GARWOOD WATER SUPPLY PIPELINE ROUTING PLAN
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, a Texas home rule municipal corporation, P.O. Box 9277, Corpus Christi,
Nueces County, Texas 78469-9277 (City) acting through its duly authorized City Manager or Designee
(Director of Engineering Services) and Freese and Nichols, Inc., a Texas corporation, 4055
International Drive, Suite 200, Fort Worth Texas 76109-4895, (Consultant Engineer), hereby agree to
the amendment of the contract approved October 28, 2003 (M2003-394), and amended October 29,
2004 (M2004-387) as follows:
Section 2. Scope of Services is amended by the addition of a paragraph to read:
The Consultant Engineer hereby agrees, at its own expense, to perform services necessary to
complete the Scope of Services set forth to complete a Garwood Right of Way Alignment as set fort by
Exhibit A-3. Task 2A-0005 Task 5 -Permitting and Agency Coordination and Task 2A-0008 Task 8 -
Phase 2A Report are deleted in their entirety. The Consultant Engineer will provide monthly status
updates (project progress or delays, Gantt charts presented with monthly invoices) and provide contract
administration services, as described in Exhibit A-3, to complete the Project.
Section 5. FEE is amended by the revision of Fees to read:
1. FEE
The City will pay the Consultant Engineer a fee, as described in Exhibit A-3, for providing services
authorized.
All other terms and conditions of the October 28, 2003 contract, as amended, between the City and
Consultant will remain in full force and effect.

B. Fee: The authorized fee remains unchanged. The table Summary of Fees set forth
on the following page will be used by the Consultant Engineer to determine the
amount to be invoiced for each task. The fee shown for each task is inclusive of all
expenses as set forth by the original contract.

TASK 1: Field Studies
Purpose: The purpose of this task is to conduct field studies and gather background
information related to easement, permitting, and regulatory requirements
associated with the proposed water rights amendment.
A.Ownership Mapping: Develop maps and spreadsheet of land ownership along
West Mustang Creek from (a) the point of diversion to the Ganado USGS
gauging station at Hwy 59 and (b) at proposed location of upstream flow
monitoring device. This task will also include ownership mapping of the relevant
Garwood Irrigation Company (GIC) canals. The maps developed in this task will
be used to assist in determining potential permitting, easement acquisition,
rights-of-entry, and mitigation requirements. It is assumed that rights-of-entry to
support field studies will be obtained by others. If acquisition of rights-of-entry
are required, scope and fee associated with this task will be authorized under a
separate amendment.
B.Risk Analysis: Develop risk analysis spreadsheet for opening of the water right
and associated permit processes. Conduct a workshop in Corpus Christi with
City staff to review risk analysis.

