Utility Easement
THE STATE OF TEXAS
KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES
THAT the Asbury United Methodist Church, Inc. ("Grantor"), of 7501 South Staples, Corpus
Christi, Nueces County, Texas 78413, in consideration of TEN DOLLARS ($10.00), and other
good and valuable consideration, paid by the City of Corpus Christi, ("Grantee") of 1201 Leopard
Street, Corpus Christi, Nueces County, Texas 78401, the receipt ofwhich is herebyacknowledged,
has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal
corporation, its successors and legal representatives, the free and uninterrupted use, liberty,
privilege, and easement of going in, on, over, under and along a certain tract of land situated in
Nueces County, Texas and being described as follows:
See the metes and bounds property description for the Utility Easement and
Temporary Construction Easement attached and incorporated as "Exhibit A".
(Premises)
Map showing the location of the Utility Easement TOGETHER WITH A
TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as
"Exhibit B".
The Temporary Construction Easement is further described as a 10-foot wide
construction easement, west of, south of, and adjacent to the 10' wide remainder of
a 20' wide Temporary Construction Easement (Doc#2008020303). Said temporary
construction easement is to be used for working room and storage of materials and
machinery during the construction phase. This Temporary Construction Easement
automatically terminates upon the first of the following: a) Completion and
acceptance of the improvements of the Buckingham Lift Station project by the City
Manager of the City of Corpus Christi, Texas, or b) One year from the date of
recording.
SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land
within the easement area to the same or better condition as existed prior to
construction of the water line. All construction is to be done in a prudent and
workmanlike manner.
Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and
its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility
lines under, on and along said Premises.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a

2008-481 is ever abandoned, then the aforesaid rights and privileges cease.

10' UTILITY EASEMENT

FIELD NOTES to describe the boundary of a 10' wide utility easement across Lot 1, Block 1, Asbury
Addition as recorded in Volume 56, Page 118, Map Records, Nueces County, Texas, said 10' wide
easement being more particulazly described by metes and bounds as follows;
BEGINNING at a 5/8" steel rod set in the southwest boundary of an existing 10' utility easement as
shown on the plat of said Asbury Park and the northwest boundary of an existing variable width utility
easement as recorded in Document #2008020302, Official Records, Nueces County, Texas for the
most northerly east corner of this easement from which a 5/8" steel rod found in the southwest right-
of-way of Yorktown Boulevazd (120' r.o.w.) for the north corner of said existing variable width
easement beazs N-28°-40'-42"-E, 10.00';
THENCE, 5-28°-40'-42"-W, a distance of 70.00' to a 5/8" steel rod found for the west corner of said
existing variable width utility easement and for an interior corner of this easement;
THENCE, S-61°-16'-28"-E, along the southwest line of said Variable width easement, a distance of
62.00' to a 5/S" steel rod set in the northwest line of an existing 25' utility easement as shown on the
plat of said Asbury Addition for the most southerly east corner of the easement from which a 5/8" steel
rod found in the northwest right-of--way of South Staples Street (100' r.o.w.) for the south corner of
said existing vaziable width utility easement bears 5-61°-16'-28"-E, 25.00';
THENCE, 5-28°-40'-42"-W, along said 25' easement line, a distance of 10.00' to a 5/8" steel rod set
for the south corner of this easement;
THENCE, N-61°-16'-28"-W, a distance of 72.00' to a 5/8" steel rod set for the west corner of this
easement;
THENCE, N-28°-40'-42"-E, a distance of 80.00' to a 5/8" steel rod set in said 10' utility easement
line for the north corner of this easement;

FIELD NOTES to describe the boundary of a 10' wide temporary construction easement across Lot 1,
Block 1, Asbury Addition as recorded in Volume 56, Page 118, Map Records, Nueces County, Texas,
said 10' wide temporary easement being more particularly described by metes and bounds as follows;
BEGINNING at a 5/8" steel rod found for the most northerly east comer of this easement in the
southwest line of an existing 10' utility easement as shown of said plat of Asbury Park, the northwest
line of the 10' wide remaining portion of an original 20' wide temporary construction easement
described in Document #2008020303, Official Records, Nueces County, Texas from which a 5/8" steel
rod found in the southwest right-of--way of Yorktown Boulevard (120' r.o.w.) and the northeast line of
said Lot 1 for the north corner of an existing utility easement for lift station as recorded in Document
#2008020302, Official Records, Nueces County, Texas bears 5-61°-16'-28"-E, 20.00' and N-28°-40'-
42"-E, 10.00';
THENCE, 5-28°-40'-42"-W, a distance of 90.00' to a 5/8" steel rod found for the west corner of said
existing temporary construction easement and for an interior corner of this easement;
THENCE, 5-61°-16'-28"-E, a distance of 82.00' to a 5/8" steel rod set for the most southerly east
corner of this easement from which the south comer of said existing temporary construction easement
in the northwest right-of--way of South Staples Street (100' r.o.w.) bears 5-61°-16'-28"-E, 25.00';
THENCE, S-28°-40'-42"-W, along an existing 25' utility easement as shown on said plat of Asbury
Park, a distance of 10.00' to a 5/8" steel rod set for the south comer of this easement;
THENCE, N-61°-16'-28"-W, a distance of 92.00' to a 5/8" steel rod set for the west corner of this
easement;
THENCE, N-28°-40'-42"-E, a distance of 100.00' to a 5/8" steel rod set in existing 10' utility
easement for the north corner of this easement;
THENCE, S-61°-16'-28"-E, a distance of 10.00' to the POINT OF BEGINNING and containing
1,820 square feet (0.0418 acres) of land, more or less.
