E3ox 9277, Corpus Christi, Texas 78469-9277 (City) acting through its duly authorized City Manager or Designee (Director of Engineering Services) and Chiang, Patel, and Yerby, Inc., a Texas corporation, 1820 Regal Row, Suite 200, Dallas, Texas 75235, (ArchitectlEngineer -Consultant}, hereby agree to the amendment of the contract administratively approved December 21, 2007 and amended by Motion 2008-005, January 8, 2008 and amended administratively by amendment January 3, 2008 as follows: Section B. Basic Services; Sect+on 1 Design Development- Preliminary Construction Document P1~ase (6Q%}, Subsection f. is amended to add the following: • revise ceEl construction schedule based on an expedited opening of next disposal cell to accommodate the remaining disposal capacity of Cell 3D; and • include storm water pond 1 with a realigned channel RSR 1 which addresses a negative slope and conflict with actual maintenance facilities location as included in the permit amendment. Section B. Basic Services; Section 2 Construction Document Phase 100%} Subsection k and I are added to read: k. preparation of mass excavation plan for Cell 4A to expedite completion of Cell 4A, including drawing sheets, specifications, and guidelines for issuance of a separate work order by the Ciry including survey staking and documen#atian survey of completed excavation; and I. preparation of separate bid, contract, plans, and specification documents to bid Cell 4A and Cell 4B for separate contract award. Section IIf Fees Authorized is amended to read: ll. SEES AUTH~~t~ED The City will pay the Consultant a total not to e~cced fee of 27,~30,Oa, The fee consists of. • An original contract fee not to exceed fee of $50,~a0~D~; • a fee far Amendr~er~t No. ~ services not to exceed fee of $14~,a0a.aa; • a fee for Amendment Na~ ~ services not to exceed ~g,~~D.BO; and • a foe for Amendment No. 3 services not to exceed 49,34. Consultant will be compensated for airfare, ground transportation, lodging, and per diem meal expenses incurred duo to out-of-town travel on a not to exceed basis as set forth in the Bummary of Fees, Travel will be wili be documented by photocopies of receipts and invoices. Per Diem will be at the GBA rate. The table "Summary of Foal" shall be used when calculating the fee due for the proportion of services completed. The City shall make pror~pt payments in response to Consultant's statements for Professional Services. Invoices will be sequentially numbered for each project and state the project name. The letter shelf state the number of the current invoice, the contract fee for each task, the amount previously invoiced for each task, and the current amount due, Invoices will be organized to accommodate funding sources. During the construction phase, the ArchitectlEngineer gill also submit a brief letterlrnemo summarizing observations during the site visit, the work of the contractor, construction progress for the billing period, and any pending items.
