The contract dated March, 01 ~aD6 and all prior amendments and renewals are referred to herein as the "O~iginal Contract." The procurement I~FP~20gfi~ g9-D0~-PEI, which resulted in this contract, anticipated passible renewals and amendments of the contract, and na additional procurement process Is necessary before entering into this renewal. The Department and the Contractor agree to amend the contract as follows: Budget. The Budget far Purchase of Service contracts Form ~D4}and Budget Narrative included in the Original Contract as an atkachrnent ate hereby deleted and the Farrn 203Q and Budget Narrative attached hereto are substituted far same. il. Renewal Period. Section dill of the Original Contract is amended to include: September 1, ~Qg~ through August 1~. III. Section V. B. of the Original Contract is deleted in its entirety and the fallowing provision substituted far sane: Amount of Paymen#. The Department shall pay the Contractor up to SD~,OOQ from available funds far services rendered in accordance with the terms of this contract upon receipt of a proper and verified statement and after deducting any known previous overpayment made by the Department. if program income accrues, the Cantractar shall return to the Department any Income that exceeds actual costs inputted for services rendered under contract. In no event shall payments exceed the Contractor's actual reasonable, necessary and allowable costs to provide services under this contract budget, III. Section V. 1, of the Original Contract is deleted in its entirety and the following provision substituted for same: Regulation Compliance. The Contractor shall remain in compliance with 45 CFR, Part 74 as applicable, Office of Management and Budget BOMB} Circulars A-"IUD, A-~~, A-8l and A-~22 as applicable, and 4D Texas Administrative Code ~TAC} ~~3~,~~a~~~G as applicable. Further, all contractors that are subrecipients and that are state or local Qovemment entities, or are funded with federal black grants, are required to comply with the uniform Grant Management Standards ~UGM}, as applicable, Schaaf districts, colleges and universities, and special districts are excluded from UMS compliance requirements. In the event of any conflict or contradiction between or among the regulations referenced in this contract term, the regulations shall con#ral in the following order of precedence: 4b CFR, Part ~4; OIVIB Circulars A-'I ~D, A~87, A-~1 and A-12~; ~GlU1S; and 4a TA 13~,~40-~~. I1. Section U. N~ of the Original Contract {22S~A~C~ is deleted in its entirety and the fallowing provision substituted far same does not apply to Original Contract 2~82BX -- governmental Bntlties}: Insurance. ~ . The Contractor shall provide insurance far direct delivery of services under this Contract. The Contractor shall obtain and furnish proof of the following bonding and insurance coverage within forty-eight ~4S}hours of the award of the Contract or at such other time as may be specified by the Department. The required coverages are: i. Dishonesty banding under a commercial crime policy ar business services bonding, at a ten thousand dollar ~~0,00~,00~ minimum; and ii. Carnmercial General Liability Coverage at a three hundred thousand dollar ~$DO,OOD} minimum for each occurrence limit, and six hundred thousand dollar ~$~aa,4aa} minimum aggregate limit. The Department shall be provided with ample written native of policy or band cancellation or material change ~~07-47~ 1011b1~7 1V~~0~7-~G~ ~a~~ 1 Tx Ilept ~'~ ~. The Contractor shall purchase coverage with insurance companies or carriers rated for financial purposes "B" ar higher whale polities cover risks located in the state of Texas. All bands, policies, and coverage shah be maintained during the entire term of contract 3~ In the event the Contractor is unable to comply with subsection 9, above, the Contractor shall provide the Contract Manager with two ~~} written denial letters from different insurance companies evidencing the Contractor's attempts to obtain and inability to obtain the requisite insurance. The Contractor shall provide this inforrnatian to the Contract Manager within ten { ~ ~}days of the award of the Contract. i. The Contractor shall also attempt to obtain the insurance required ire subsection 1, above, an an annual basis. If the Contractor is not able to obtain insurance, the Contractor shall provide the Contract Manager with the documentation required in subsection 3, above, to demonstrate the Cantrattar's compliance with this sec~an. 4, All required insurance policies shall include an endarsernent stating that the Department shall be given thirty ~30~ calendar days written notice of polity or bond cancellation or a material change in the policy ar band. 5. The Department may waive all ar part of this insurance requirement at its discretion, 111. section 1!l of the Original Contract is deleted in its entirety and the following provision substituted for same: A. The Contractor is required to submit quarterly reports and an annual year~end~ sport timely and accurately. The quarterly reports will be submitted to the Department due by the 1~ day after the end of each quarter. The annual year-end report will be submitted to the Department na later than ~~ days after the end of the fiscal year. Cuarterly and year-end reports must be submitted on the report templates provided by DFP. The Cantractar shall accurately complete or ensure accurate completion of program forms, including but not limited to the registration form, services tracking farr~, and outcome surveys. All farms must be an the template required by the Department except as approved in writing by the program's program