C.Field Survey of West Mustang Creek: Conduct field study and survey
measurements of width of West Mustang Creek upstream from the mouth of the
creek. The field survey information will be used in conjunction with the land
ownership maps to determine public/private ownership of the bed and banks
and to provide data for hydrologic modeling, if hydrologic evaluations are
required for permit applications. It is assumed that survey data will be collected
at no more than seven sub-reaches of the creek.
D.West Mustang Creek Habitat Assessment: Conduct a habitat assessment of
West Mustang Creek between the proposed point of diversion from the GIC
canal to the mouth of Mustang Creek. The purpose of this task is to identify
potential creek habitat impacts, investigate endangered species, and delineate
flow regimes. As provided for in Task 4, meetings will be held with Texas Parks
and Wildlife Department (TPWD), Texas Commission on Environmental Quality
(TCEQ), U.S. Army Corps of Engineers (USAGE), and the Texas General Land.
Office (TGLO) to determine requirements and needs for West Mustang Creek
habitat impact assessments. For the purposes of establishing a budget, it is
assumed that the assessment of potential habitat impacts will be based on
representative field data collected at up to four sub-reaches of the study area. It
is also assumed that the level of effort of characterizations of the physical
habitat and biological community, if required, will be similar to that required for a
TCEQ Receiving Water Assessment.
E.Coordinate Re-Calibration of Ganado Gauging Station: Coordinate re-calibration
of the Ganado Gauging Station with LNRA and the United States Geologic
Survey (USGS).
F.Task 1 Summary Findings: Prepare summary of Task 1 results for incorporation
into final report. Conduct a workshop with City staff in Corpus Christi to review
summary findings and receive comments.
TASK 2: Agreement with Lower Colorado River Authority (LCRA) for use of
Garwood Irrigation Company Facilities
Puraose: The purpose of this task is to develop an agreement between the City of
Corpus Christi (City) and LCRA for upgrades, operation, and maintenance of the
Garwood Irrigation Company Facilities including the proposed West Mustang Creek
Diversion.
A.Agreement Framework: Develop framework of agreement for use of GIC facilities.
The agreement will include the scope of maintenance upgrades for the existing
Garwood Pump Station and Town Canal, design of the diversion structure at
West Mustang Creek, and operations and maintenance plan. The operations
and maintenance plan will consider coordination of river and irrigation diversions,
in-stream flow needs for the Colorado Basin, diversion schedules, metering and
gauging requirements, coordination with Lake Texana operations, flow regimes
(erosion, flooding) in the canal and West Mustang Creek, and scheduled
maintenance of the GIC facilities and proposed West Mustang Creek Diversion.
B.Framework Meeting: Meet with LCRA to present framework and develop a
detailed outline of the draft agreement. Discuss inclusion of Garwood Water
Diversion in LCRA Water Management Plan. This task assumes one meeting in
the Garwood area.

C.Prepare Draft LCRA Agreement: Based on results of the meeting with LCRA,
develop the draft agreement. Provide draft agreement to City and LCRA prior to
scheduling the Draft LCRA Agreement Workshop.
D.Draft LCRA Agreement Workshop: Meet with LCRA and City to review and edit
draft agreement for use of GIC facilities. This task assumes one meeting in the
Garwood area.
E.Prepare Final Agreement: Finalize agreement based on input and comments from
LCRA and Corpus Christi.
F.Execute Agreement: Meet with the City and LCRA and obtain each entity's
written approval of the Final Agreement. The executed agreement will be
included as part of the Texas Commission on Environmental Quality (TCEQ)
water right amendment application. This task assumes two (2) meetings, one in
the Austin area (LCRA Board meeting), and one in Corpus Christi (City Council
meeting).
G.Task 2 Summary: Prepare a summary of Task 2 for incorporation in final report.
TASK 3: Agreement with Lavaca-Navidad River Authority (LNRA) for conveyance
through Lake Texana.
Pur ose: The purpose of this task is to develop an agreement between the City
and LNRA for upgrades, operation, and maintenance of LNRA facilities associated
with the proposed Garwood Diversion.
A.Aareement Framework: Develop framework of agreement for use of Lake Texana
and other LNRA facilities. The agreement will include arrangements for capital
improvements to LNRA facilities (as needed), and operations and maintenance
arrangements. A Water Accounting Plan will be developed as part of the
operations and maintenance portion of the agreement. The Water Accounting
Plan will include withdrawal schedule for Colorado River diversions, content and
availability estimates for Lake Texana, loss estimates in West Mustang Creek,
flooding impacts and operational responses, spills from Lake Texana, meter and
gauging requirements, bay and estuary releases, instream flow needs for the
Lavaca/Navidad Basins, irrigation diversions, and system accounting and
reporting for flows through Lake Texana.
B.Framework Meeting: Meet with LNRA and City to present draft framework and
prepare a detailed outline of the draft agreement. This task assumes one (1)
meeting in the Edna area.
C.Prepare Draft Agreement: Based on the results of the Framework Meeting,
prepare a draft agreement. Provide draft agreement to City and LNRA prior to
scheduling the Draft LNRA Agreement Review Workshop.
D.Draft LNRA Agreement Review Workshop: Meet with LNRA to review and edit
draft LNRA Agreement. This task assumes one (1) meeting in the Edna area.
E.Regulatorv Coordination: Meet with TCEQ and TPWD to obtain their concurrence
on the provisions of the LNRA agreement. This task assumes two (2) meetings
in the Austin area.
F.Prepare Final LNRA Agreement: Finalize agreement based on input and
comments from LNRA, TCEQ, TPWD, and City.
G.Execute Agreement: Meet with the City and LNRA and obtain each entity's
written approval of the Final Agreement. The executed agreement will be
included as part of the TCEQ water right amendment application This task

