AMENDMENT N0.4
CONTRACT FOR PROFESSIONAL SERVICES
This City of Corpus Christi, Texas hereinafter called "CITY", and RVE. INC., hereinafter called "CONSULTANT",
agree to the following amendment to the Contract for Professional Services for Laguna Shores Road -Graham
Road to Hustlin' Homet (Bond 2004) (Project No. 6278) as authorized and administratively amended by:

EXHIBIT A, SECTION 1. SCOPE OF SERVICES, PART A. BASIC SERVICES shall be modified by the additional
paragraph shown below.
Modify existing construction plans for roadway extensions on Hustlin' Hornet Road, Graham Road and
Lola Johnson Road to achieve a minimum roadway elevation of 5.0 Ft.
EXHIBITA, SECTION 1. SCOPE OF SERVICES, PART B. ADDITIONAL SERVICES shall be modified as shown
below.
1. Permitting. Add: "Perform additional environmental surveys and modify USACE permit application for
roadway extensions."
3. Topographic Survey. Add: "Perform additional topographic surveys needed for design of roadway
extensions."
6. Construction Observation Services. Replace "(Limited to 12 month construction duration)" with
"(Limited to 4 month construction duration)"
9. Prepare Mitigation Plan. Furnish the City documentation necessary for required mitigation plan at the
"Laguna Shores W W Treatment Plant" tract. Perform wetland delineation survey, endangered species
survey, archaeological survey, topographic survey, state land survey and GLO easement document.
Prepare and submit mitigation plan for the "Laguna Shores W W Treatment Plant" tract to the U.S. Army
Corps of Engineers (USACE) for review and comment. Fees are in addition to the fees already
authorized for Amendment No. 3.
10. Respond to Agencv Comments. Response to agency comments and revisions to the mitigation plan
submitted in Item 9. Fees are in addition to the fees already authorized for Amendment No. 3.
11. Initial Work on the Van Galen Ditch Site. Reimbursement forwork completed on the Van Galen Ditch
Site underAmendment No. 3.
12.100-Year Storm Analysis of Jennings Ditch. Computation of 100-year storm flows for the Jennings
Ditch based on the drainage area shown on the Draft Goldston Stormwater Master Plan.

EXHIBIT "A", SECTION 3. FEES, PART C. SUMMARY OF FEES shall be modified by the attached Summary of
Fees as shown in the attached Exhibit "A" for an additional fee not to exceed 28 957.50 (in figures) Twenty Eipht
Thousand Nine Hundred Fiftv Seven Dollars and Fiftv Cents (in words), for a total restated fee not to exceed
$521,087.50 (in figures) Five Hundred Twenty One Thousand Eighty Seven Dollars and Fiftv Cents (in words).
EXHIBIT A-1, Additional Services shall be modified as shown below.
6. CONSTRUCTION OBSERVATION SERVICES (12 Month Duration) Replace "(12 Month Duration)"
with "(4 Month Duration)".
All other terms and conditions of the May 31, 2005 contract between the City and Consultant, and of any
amendments to that contract which are not specifically address herein shall remain in full force and effect.

DEFINITIONS
a. Board Member. A member of any board, commission or committee appointed by the City Council of the City of
Corpus Christi, Texas.
b. Employee. Any person employed by the City of Corpus Christi, Texas, either on a full or part time basis, but not as
an independent contractor.
c. Firm. Any entity operated for economic gain, whether professional, industrial or commercial and whether
established to produce or deal with a product or service, including but not limited to, entities operated in the form
of sole proprietorship, as self-employed person, partnership corporation, joint stock company, joint venture,
receivership or trust and entities which, for purposes of taxation, are treated as non-profit organizations.
d. Official. The Mayor, members of the City Council, City Manager, Deputy City Manager, Assistant City Managers,
Department and Division Heads and Municipal Court Judges of the City of Corpus Christi, Texas.
e. Ownership Interest. Legal or equitable interest, whether actually or constructively held, in a firm, including when
