AMENDMENT N0.3
CONTRACT FOR PROFESSIONAL SERVICES
This City of Corpus Christi, Texas hereinafter called "CITY", and RVE, INC., hereinafter called "CONSULTANT",
agree to the following amendment to the Contract for Professional Services for Laguna Shores Road -Graham
Road to Hustlin' Homet (Bond 2004) (Project No. 6278) as authorized and administratively amended by:

- EXHIBIT A., SECTION 1. SCOPE OF SERVICES, PART B. ADDITIONAL SERVICES shall be modified by
the additional paragraph as follows:
Prepare Mitigation Plan. Furnish the City documentation necessary for required mitigation plan.
Perform wetland delineation survey, endangered species survey, archaeological survey and
topographic survey at site shosen by City. Prepare and submit mitigation plan, for the Van Galen
Ditch tracts, to the U. S. Army Corpos of engineers (USAGE) for review and comment.
10. Respond to Agency Comments. Response to agency comments and revisions to the mitigation
plan submitted in Item No. 9.
- EXHIBIT "A" SECTION 3. FEES, PART C. SUMMARY OF FEES shall be modified by the attached Summary
of Fees as shown in the attached Exhibit "B" for a revised fee not to exceed $43,380.00 (FortyThree Thousand
Three Hundred Eighty Dollars and Zero Cents), for a total restated fee not to exceed $492,130.00 (Four

Amendment No. 3
Dear Mr. Stowers:
Per our discussion, I am submitting a revised Draft Amendment No. 3 for your consideration.
The revised Amendment includes a fee for preparation of the Mitigation Plan and for responding
to Agency comments on the Van Galen Ditch site. Please note that preparation of the plan
assumes a typical mitigation plan preparation approach and does not include any extensive
special studies. Fees for preparation of the mitigation construction plans are not included.
The proposed fees are:
Mitigation Plan: $ 32,980.00.
Response to Agency Comments: $ 10,400.00
Total Amendment $ 43,380.00
I expect it will take about 2 months to do the field work and prepare the mitigation plan for
submission. It will likely take another 2 months to receive agency comments. The back and
forth after receiving comments and submitting various revisions may require several more
months.

The roadway construction plans aze complete except for the bridge. As soon as we receive the
Geotechnical Report for the bridge foundation we can complete the plans and they will be ready
to bid, pending any revisions that maybe required for the final USACE Permit, which cannot be
issued until approval of the Mitigation Plan.

DEFINITIONS
a. Board Member. A member of any board, commission or committee appointed by the City Council of the City of
Corpus Christi, Texas.
b. Employee. Any person employed by the City of Corpus Christi, Texas, either on a full or part time basis, but not as
an independent contractor.
c. Firm. Any entity operated for economic gain, whether professional, industrial or commercial and whether
established to produce ordeal with a product or service, including but not limited to, entities operated in the form
of sole proprietorship, as self-employed person, partnership corporation, joint stock company, joint venture,
receivership or trust and entities which, for purposes of taxation, are treated as non-profit organizations.
d. Official. The Mayor, members of the City Council, City Manager, Depu~City Manager, Assistant City Managers,
Department and Division Heads and Municipal Court Judges of the Ci of Corpus Christi, Texas.