specialis#~ The Contractor shall enter data into the PEI database accurately, timely, end an an ongoing basis to ensure that data far a specific month is data entered into the system within six ~~~ days of the close of the month, but no later than g days following the close of the month of services. B. The Contractor shall submit service delivery reports required by the contract ar self~evaluations of performance and all other reports requested by the Department in appropriate format and an a timely basis; and make available at reasonable times and far reasonable periods client records and other programmatic ar financial records, books, reports, and supporting documents for reviewing and copying by the Department, the U.. Department of Health and Human services, or their authorized representatives. C. In developing, copying and disseminating reports or other informa~an under this contract the Contractor hereby agrees to the fallowing: 1. Grant to the Department the right to copyright, use, reproduce, and distribute any material written ar produced by the Contractor that is subject of this contract ~. Defend any claim, suit, or proceeding brought against the Mate of Texas ar the Department on the issue of infringement of any copyright by any product, ar any product part, supplied by the Contractor to the Department under this agreement subject to the jurisdiction of the Attorney General of Texas. The Contractor v~rill pay, subject to limitations specified in this section, any 1~inal judgment entered against the Mate of Texas ar the Department on this issue in any salt ar proceeding defended by the Contractar~ The Contractor will be relieved of this obligation if within thirty ~3a}days after the Department receives notice, the Department fails to notify the Contractor in writing of any claim, suit, ar proceeding, and at the Contractor"s expense, give the contractor all infarmatian needed to defend any claim, suit or proceeding, The Cantractar will report to the Department within thirty ~3a~ days and in reasonable written detail, each nonce of claim of copyright infringement pertaining to this contract of vwrhich the Contractor has knouvledge. 1111. ectian Vll. E. of the Original Contract is deleted in its entirety and the fallowing provision substituted for same: Direct Contact with Ctients. Prevent or promptly remove any employee, subcontractor ar volunteer fror~ direct client contact andlar from access to client retards who is alleged to have committed acts of abuse, neglect ar exploitation of children, the elderly or persons with disabilities; or an offense under the Texas Penal Cade against the person; against the family; against public order or decency; against public health, safety ar morals; 1~ag~ ~ against property; or an offense under Chapter 481 of the Texas Health and Safety Code Texas Controlled Substances Act}; or any act or offense that can reasonably be associated with potential risk of hafm or loss to the Department andlar its clients based are the job duties or contractual roles} of the person in question at any time during the contract period, If it is determined, with certainty, that the person in question has not committed the acts or offenses alleged, that person may again be assigned to direct client contact and for access to client records; however, the Contractor or Subcontractor shall notify the Department of its intent to da so no later than ten ~1 D} business days and receive Departr~ent approval prior to the reassignment. The Contractor or Subcontractor must provide the Department with further information concerning the reasons for the reassignment upon the request of the Departmen#. If the person in question is found to have committed any of the acts ar offenses listed in this paragraph, that person shall not be reassigned to duties involving any direct contact with clients andlor access to client records, Contractor will immediately remove access capabilities to any DFP automatedlinternet based applications} or immediately notify DFPS that access to such applications needs to be terminated for any employee, subcontractor or volunteer whose employment, subcontract, or volunteer term with the contractor has been terminated for any reason. 1111. Section VII. ~.. of the Original Contract is deleted in its entirety and the fal#owing provision substituted far same: Diecloeure and Release. Disclose and release, or cause its employees, subcontractors and volunteers with direct client contact andlor access to client records to disclose and release, any allegation made against that employee, subcontractor or volunteer alleging the commission of an act of abuse, neglect or exploitation of children, the elderly or persons with disabilities; criminal history or any current criminal indictment for felonies} ar information afar misdemeanors} involving an offense described in Section VII above. This disclosure and release is required of all individuals who have, or will have, direct contact with clients andlor access to client records, prior to such contact or access and shall be accomplished through use of ~a} a criminal history background check; fib} a DFP abuse and neglect history check and ~c} a signed disclosure and release by each such person attesting to this information, which shall be maintained by the contractor, available for review by the Department, and renewed at ir}tervals not to exceed ~4 months while the contract is in effect. 1!