HomeMy WebLinkAboutC2008-115 - 4/8/2008 - Approved r ~ Page ~ a INTERI~oCAL C~OP~RATI~N AREEI~ENT BETVI~EEIV THE CITY DF COI~PU CHRIBTI AND DoRPU CHRISTI II~DEPENDE~IT BCHO~L DIBTRI~T This agreement Agreement} is entered into between the City of Corpus Christi, a Texas hone-rule municipal corporation City}, and the Carpus Christi Independent Schaal District District}far purposes of the Interlacal Cooperation Act, Texas Government Cody, Chapter ~9~, a areended, to achieve efficiency in meeting intergovernmental responsibilities. V1~HEREA, the City is sponsoring summer recreational programs far children from June 6, ~a08, to August 8, ~QQB at which food will be served ~ur~r~er Food Program}; and V1~HEREA, the District agrees to provide ~tniti~ed lunch and snack meals} inclusive of milk and juice thereinafter collectively referred to as IVleals}, to the City far a fixed fee. NOW, THEI~EFOIE, the City and the District, in consideration of the mutual covenants contained herein, agree as follows: 1. Term. This Agreement begins June , ~Oa8 and ends August 8, ~OQ~. Consideration. The City shall pay the District 2.aa per lunch veal and .GO per snack meal. 3. Billing. The District shall bill the City an a monthly basis forall Meals provided to the City. The City shall pay the bill within two Fridays afker receipt of the bill out of current City revenue, 4. l~lut~itional Assurances. The District assures that each Meal will meet the minimum nutrition value and content requirements, in accordance with the Texas Health and Human services Commission FY ~a08 hummer Food service Program regulations. . Recordkeeping. A. The District rr~ust maintain full and accurate records including, but not limited ta, the follavuing: 1. Menu records ~~lenu Records}, including the amount of foal prepared; and 2. Meal records Meal Records}, including the daily number of Meals delivered by type. B. The District must provide monthly reports of Menu Records and Meal Records to the City's Director of Programs} ar designee, within ten business daysfollowing the end of each month during which Meals are provided. C. The District must retain the Menu Records and Meal Retards far ~ years and 9Q days, or so long as an audit i in progress. The District must make all retards and accounts pertaining to this hummer Food Program available to representatives ofthe United states Deparkment of Agriculture and the General Accounting Office far audit or administrative review at a reasonable time and place. Food service operations. The foal service workers will continue to be the District's employees for the terra of this Agreement and, therefore, subject to the District's board policies and regulations. Their salaries and benefits, if any, will be paid out of the City's consideration payments set out shave, 8. Coordination. The City's Director of Perks end Pecreatian, or designee, shall place a weekly artier with body l~oustor~, the District's appointed representative, ar designee, far the number of Meals by type needed, the sites at which the Meals are needed, and the tine at which the Meals must arrive at each site. 9. Governmental Service. This Agreement is between the City and the District for the purpose of providing Meals far the Summer Food Program sites and activity sites and is not for the benefit of any third partyarindividual. ~0. Current Revenue. All money spent for this hummer Faad Program through this Agreement must be spent out of currently available revenue of the City and the District. ~ 1. Entirety cause. This Agreement expresses the entire agreerr~ent between the parties. Any modification, amendr~entt or addition to this Agreement is not binding upon the parties unless in vuriting and signed by persons authorized to make these agreements an behalf of the respective party.
