I, Gollihar to SPID, Parcel l Right-of--Way Easement THE STATE OF TEXAS § COUNTY OF NUECES § KNOW ALL BY THESE PRESENTS: THAT Adolph M. Gonzales; Mary Isabel Gonzalez Palacios, Individually and as Independent Executrix of the Estate of Rosa Gonzalez, Deceased; Manuel M. Gonzales; John Joe Gonzalez, Individually and as Independent Executor of the Estate of Joe M. Gonzalez (a/kla Jose M. Gonzalez), Deceased; Richard Charles Gonzalez; Alphonso M. Gonzales, Jr, and Eric Gonzales, (herein collectively called "Grantors") of 4841 Cheryl, Corpus Christi, Nueces County, Texas 78415 in consideration of TEN DOLLARS ($10.00) and other goad and valuable consideration to Grantors in hand paid by the City of Corpus Christi ("Grantee"), of i 201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, have conveyed, and do convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description attached and incorporated as "Exhibit A". (Premises) Map showing the Iocation of the RIGHT-OF-WAY EASEMENT TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as "Exhibit B". The Temporary Construction Easement is further described as 15 foot wide, east of and adjacent to the permanentRight-of--Way Easement. Said Temporary Construction Easement is to be used for working room and storage of materials and machinery during the construction phase. This Temporary Construction Easement automatically terminates upon the first of the following: i) one year from the recording date of this instrument or ii} upon completion and acceptance of the Greenwood Drive, Phase 1 Improvements Project by the City Manager of the City of Corpus Christi, Texas. Together with the free ingress, egress and regress to and far the City of Corpus Christi, Texas, and its franchisees, to construct, operate, repair and maintain streets, sidewalks, curbs, gutters and appurtenances upon said Premises for the public use by foot, with automobiles, carts, carriages and all other vehicles and all other means of transportation necessary or convenient at all times and in all seasons in, along and upon said Premises, as well as to construct a public bus stop facility and related improvements, on, over, under and along said Premises. 2008-168 05/09/08 Ph. 15ROW_Gon~les e~al.dce Gonzales, Adolph, M Palacios et al TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Carpus Christi, Texas, its successors, legal representatives, franchisees and the public, for the proper use as public streets, public bus stop and related improvements, Temporary Construction Easement for so long as used for such purposes, and if the use for said easements and rights of way is ever abandoned, then the aforesaid rights and privileges cease. COUNTERPARTS: This Right-of--Way Easement maybe executed in counterparts and each shall have the effect of an original. Grantors: Adolph M.
