Utility Easement
THE STATE OF TEXAS

KNOW ALL BY THESE PRESENTS:
THAT the Mostaghasi Investment Trust ("Grantor"), of 5830 Loire, Corpus Christi, Nueces
County, Texas 78414, in consideration of $10.00 (TEN DOLLARS) and other good and valuable
consideration paid by the City of Corpus Christi, ("Grantee") of 1201 Leopard Street, Corpus
Christi, Nueces County, Texas 78401, the receipt ofwhich is hereby acknowledged, has conveyed,
and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its
successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement
of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and
being described as follows:
See the metes and bounds property description for the UTILITY
EASEMENT attached and incorporated as "Exhibit A". (Premises)
Map showing the location of the UTILITY EASEMENT TOGETHER
WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and
incorporated as "Exhibit B". (Premises)
The Temporary Construction Easement is further described as a 30 foot
wide construction easement, east of and adjacent to the permanent utility
easement. Said temporary construction easement is to be used for working
room and storage of materials and machinery during the construction phase.
The Temporary Construction Easement automatically terminates upon
completion and acceptance of the improvements of the Wood River Lift
Station Upgrades and Force Main Extension project by the City Manager of
the City of Corpus Christi, Texas.
Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and
its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility
lines under, on and along said easement.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a
UTILITY EASEMENT and right-of--way for so long as used for such purpose, and if the use of said
easement and right of way is ever abandoned, then the aforesaid rights and privileges cease.

SQUARE FEET (0.298 ACRES), OUT OF LOT 1, SECTION 2, NUECES
RIVER IItRIGATION PARK, A MAP OF WHICH IS RECORDED IN
VOLUME A, PAGE 54, OF THE MAP RECORDS OF NUECES COUNTY,
TEXAS, THIS TRACT BEING MORE PARTICULARLY DESCRIBED BY
METES AND BOUNDS AS FOLLOWS:
The following description accompanies and is a part of a separate exhibit map.
Bearings are based on the Texas Coordinate System, South Zone (4205), NAD 83, derived from
measurements taken with Global Positioning System (GPS) equipment and referenced to the
monumented right-of--way of F.M. 624.
Beginning, at a point on the south boundary line of River Ridge Unit 2, a map of which is recorded in
Volume 67, Page 118 of the Map Records of Nueces County, Texas, for the northwest comer of this track
from which point a concrete monument Texas Department of Transportation Type 2 found on the south
right-of--way line of F.M. 624 bears North 84°58'00" East, a distance of 666.65 feet and North 85°03' 16"
West, a distance of 67.72 feet;
Thence, South 85° 03' 18" East, with the said south boundary line of River Ridge Unit 2, a distance of
15.04 feet, to a point, for the northeast corner of this tract;
Thence, South 09° 17' 32" West; a distance of 866.36 feet, to a point on the south boundary line of
aforementioned Lot 1, Section 2, Nueces River Imgation Park, for the southeast comer of this tract, from
which corner the southeast corner of said Lot 1 bears South 84°58'00" East, a distance of 80.12 feet;
Thence, North 84° 58' 00" West, with said south boundary line of Lot 1, a distance of 15.04 feet to a
point for the southwest corner of this tract;
Thence, North 09° 17' 32" East, a distance of 866.34 feet, to the Point of Beginning and cornaining
12,994.00 square feet (0.298 acres) of land.