assumes two (2) meetings, one in the Edna area (LNRA Board meeting), and

H.Task 3 Summary: Prepare summary of Task 3 results for incorporation in final
report.
TASK 4: Regulatory Agency Coordination
Puraose: The purpose of this task is to coordinate with regulatory agencies and
regional water planning groups regarding regulatory agency concerns, required
permits, and consistency with current State of Texas water resources planning
requirements.
A.Coordinate with TPWD regardinq Gravel Sand and Marl (GSM) Permit: Meet
and coordinate with TPWD regarding the need for a GSM Permit. This task
assumes up to two (2) meetings with TPWD in Austin, Texas.
B.Coordinate with TPWD regardinq LNRA Lake Texana Inflow and Release
Agreement: Meet and coordinate with TPWD .the possible amendment of the
existing agreement governing releases from Lake Texana between LNRA and
TPWD. This task assumes up to three (3) meetings with TPWD in Austin.
C.Coordinate with TCEQ regardinq Bed and Banks Authorization: Meet and
coordinate with .TCEQ regarding the need for a Bed and Banks authorization.
This task assumes up to three (3) meetings with TCEQ in Austin, Texas.
D.Coordinate with TGLO regardinq Bed and BanksAuthorization: Meet and
coordinate with TGLO regarding the need for a Bed and Banks authorization.
This task assumes up to three (3) meetings with TGLO in Austin, Texas.
E.Coordination with TCEQ and TWDB for Regional Water Planning: Meet with
TCEQ and Texas Water Development Board (TWDB) to determine the status of
diversion of the City's Garwood Right as a "consistent" strategy for Region N.
This task assumes one (1) meeting each with TCEQ and TWDB in the Austin,
Texas area.
F.Regional Water Planning Groug Coordination: Meet with Region N and Region K
representatives to determine the status of status of diversion of the City's
Garwood Right as a "consistent" strategy for Region N. This task assumes one
(1) meeting each with Region N and Region K planning groups, in the Corpus
Christi and Austin areas, respectively.
G.Monitor LCRA/SAWS Proiect: Continue discussions with LCRA and SAWS, as
appropriate, to monitor status of the LCRA/SAWS Project and explore
opportunities for the cooperative development of delivery options in conjunction
with the LCRA-SAWS Water Supply Project. This task assumes up to two (2)
meetings with LCRA in the Garwood, Texas area.
H.U S Army Corps of Engineers (USAGE) Coordination: Meet with USAGE to begin
coordination process for 404 permitting of the following facilities:
.Proposed improvements to GIC canal
.Proposed West Mustang Creek Diversion
.Proposed gauging stations.
This task will seek to identify the appropriate approach to permitting the facilities
through the 404 system, and identify specific concerns of the USAGE and other
participating regulatory agencies prior to preliminary design of each facility. This
task assumes one (1) meeting with USAGE in the Galveston District Office.