(. Section VIII of the Original Contract is deleted in its entirety and the following provision substituted for same: Service Pravislons. The Department has identified the need for the CYD program to increase the number of clients being served, therefore ~e Department has removed the contractual obligations pertaining to "evidenced based"' services In return #or the removal of this obligation, the "Target' far Output #~ has been increased accordingly, The Contractor Fiscal Agent} shall provide services based on the results of the community strengths and needs assessment, Request far Proposal criteria and recommendations of the CYD Callabarative Committee Review Committee via development of subcontracts with designated service providers, if said providers meet the subcontracting requirements of the Department and Contractor. Based on the recommendations of the CYD Collaborative Committee Review Committee and within the funding limits set in the Request for Proposals, the Contractor may provide direct services to the CYD program. The Contractor Plan of Operation must be submitted on the DFPS~required template and be submitted in can~unctian wi#h the contract and budget as supporting materials. The Contractor shall follow the Pian of Operation, ar any changes in service delivery shall be addressed via update of the Plan of Operation, and submitted to the Department within 3D days. Plans of Operation for subcontractors must contain the fallowing information; 1. A detailed program description ~. Inclusive dates for service provision 3. Goals of the program andlor service, including the impact on juvenile crirr~e ~. Days and hours during which services will be provided . Name of organi~a#ion responsible far providing services and the location where the services will be provided ~. How cervices will be available to youth andlor families without transportation 7. "Safe passage" plan far youth andlar families without transportation 8. Population to be served by the program g. The number of unduplicated youth andlor family Members to be served ~ D. An explanation of haw DYD funds will be used to enhance existing services, if applicable 11. Description of how service pragrarns will be culturally diverse ~2. Staffing plan, with personae! qualifications, job descriptions, criminal check verification, and training ~a~~ 3 ~Ilinor changes in service delivery shall be negotiated between the service provider and the Contractor and reported to the Department within 30 days. Any changes to the type of service to be provided, ar requiring development of a new subcontrac#, must be approved in advance by bath the Review Committee and the Department. Any changes not requiring prior approval from the Department must be reported to the Department within 0 days. The Contractor must add Its services to the appropriate ~-~ ~9 Area Information Center where Its CYD services are provided no later than April 9, ~OOfi and must update its information appropriately within 3D days of any changes in the scope of its CYD program, The Contractor must ensure all subcontractors have also added their services to the ~-9-~ Area Information Center. A. ln~r~v~uc#fon. The ~4~' Regular Legislative Session, In House Bill 3~7, created the Comaunity Youth Development grants. ~Sectian g~, Amending Artiele 449 3 X503}, V.T.C.S., by adding Sec#ion ~ B.~ The Baal of the CYD program is to assist comaunities, identified by high incidence of juvenile crime, in alleviating family and community conditions that lead to juvenile crime. B. ~eo~raphrc Area. The Contractor shall serve CYD eligible participants in III' code 7849 ~ in Nueces County of the State of Texas. Eligible participants include youth through age 17 who live in andlor attend school in the designated Zl~ code. The target age range is 10 to 97 years, Family members meeting eligibility criteria as defined in Section C, 3~b~ below may be served through CYD. C. CYD er~rices~ The Contractor is responsible for the fallowing tasks, as related to service delivery through the Community Youth Development program: 1. TMe Contractor is responsible far providing written documentation of the link between the needs assessment, funding priorities outlined in the local RFP, and contracted services; and must conduct procurements that are in accordance with appropriate state and federal guidelines and with the guidelines set Earth in this RFP For years in which a Contractor renews contracts, written documentation must be provided that supports the services currently funded and the decision to renew. 2~ As part of the performance measures, service providers will be responsible for implementing apre- testlpost-test program evaluation design quantifiably demonstrating a significant increase in the identified assets as a result of program participation. In addition, the Dontractar must have written policies and procedures in place detailing actions that will be taken if and when a subcantractar does not successfully meet established performance measures. 3. The Contractor is also responsible for the following: a. Ensuring that the percentage of you#h under the age of 9 a served does not exceed the percentage cap in RFP 2~Ofi~99~a'I PEI. This cap must be met each month by each individual service, If the cap is exceeded, those youth may be considered ineligible and costs may be disallowed. b. Ensuring that family mer~bers of eligible participants only participate If the service involves the eligible youth ar if the service provided to the family member can be directly linked to having an impact on the youth participant's likelihood of engaging in delinquent behavior. c, Whether provided directly by the Contractor or through subcontract, Cantrac#ars are responsible far: Ensuring the YAC is comprised of a diverse group of youth, not just yau#h from one CYD program; * Ensuring par~cipation of at least ~U active youth who are either in middle Schaal