Box 977, Carpus Christi, Texas 7549-9277, hereina~er called "City" and Nueces Hotel Holdings, LP, Developer}, 3401 Allen Parkway, ate 2D0, Houston, 77019 hereinafter called r'Developer". HER~A~ Developer ~s developing a ubdl~lslon known as, Lots 17A, ~ 7B, and 17C, Forest Park Addition Unit containing 5.746 acres of land located north of Buffalo street east of a Nueces Bay Boulevard, as shown an attached location map, ~xhzbit 1; and AREA, the Developer has submitted construction plans that shams the extent of the irnpravements; ~VH:EREA, it is in the best Interests of the City to have a public mater 1~ne installed by the Developer in conjunction with the Developer's project; N~, 'THE~EF~IiE, in order to provide a coordinated public mater construction project, the City and Developer agree as fallov~s: The Developer mill construct the public mater line for and on behalf of the City along buffalo treet~ The public water line is required to be constructed in accordance with the plans and specifications approved by the City Engineer, The total cost of the City's share of the publlc mater line constructlan, ~~ depleted an In ~11~1~ ~~ ~s ~~ 9,779.9 ~ .
