Drainage Easement THE STATE OF TEXAS COUNTY OF NUECES KNOW ALL BY THESE PRESENTS: THAT I, Martha Kitchen ("Grantor"), of 4634 Abner Drive, Corpus Christi, Nueces County, Texas 78411, in consideration of $10.00 (TEN DOLLARS), and other good and valuable consideration, paid by the City of Corpus Christi, ("Grantee") of 1201 Leopazd Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description for the DRAINAGE EASEMENT attached and incorporated as "Exhibit A". (Premises) Map showing the location of the DRAINAGE EASEMENT TOGETHER WITH TWO TEMPORARY CONSTRUCTION EASEMENTS is attached and incorporated as "Exhibit B". (Premises) The Temporary Construction Easements are further described as variable width construction easements, north and south of and adjacent to the permanent drainage easement. Said temporary construction easements are to be used for working room and storage of materials and machinery during the construction phase. The Temporary Construction Easements automatically terminates upon completion and acceptance of the improvements of the Till Creek Drainage Basin Improvement project by the City Manager of the City of Corpus Christi, Texas. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees, to construct, operate, repair and maintain drainage utilities and related appurtenances for the public use in, on, over, under and along said premises. 2009-081 02/09/09 Till Oeek Drainage Basin Imps\Parcel 2\DE.Kitchen.doc Kitchen, Martha TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, franchisees and the public, for the proper use as a drainage easement for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges shall cease.
