portion of work completed. However, the total of the payments made for Basic Services will not exceed 95°l0 of the total authorized fee until all deliverables specified in Exhibit A are accepted and approved by the City Engineer. For services provided in Sections I I.B. ~ and ll . 8.~, payment gill be made based upon the hourly rate for regulatory assistance set forth in Exhibit E-1. The Engineer will be reimbursed at actual costs plus ten percent ~~ 0°l0} for airfare, ground transportation, lodging, and per diem meal expenses. The Engineer may be required and authorized by the pity Attorney to retain the services of sub~consultants. The Engineer will be reimbursed any sub-consultant, computer modeling} copying and mapping costs authorized by the pity Attorney at actual cast. Travel expenses will be vuill be documented by photocopies of receipts and invoices. For services provided in Section 118.2, , 4, 5.a, 5.b, ~ and ~ payment will be made based upon a fixed fee amount set forth by the Summary of Services and Fees listed as Table 1-~ Summary of Fees.
