INC. hereinafter called "Engineer", agree to the following amendments to the Contract for Engineering Services for McBride Lift Station and Force Main (Project No. 7287), as authorized and administratively amended by: Ori final Contract November 11, 2003 Motion No. M2003-400 $308,620.00 Amendment No. 1 Jul 9, 2004 Administrative A royal $0.00 EXHIBIT "A" OF THE ORIGINAL CONTRACT, SECTION 1. SCOPE OF SERVICES, PART A. BASIC SERVICES, shall be modified as follows: 1. PRELIMINARY PHASE: Not Applicable (100% complete) 2. DESIGN PHASE (REMAINING TASKS TO BE PERFORMED) Prepare the 100% submittal of Plans, Specifications and Estimate package. Additional force main and sanitary sewer drawings will not be created and the 60% plan and profile sheets will be utilized to produce the 100% submittal. The City has accepted the 60% analyses and design (i.e. horizontal and vertical alignments, structural details, etc.) and changes to design of the system is not included in this Scope of Work. Non-significant changes to address the 60% review comments will be addressed and are included in this Scope of Work. The following sheets/tasks will be created to produce the 100% submittal: • Address the 60% design comments (refer to Attachment No. 1) • SW3P Summary Sheet • Traffic Control Plan consisting of a Construction Sequence Summary (one sheet) and TXDOT Standards • Electrical and Controls sheets for proposed lift station • Reprint 60% sheets with new dates • Provide miscellaneous CADD annotation updates to 60% sheets • Mail plans to utility owners to obtain input from the utility owners • Develop Specifications and update construction estimate A prefinal set of plans will be submitted to the City before final signed and sealed drawings are submitted. 3. BID PHASE a. participate in the pre-bid conference. b. assist the City in solicitation of bids by identification of prospective bidders, and review of bids by solicited interests. c. review all pre-bid questions and submissions concerning the bid documents and prepare, in the City's format, for the Engineering Services' approval, any addenda or other revisions necessary to inform contractors of approved changes prior to bidding. 2009-108 AMEND. NO. 2 03/04/09 Pa e 1 of 4 RV287W MENOMENT NO. 2WMENDMENT NO. 2 Arcadis U.S. d. attend bid opening, analyze bids, evaluate, prepare bid tabulation, and make recommendation concerning award of the contract. e. in the event the lowest responsible bidder's bid exceeds the project budget as revised by the Engineering Services in accordance with the A/E's design phase estimate required above, the Engineer will, at its expense, confer with City staff and make such revisions to the bid documents as the City staff deems necessary to re-advertise that particular portion of the Project for bids. CONSTRUCTION PHASE a. participate in pre-construction meeting. b. review for conformance to contract documents, shop and working drawings, materials and other submittals. c. review field and laboratory tests. d. provide interpretations and clarifications of the contract documents for the contractor and authorize minor changes, which do not affect the contractor's price and are not contrary to the general interest of the City under the contract. e. make regular visits to the site of the Project to confer with the City project inspector and contractor to observe the general progress and quality of work, and to determine, in general, if the work is being done in accordance with the contract documents. This will not be confused with the project representative observation or continuous monitoring of the progress of construction. f. prepare change orders (coordinate with the City's construction division); provide interpretations and clarifications of the plans and specifications for the contractor and authorize minor changes which do not affect the contractor's price and are not contrary to the general interest of the City under the contract. g. make final inspection with City staff and provide the City with a Certificate of Completion for the project. h. as applicable, review and assure compliance with plans and specifications, the preparation of operating and maintenance manuals (by the Contractor) for all equipment installed on this Project. These manuals will be in a "multimedia format" suitable for viewing with Microsoft's Internet Explorer, version 3.0. As a minimum the Introduction, Table of Contents, and Index will be in HTML (HyperText Markup Language) format, with HyperText links to the other parts of the manual. The remainder of the manual can be scanned images or a mixture of scanned images and text. use the common formats for scanned images - GIF, TIFF, JPEG, etc.. Confirm before delivery of the manuals that all scanned image formats are compatible with the image-viewing software available on the City's computer - Imaging for Win95 (Wang) and Microsoft Imaging Composer. Deliver the manuals on a CD-ROM, not on floppy disks. i. review construction "red-line" drawings, prepare record drawings of the Project as constructed (from the "red-line' drawings, inspection, and the contractor provided plans) and deliver to the Engineering Services a reproducible set and electronic file (AutoCAD r.14 or later) of the record drawings. All drawings will be CADD drawn using dwg format in AutoCAD, and graphics data will be in dxf format with each layer being provided in a separate file. Attribute data will be provided in ASCII format in tabular form. All electronic data will be compatible with the City GIS system. AMEND. ADDITIONAL SERVICES, shall be modified as follows: Permitting. Furnish the City all engineering data and documentation necessary for all required permits. The A/E will prepare this documentation for all required signatures. The A/E will prepare and submit all permits as applicable to the appropriate local, state, and federal authorities, including, but not limited to: a. Prepare TXDOT Permits/Amendments. b. Perform two utility coordination meetings. ARCADIS may request from utility owners to perform potholes. If additional utility coordination meetings are needed to resolve utility conflicts, additional compensation will be requested from the City. 2. Right-of-Way (ROW) Acouisition Survev. This item is deleted from the Contract entirely. 3. Topographic Survev. Not applicable. 4. Environmental Assessments. Prepare an environmental site assessment. An allowance of $18,000.00 has been budgeted for this task. Depending on the City and project requirements, the fee may be higher or lower. A Scope of Work and fee will be prepared in the future and submitted to the City for review and approval consideration. 5. Geotech Report. Not applicable. 6. Construction Observation Services. This item is deleted from the Contract entirely. Start Up Services. Provide on-site services and verification for all start-up procedures during actual start up of major Project components, systems, and related appurtenances if needed and required. 8. Warranty Phase. Provide a maintenance guaranty inspection toward the end of the one- year period after acceptance of the Project. Note defects requiring contractor action to maintain, repair, fix, restore, patch, or replace improvement under the maintenance guaranty terms of the contract. Document the condition and prepare a report for the City staff of the locations and conditions requiring action, with its recommendation for the method or action to best correct defective conditions and submit to City Staff. Complete the inspection and prepare the report no later than sixty (60) days prior to the end of the maintenance guaranty period. 9. Provide SCADA Documentation. Provide standardized SCADA documentation, which will include PFDs, P&IDs, loop sheets, logics, SCADA architecture, DCS I/O lists, instrument lists, tie-in lists, piping lists, equipment lists, and instrumentation specification sheets. 10. Feasibility/Route Studies or Engineering Reports. Not applicable. AMEND. "A" OF THE ORIGINAL CONTRACT, SECTION 3. FEES, PART C. SUMMARY OF FEES, shall be modified as specified in EXHIBIT "A" SUMMARY OF FEES. All other terms and conditions of the November 11, 2003 contract between the City and Engineer, and of any amendments to that contract, which are not specifically addressed herein shall remain in full force and effect. The City reviewed and provided comments that ARCADIS will address. The purpose of this Amendment No. 2 is to provide a Scope of Work and tasks that ARCADIS will perform to complete the 100% Plans, Specification and Estimate package and other additional services tasks as summarized on the following page. Scope of Work and tasks: Consultant will perform the following BASIC SERVICES tasks. A. PRELIMINARY PHASE: NOT APPLICABLE, 100% COMPLETED. B. DESIGN PHASE (REMAINING TASKS TO BE PERFORMED) 1.
