The City of Corpus Christi, Texas hereinafter called "City", and COYM. RENNET &
GUTIERREZ ENGINEERING, INC., hereinafter called "Engineer", agree to the following
amendment to the Contract far Professional Services far Lift Station at Buckin ham RFQ 99-
01 Z (Proiect No. 7117} as authorized by:

- Exhibit "A", Section 1. Scope of Services, Part A. Basic Services and Part B. Additional
Services is amended as shown an the attached "Amendment No. 5, Exhibit A" and
summarized below:
1. Preparation of a ROW strip map for Yorktown Boulevard from South Staples
Street to Cimarron Boulevard and performing ROW acquisition surveys for the
adjus#ed force main route along Yorktown Boulevard.
2. Updating the plans for the Buckingham Lift S#ation to bid as a "stand atone"
project. The revised set of plans will reflect new equipment and standards now
required by the Wastewater Department for lift station design and construction.
- Exhibit "A" Section III. FEES shall be modified as shown on the attached
"Amendment No. 5, Exhibit "A" for a revised fee not to exceed 49 550.00 Fo -Nine
Thousand Five Hundred Fif#-- Dollars and Zero Cents}, for a total restated fee not to
exceed 435,686.00 (Four Hundred Thirty-Five Thousand Six Hundred Eia_hty-Six
Dollars and Zero Cents}. ~~~
All other terms and conditions of the Contract and Amendments between the City and Engineer
will remain in full force and effect.

Buckingham Lift Station and Force Main
City of Carpus Christi Project No. 7117

We were recently instructed to prepare an amendment to our original contract for the following:
Preparation of a ROW strip map for Yorktown Blvd. from S. Staples St. to Cimarron Blvd and
performing ROW acquisition surveys far the adjusted force main route along Yorktown Blvd.
2. Updating the plans for the Buckingham Lift Station to bid as a "stand alone" project. The
revised set of plans will reflect new equipment and standards now required by the Wastewater
Dept. for lift station design and construction.
An explanation follows:
1. A ROW strip map will be constructed for the section of Yorktown Blvd. from S. Staples St. to
Cimarron Blvd. The strip map will be utilized to ascertain additional ROW and easements required
for the reroute of the 18" force main from the Buckingham Lift Station to the 1 S" farce main
presently being constructed under the Cimarron Blvd Phase 1 project. ROW and easement
acquisition surveys will be performed and plats and field notes submitted to the Engineering Dept.
for land acquisition.
2. As you may recall, the original approved plans set included all lift station improvements as well as
approximately three miles of 18" PVC force main. Since the time of the original plans completion
and approval in March 2004, a new Master Plan has significantly changed the route of the force
main. The new route will require additional land acquisition and design. Also, since the completion
of the original plan set, new equipment and standards for lift station design and construction have
been adopted by the Wastewater Department. These new standards require significant changes to
the lift station original plans in all disciplines associated with the project. We have reviewed the fees
contained in our original contract and found that the Inspection Fee for the lift station as presently in
the contract is $57,250.00. It is our opinion that, given our geographic location near the site and the
usual pace of lift station construction, our firm can properly oversee the lift station construction
under the Construction Administration portion of our contract. Therefore, it appears that a portion of
the inspection fee of $57,250.00 shown in our original contract can be deleted.

DEFINITIONS
a. "Board Member". A member of any board, commission or committee appointed by the City Council of the City of
Corpus Christi, Texas.
b. "Employee". Any person employed by the City of Corpus Christi, Texas, either on a full or part time basis, but not
as an independent contractor.
c. "Firm". Any entity operated for economic gain, whether professional, industrial or commercial and whether
established to produce or deaf with a producf or service, including but not limited to, entities operated in the form
of sole proprietorship, as self-employed person, partnership, corporation, ~oint s#ock company, joint venture,
receivership or trust and entities which, for purposes of taxation, are treate~ as non-profit organizations.
d. "Official". The Mayor, members of the City Council, City Manager, DeAuty Ci(y Manager, Assistant City Managers,
Department and Division Heads and Municipal Court udges of the City of Corpus Christi, Texas.
e. "Ownership Interest". Lego! or equitable interest, whether actually or constructively held, in a firm, including when