I.TPDES Coordination: Maintain dialogue with TCEQ on potential need for a
TPDES permit. This task assumes no meetings with TCEQ will be required.
J.Landowner Issues and Communications: Assist LCRA in communicating with
potentially affected landowners as requested by the City. This task assumes up
to three (3) meetings in the Edna, Texas area.
K.Meet with Environmental Grouas: Plan, schedule and attend up to three meetings
with selected environmental groups that have interest in the proposed diversion.
This task will include planning and scheduling of these meetings, and
development of background information and exhibits. This task assumes up to
three (3) meetings, including two (2) in the Austin area and one (1) in the Edna
area.
L.Task 4 Summary: Prepare summary of Task 4 results for incorporation in final
report.
TASK 5: Permitting Activities
Purpose: The purpose of this task is to prepare and submit permit applications and
other materials required for the delivery of Garwood Water to Corpus Christi.
A.Bed and Banks Authorization: Prepare and process appropriate materials to
support the request for a Bed and Banks authorization to transfer Garwood
water via West Mustang Creek, where required.
B.Prepare Amendment to TPWD/LNRA Inflow and Release Agreement: Purpose of
this task is to amend the existing agreement governing Lake Texana
environmental flow releases between TPWD and LNRA to accommodate City's
diversion of the Garwood Right through Lake Texana. This task will include:
1.Development of amendment framework. The amendment framework will be a
list of items, topics, and issues that must be addressed by the amendment.
2.Meet with LNRA and TPWD to present amendment framework and develop a
detailed outline of the draft amendment. This task assumes one (1) meeting
in the Edna area.
3.Based on the detailed outline, develop draft amendment. Provide draft
amendment to LNRA and TPWD for review prior to scheduling Draft
Amendment Workshop.
4.Meet with LNRA and TPWD to review and edit the draft amendment. This task
assumes one (1) meeting in the Edna area.
5.Prepare final amendment based on input and comments from LNRA and
TPWD.
6.Meet with LNRA and TPWD and obtain each entity's written approval of the
Final Amendment. The final amendment will be included, as appropriate, as
part of the TCEQ water right amendment application. This task assumes
attendance at one (1) governing board meeting each with TPWD and LNRA
in Austin and Edna, respectively.
C.Water Rioht Amendment Application: Prepare application to TCEQ to amend the
City's Garwood Water Right. The application is required to amend the current

closed conduit conveyance recommendation to provide for use the Garwood
Irrigation Company canals, West Mustang Creek, and Lake Texana for
conveyance of Colorado River water to Corpus Christi. As part of the water right
amendment application, it will be requested that the diversion eligibility of
Segment C be preserved to allow for future downstream diversion options.
D.Monitor Permit Applications Status: Submit and monitor processing of permit
applications. Additional studies and information requests beyond Texas Water
Code requirements for administratively complete permit applications are not
included in this scope and will be covered as necessary under future
amendments.
E.Regulatory Agency Coordination during Permit Application Processing:
Coordinate with TCEO, TPWD, LCRA, LNRA, COE, South Texas Nuclear
Project (STNP), and GLO and respond to comments related to work performed
in preparing the permit applications.
F.Develop Supporting Information for Amendment of Region N Regional Water
Plan: Develop supporting information of use by the Region N regional water
planning group in amending the Coastal Bend Regional Water Plan to select
Garwood diversion as a water management strategy to meet municipal and
industrial needs.
G.Coordinate Amendment of Reoion N Regional Water Plan: Meet with and
coordinate approval of amendment to Region N Regional Water Plan. This task
assumes up to two (2) meetings with the Regional Water Planning Group in the
Corpus Christi area.
H.Amend Water Conservation and Drought Management Plan: Amend existing
Corpus Christi Water Conservation and Drought Management Plan to include
specific quantitative goals to comply with Chapter 288 of the Texas
Administrative Code and a provision that each wholesale water customer
develop a water conservation plan. Conduct a workshop with City staff to review
goals and objectives of the Water Conservation and Drought Management Plan.
Prepare draft Amendment, then provide draft amendment to City for review.
Conduct a workshop with City staff concurrent with delivery of the draft
amendment. Incorporate City comments and prepare a final amendment for City
approval.
(.Easement Acouisitions: Acquisition of easements required for proposed diversions
and facilities are not included in this scope. If easement acquisitions are
required, scope and fee associated with this task will be authorized under a
separate amendment.
J.Gravel, Sand, and Marl Permit Application: Preparation of the GSM permit
application is not included in this scope. If a GSM permit is needed, the scope
and fee for preparation of this permit will be authorized under a separate
amendment.
K.Section 404 Permits: Preparation and processing of pre-construction notification
for a Section 404 Nationwide Permit 7 for the construction of the ouffall structure.
If additional 404 permit(s) are required, the scope and fee for preparation of
these permits will be authorized under a separate amendment.

