Home My WebLink AboutC2008-182 - 6/11/2008 - NARATIFICATION AND AMENDMENT No. 22 to AGREEMENT FOR ARCHITECTIENGINEER CONSULTANT SERVICES The City of Corpus Christi, Texas hereinafter called "City", and Shiner Moseley and Associates, Inc., hereinafter called "Engineer', agree to the following amendments to the Contract far Engineering Services for the Cefe F. Valenzuela Landfill, as authorized by Motion. No. 96-035, passed February 13, 1996, and as amended by Motion No 96-318, passed October 15, 1996, and as administratively amended on March 14, 1997, March 27, 1997, November 4, 1997, Motion No. 97-380, passed December 23, 1997, and Motion No. 99-358, passed October 12,1999, and administratively amended September 22, 2000, administratively amendment January 13, 2003, and Motion No. 2004-459 passed December 21, 2004 and Motion 2005-385 passed November $, 2005, and Motion 2006-007 passed January 17, 2006, and administratively approved February 16, 2006 and Mo#ion 2006-201 passed July 11, 2006 and administratively approved August 14, 2006, and administratively approved August 21, 2006, and administratively approved January 5, 2007, and Motion 2007-051 passed February 20, 2007 and administratively approved April 22, 2007. Section III. Additional Services, is amended by the addition ofi design and construction phase services to cons#ruct Storm Water Detention Pond 3 to its entire 26 acre capacity. Task 4.22 is added to read: TASK 4.22 Storm Water Detention Pond 3 - The Engineer will provide design of the full pond including modification of the pond "footprint" to maintain the required detention area while avoiding surface features such as leachate storage ponds, existing oil wells and pipelines. The design will include new access roads to two operational oil wells adjacent to the Storm Water Pond 3. The design will inlcude modifications to landfill perimeter fence necessary to accommodate the modified pond and maintain access to oil wells by well operators. The Engineer will coordinate with JV Construction (pipeline contractor) and Alan Geisler (oil well owner}. The Engineer will provide construction phase services for the construction of Storm Water Pond 3 and coordinate with multiple contractors working at Cefe Valenzuela Landfill including Allied Wastes, King Isles, Longhorn Excavators, JV Construction, Fast Flow, and D&C Fencing. Engineer is to work to expedite completion of Storm Water Detention Pond 3. SECTION VI. FEE is amended b the insertion of Phase ill fees to read: Section VI. FEE. The City will pay the Engineer a restated total not to exceed fee of $4,359,503.00. This fee will be full and total compensation for all services provided and expenses incurred. The fee is subject to the availability of funds. The Engineer may be directed to suspend work pending receipt and appropriation of funds. This amendment authorizes the following fees: A. FEE FOR ADDITIONAL SERVICES The City agrees to pay the Engineer for services provided in accordance with the Scope of Services and Fee under this Amendment, an additional fee for additional services not to exceed $36,200.00. The revised total fee as amended is not to exceed $4,359,503.00. The total amended fee is the full and total compensation for all ~Rrvices provided and expenses incurred by the Engineer. For services authorized by Shiner Moseley & Assoc.,Tnc. the Director of Engineering Services under Section 111 "Additional Services", the City will pay the Engineer a fixed fee for providing services authorized as shown by the Summary of Fees attached as Exhibit A-21 on the following page.