yr high school • Ensuring the YAC meets at least ante per r~anth and for a minimum of four hor~rs to accomplish roles and responsibilities of the YAC; • Ensuring adequate participation from the YAC in CCC meetings, the needs assessment, and the Review Committee, as required in RFP 240fi-g9-0g9-PEI; • Ensuring the YAC solicits feedback regarding the CYD program from youth part~crpants and that services are appropriately responsive to youth creeds based on the information provided; • Ensuring full participation at the Teen Summit. d. Ensuring that measurable performance measures appropriate to youth leadership development are in the subcontract of the provider offering services to meet the youth leadership development requirement, if that service is subcontracted. e, Ensuring that at least g0°lo of the participants involved in nrentaring services are within the targeted grades {4~' - 8~`}. D. Adl~irristra~ion. The Contractor is accountable far the following administrative responsibilities gage 4 related to the Community Youth Development program. 1, The ttengths and needs assessment must meet the minimum requirements defined by DI=PS, be sufficiently dacumented, be the collaborative effort of the Contractar, Youth Advisory Committee end CYD Collaborative Committee and rust be completed in a ~mely manner so as to allow the Contractor to meet contractual deadlines. If the contract will be renewed, all re ~ewal information required by the Department is due to the Department no later than June 1 ~ of the year prior tv the beginning of the next fiscal year, The assessment must focus an, but is not limited to, needs and strengths related to juvenile delinquency prevention. 2. The Contractor is responsible for ensuring that; Colleborative Committees establish a formal, written selection process to assure fair and objective selection ol* Review Committee members • Review Committee members consist of a minimum of flue members, that ~~°lo or mare of the members reside in the ZIP code end that at least one member of the YAC participates • All Review Committee members sign written conflict of interest and confidentiality statements prior to reviewing proposals • Term limits for participation on the Review Committee are enforced • Review Camrni#tees use a consensus process to make recommendationsduring the Iocal procurement 3~ The Contractor is responsible for ongoing management and monitoring of subcontracts. This includes appropriate negotiations of contracts at bath procurement and renewal, ensuring timely and accurate billing and submission of required program documentation, and formal on- site manitaring~ Any finding ar issue dacumented in a monitoring report for a Contractor by DFP in which a subcontractor's performance played a considerable part will be considered significant mismanagement of subcontracts on the part of the Contractor. ~~ The Contractar 'rs expected to be adequately prepared so that contractual deadlines for quarterly reports, the year-end report, and renewal information acre met. Quarterly and year- end reports must be submitted an the report templates provided by DFP. ~. The Contractar is expected to properly manage its budget and should not lapse a signifcant amount of the contract budget at the end of each fiscal year. 6. The Cantr2~ctor is expected to hold a minimum of four CC meetings, one each quarter and at least one cor~munity meeting, The first CCC meeting of the year should be an annual planning meeting. Minutes, active attendance rosters and attendee sign-in sheets must be documented and submitted to DFP by the prescribed deadlines. ~[. The provisions Qf this section shall supersede any performance measures set Earth in the Original Contract, Performance Measures. Pursuant to Texas Murnan Resources Code 4~.~58 fall contracts for client services must include clearly defined goals and outcomes that can be measured to determine whether the objectives of the program are being achieved. The department will use the following performance measures to evaluate the success of the Contractor's performance of services under this contract. Output Measures Output ~~: Number of youth served monthly by the Community Yo~,th Develaprnent program. Output Performance Period; Contractor performance on this output will be measured monthly throughout the contract period for each calendar month. If the contract period is more than one year, each performance period will be for the 1 ~~manth period corresponding to the state fiscal year, ar part thereof, if the contract period begins after the state fiscal year, Indicator: Total number of unduplicated youth served by the Community Youth Development program in each calendar month. Target; The target far this measure will be determined after baseline data are collected from the youth participating in services during prior fiscal years of the program. A target better than baseline will be established for the subsequent contract period, Purpose: To evaluate the Contractor's success in providing Community Youth Development program services to targeted yauth.Data source; PEI Database ~ag~ 5 hllethodolagy. Sum of all unique youth registration lD numbers within the PEIS database where at least one individual youth received a minimum of one service within the month. Ou#put ~~: Number of youth served during each fiscal year by the Community Youth Development program. Output Performance Period: Contractor performance on this output will b measured annually. if the contract period is more than one year, each performance period will be for the 12-month period corresponding to the state fiscal year, or part thereof, if the contract period begins after the