L.TPDES Permit Application: Preparation of a TPDES permit for the Garwood
Diversion is not included in this scope. If a TPDES permit is required, the scope
and fee for preparation of the TPDES permit will be authorized under a separate
amendment.
M.TCEQ Public Hearings: Participation and assistance with TCEO Public Hearings
is not included in this scope. If Public Hearings are required, the scope and fee
for participation and assistance with the public hearing will be authorized under a
separate amendment.
N.In-Stream Flow Analyses: In-stream flow analyses in support of habitat evaluation
of West Mustang Creek are not included in this scope. If in-stream flow
analyses are required, the scope and fee for these analyses will be authorized
under a separate amendment.
O.Task 5 Summary: Prepare summary of Task 5 results for incorporation in final
report.
TASK 6: Conceptual Facilities Design
Purpose: The purpose of this task is to develop conceptual diversion facilities
designs to assist with development of agreements with LCRA and LNRA, and to
assist in permit identification and coordination with regulatory agencies.
A.GIC Facility Reauirements Workshop: Conduct workshop with LCRA to determine
facility requirements for Garwood diversion, including Garwood Irrigation
Company (GIC) Canal System improvements and West Mustang Creek
diversion structure configuration. The workshop will be focused on identifying the
facility requirements necessary to comply with the final agreements between the
City and LCRA and LNRA. This task assumes one (1) workshop in the Garwood
area.
B.Conceptual Design of GIC Canal System Improvements:' Develop conceptual
designs for improvements to GIC Canal System improvements based on input
obtained during the GIC Facility Requirements Workshop.
C.Conceptual Desion of West Mustano Creek Diversion Structure: Develop
conceptual design of West Mustang Creek Diversion structure based on input
obtained during the GIC Facility Requirements Workshop.
D.GIC Facilities Conceptual Desion Review Workshop: Meet with LCRA and City to
review conceptual designs for GIC Canal System Improvements and West
Mustang Creek Diversion Structure. This task assumes one (1) workshop in the
Garwood area.
E.West Mustang Creek Gauging Stations Facilities Requirements Workshop:
Conduct a workshop with City, LNRA, and USGS to identify specific
requirements for proposed West Mustang Creek gauging stations. The
workshop will be focused on identifying the facility requirements necessary to
comply with the final agreements between the City and LCRA and LNRA. This
task assumes one (1) workshop in the Edna area.
F.Conceptual Design of West Mustang Creek Gauging Stations: Develop
conceptual designs of gauging stations necessary to implement the final
agreements with LCRA and LNRA. Meet with LCRA, LNRA, and the City to
review conceptual design. Upon approval of conceptual design, proceed with

