The City of Corpus Christi, Texas, hereinafter called "City", and the Division of Nearshore Research {DNR) at Texas A&M University -Corpus Christi, hereinafter called "DNR", hereby agree to the following amendment: Section II. Scope of Services, A. Tasks 2-3 is amended to read as follows: II. SCOPE OF SERVICES A. TASKS: DNR will complete the following tasks: Year 1-modified scope. 2-3. Bathymetric surveys Description: These surveys combine single-beam and multi-beam sonar coverage to provide high resolution of features more economically. The channel from the GIWW to the GOM will be conducted with multi-beam to ensure identification of bank-to-bank features such as shoals, scour holes and sand bars. The region immediately offshore of the mouth (area of seasonal scour and shoaling will be surveyed with multi-beam while the remaining nearshore survey will combine single-beam sonar and sled technology to provide complete coverage of the shallow nearshore bar features. The region that will be covered by the survey is shown in Figure 1. Purpose: to define features such as shoals (areas of deposition) and scour (areas of erosion) in the channel and nearshore. Schedule: Four surveys scheduled to define the peak of seasonal change. The surveys would be conducted during the last two weeks of the following months; February (Winter), May (Spring}, August (Summer) and December (Fall). Note: Amendmenk No. 1 upgrades the February 2008 survey to amulti-beam survey that is presently scheduled and sponsored as a single beam survey by the Corps. In addition, the Carps will sponsor multi-beam bathymetric surveys that will be conducted during May and August 2008. Therefore, the four surveys to be conducted during this contract period would begin during December 2008 and conclude in December 2009. Amendment No. 1 will provide greater detail of bottom features, thereby improving capability of determining trends in sediment transport in Packery Channel. The multibeam technology will provide bank ko bank coverage in the entrance channel and inland waterway and provide coverage to depth limitations of 5 ft (MSL) in the basin. The survey will provide coverage of the region surrounding the jetties in the Gulf of Mexico. The multibeam survey wilt be conducted according to the original schedule at the end of February or first week of March (weather dependent) to define conditions for the winter period (December through February). The survey area addressed by Amendment No. 1 wilt include the entrance channel, deposition basin and inland waterway to and including a small section of the GIWW {Figure 1). The offshore region immediately surrounding the channel mouth (.5 mile box} will also be surveyed (Figure 2}. All survey operations for Amendment No. 1 are to be completed by the end of February 2008 or first week of March 2008, weather permitting. The proposal for the multi-beam upgrade is attached as Exhibit A-1. III, FEES AUTHORIZED The City will pay DNR a fixed fee not to exceed $252,507.00 for providing all services for during the contract term (12 months}. The fee consists of an original contract fee of $241,487.00 and a fee for Amendment No. 1 of $91,020.00. This fee will be full and total compensation for ail services provided and expenses incurred in pertorming the tasks specified in Section il. Invoices will be submitted to the Director of Engineering Services. Invoices will be submitted no more frequently than once per month for services rendered. All invoices shall be accompanied by a cover letter summarizing project status and the tasks undertaken during the time period covered by tale invoice. Invoices will be based on the budget attached as Exhibit A. Invoices will be sequentially numbered for each project, state the project name (Packery Channel Quarterly Monitoring Project) and City project number (5228}. The letter shall state the number of the current invoice, the total authorized fee, the amount previously invoiced, and the current amount due. Statements will be based upon percent of project completed. However, a final payment of $3,500 will be retained until delivery of the final report. All other terms and conditions of the February 26, 2008 contract, as amended, between the City and Consultant shall remain in effect.
