HomeMy WebLinkAboutC2008-398 - 10/7/2008 - NA ~0 R I G I N A L °°°# 8008045864 DEPARTMENT OF ENGMEERMG SERVICES PROPERTY AND LAND ACQUISITION DIVISION Wood River Litt Station Upgrades and Force Main Ext. ~Z J Utility Easement THE STATE OF TEXAS COUNTY OF NUECES KNOW ALL BY THESE PRESENTS: THAT the Mostaghasi Investment Trust ("Grantor"), of 3701 Cimarron Boulevard, Corpus Christi, Nueces County, Texas 78414-3687, in consideration of $10.00 (TEN DOLLARS) and other good and valuable consideration paid by the City of Corpus Christi, ("Grantee") of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description for the UTILITY EASEMENT attached and incorporated as "Exhibit A". (Premises) Map showing the location of the UTILITY EASEMENT TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as "Exhibit B". (Premises) The Temporary Construction Easement is further described as a 10 foot wide construction easement, north of and adjacent to the permanent utility easement. Said temporary construction easement is to be used for working room and storage of materials and machinery during the construction phase. The Temporary Construction Easement automatically terminates upon completion and acceptance of the improvements of the Wood River Lift Station Upgrades and Force Main Extension project by the City Manager of the City of Corpus Christi, Texas. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility lines under, on and along said easement. Beginning, at a point on the north right-of--way line of that certain 150.00 foot wide roadway, known as F.M.