preliminary design of gauging stations needed to provide accounting,
management, and communication system for diversion. This task includes
conceptual designs for up to three (3) stations.
G.West Mustang Creek Gauging Stations Conceptual Design Workshop: Meet with
LNRA and City to review conceptual designs for West Mustang Creek Gauging
Stations. This task assumes one (1) workshop in the Edna area.
H.Task 6 Summary: Prepare summary of Task 6 results for incorporation in final
report.
TASK 7: Mary Rhodes Pipeline Facilities Assessment
Purpose: Diversion of the Garwood water will increase the City's reliance on the
Mary Rhodes Pipeline (MRP). There is a need to identify alternatives for increasing
the MRP's operational flexibility and reliability in order to best integrate the
Garwood water into the City's existing treatment and distribution system operations.
The purpose of this task is to evaluate the existing MRP system, identify and
evaluate alternatives to enhance the MRP system's operational flexibility and
reliability, and to develop a prioritized list of improvements to the MRP to enhance
its operational flexibility and reliability.
A.Data Collection and Review: Gather and review previous studies, construction
plans, and operations and maintenance manuals (O&M's) for the MRP provided
by Corpus Christi and Lavaca-Navidad River Authority (LNRA).
B.Facilities Site Visit: Make site visits to each pump station, and other components
of the MRP as required. Review existing equipment complements (pumps,
piping, etc.) and SCADA. Meet with operations personnel and LNRA
representatives to gather field information and identify potential alternatives.
C.Task Kickoff Workshop: Conduct a Task Kickoff Workshop to provide an overview
of the Task Scope to City personnel, discuss overall MRP overall flexibility and
reliability objectives, and identify potential alternatives for evaluation, including
project facilities, SCADA systems, and operations protocols. This task assumes
attendance at one (1) workshop in Corpus Christi.
D.Pump Station Assessment: Review plans, specifications, operating manuals, and
the Lake Texana, Bloomington, and Woodsboro Pump Stations. Identify
limitations of the existing pump stations considering the proposed Garwood
Diversion and the City's overall MRP overall flexibility and reliability objectives.
E.SCADA System Assessment: Review plans, specifications, and other information
related to the MRP's SCADA system. Identify limitations of the MRP's SCADA
system considering the proposed Garwood Diversion and the City's overall MRP
overall flexibility and reliability objectives. Make recommendations for improved
reliability, operations and maintenance, and including the need for additional
backup and redundant systems to enhance the existing SCADA system.

G.Alternatives Identification and Screening: Review the MRP System and identify
alternatives to improve operational flexibility and reliability Consider
modifications to the project facilities, local control systems and instrumentation,
storage, ways to maintain consistent water quality to aid in water treatment,
better surge control, improved methods for start-up, shut-down, power failure
recovery, and pump changes. Develop up to 10 alternatives, including
conceptual capital cost estimates for each alternative.
H.Alternative Control Strategies: For each alternative developed, identify the
preferred control strategy and prepare schematic process and instrumentation
diagrams for each alternative. Consider and include appropriate reliability and
redundancy features consistent with the City's overall goals for the MRP.
Prepare conceptual capital cost estimates for each control system and include in
the overall alternative cost estimates.
(.Recommended MRP Improvements: Screen the MRP alternatives and identify a
recommended alternative. Develop an implementation plan for executing the
recommended alternative. The implementation plan is expected to take the form
of a prioritized list of improvements.
J.Task 7 Summary: Prepare summary of Task 7 results for incorporation into final
report. Conduct a workshop with City staff in Corpus Christi to review summary
findings and receive comments.
TASK 8: Phase 2A Report
Purpose: The purpose of this task is to consolidate the Task Summaries into a final
report.
A.Prepare Draft Report: Prepare Develop Draft Report based on the previously
prepared task summaries. Submit 10 hard copies and one electronic copy to the
City for review and comment.
B.Prepare Presentation summarizing Draft Report: Prepare a PowerPoint
presentation summarizing the draft report and give the presentation at the Draft
Report Workshop. Give the presentation at two additional meetings of the City's
choice.
C.Draft Report Workshop: Meet with City and review the findings of the Draft Report.
D.Draft Report Comments Meeting: Meet with City and receive City's comments on
Draft Report.
E.Prepare Final Report: Incorporate comments into Draft Report. Submit 20 hard
copies and one electronic copy to City.
F.Final Report Presentation: Prepare a Power Point Presentation of the final report
findings. Present findings to City Council and others as requested by the City (up
to 3 presentations).
Task 9: Project Management
Purpose: The purpose of this task is to coordinate Engineer's efforts, monitor schedule
and budget, and provide monthly status reports to City.
A.Proiect Schedule: Develop and maintain project schedule in CPM format for all
authorized project activities.
B.Progress Reports and Invoices: Prepare monthly progress reports and invoices
and submit to the City no later than the fifth day of the month.