state fiscal year. Indicatory Total number of unduplicated youth served by the Community Youth De~relopment program during the fiscal year. Output ~3: DFP Protective Factor Surrey Questionnaires are completed, Output Performance Period: Contractor performance on this output will be measured for the contract period. if the contract period is more than one year, each performance period wi11 be for the 1 ~r~onth period corresponding to the state fiscal year, ar part thereof, if the contract period begins after the state fiscal year. Indicator; Percent of eligible target youth who ca~nplete a pre- and apart-service Protective Factor Survey Questionnaire. Purpose: To evaluate the Contractor's success in obtaining completed pre- and post service Protective Factor Survey Questionnaires from eligible youth. Definitions: Com fete - At least GO°lo of the items ors the pre and the post~service Protective Factor Survey Questionnaire are completed. El~ble - To complete the pre-service Protective Factor Survey Questionnaire, the par~cipant must meet the criteria far eligibility and acceptance into the program. To om fete the ost-service Pro five Fa tar Surve Questionnaires, the participant must have: ^ Completed the prescribed program; ar Participated in the program far ~~ ~ months frorr~ the date when the Pre-Protective Factor Survey was completed; or ^ Been receiving program services far the length of time required to achieve benefit as defined by the Contractor and approved by DFPS and stipulated in the contract plan of opera~ons. The Contractor is required to ensure that the target youth completes the pre- and post-service Protective Factor purvey Questionnaires. Target; 8~°l0 Data Source; PEIE Database I~ethadology; The numerator is the number of eligible Community Youth Development program target youth that have a completed pre- and post-service Protective Factor Survey Questionnaire in the i~E15 database for the output performance period. The denominator is the total number of eligible Community Youth Development program youth entered into the PElS database far the output performance period. Divide the numerator by the denominator, then multiply by 14D and state as a percentage. Output #4: DFPS Satisfaction Questionnaires for Community Youth Development program services are completed by youth receiving services in the Car~muni#y Youth Development program. indicator: Percent of eligible Community Youth Development program youth who complete the DFPS satisfaction questionnaire. Purpose: Ta evaluate the Contractor's success in obtaining completed satisfaction survey questionnaires from Page 6 the youth. Definitions. Target: ~D°lo Data Source: DFPS Satisfaction Questionnaire Methodology: The numerator is the number of eligible Community Youth Development program youth for which a Satisfaction Questionnaire was completed for the output performance period, The denominator is the total number of efigibie target youth served during the output performance period. Divide the numerator by the denominator, then multiply by ~ 00 and state a a percentage. Output Performance Period: Contractor performance an this output will be r~easured far the contract period. if the contract period is more than one year, each performance period will be for the ~ ~~manth period corresponding to the state fiscal year, or part thereof, if the contract period begins after the state fiscal year, Outcome lVleaures Outcome #1: Youth report an increase in the targeted protective factors. Indicator: The aggregate increase in targeted prote~ive factors, as determined by comparison of the pre-service Protective Factor Survey Que~tiannaires to the post-service Protective Factor Survey Questionnaires. Purpose: To evaluate the Contractor's success at increasing protective factors in the target youth enrolled in the Community Youth Development program. Definition: Targeted Protective Factors- The protective factors the Contractor has identified its program will impact, Target: The target far this measure will be deterrrrined after baseline data are collected from the youth participating in services during all ar part of fiscal years 207-~~08 of the contract. A target better than baseline will be established for the subsequent contract pariad. Data Source: P~1 Database ~Aethodology: The methodology for calculating this measure will be determined by DFPS after the Protective Factor Survey Questionnaires have been finalized, and before baseline data begin to be collected. Outcome Performance Period: Contractor performance on thin outcome will be measured far the contract pariad. If the contract period is more than one year, each performance period will be far the "#~-month period corresponding to the state fiscal year, or part thereof, if the contract period begins after the state fiscal year. Outcome #~: Youth in Community Youth Development program will not engage in de#inquent behavior. Indicator: Percentage of youth that are not referred to juvenile probation while registered in and receiving services from the Community Youth Development program. Targe#: 9a°la purpose: To evaluate the Contractor's success in keeping youth in the Community Youth Development program frorr~ engaging in delinquent behavior. Data Sources: TJPC and PFIS Database. Methodology: The numerator is the total number of Community Youth Development program youth in which a target youth gage t~-~~} in the PFIS database is matched to a target youth in a referral to 'uvenile robation as indicated ~ data re orked b the Texas De artment of Juvenile Probation if the validated incident occurred during the outcome performance period .and while the youth was receiving services.
