Purpose. To establish a Memorandum of Agreement (MOA) between CCPD and NASCC whereby NASCC is authorized to use specific emergency radio frequencies on the CCPD network during disasters and/or mutual aid events. The goal is to establish network communications between NASCC and CCPD and to define the working arrangements, relationships, and responsibilities of both parties. 2. Background a. References (a) through (c) prescribe policies for the Navy to develop agreements on actions of mutual interest. b. Reference (d) defines the requirement for agencies to\develop network relationships with communities and other users for Enterprise Land Mobile Radio (ELMR) Systems. 3. Scope. The provisions of this Frequency Use Authorization will apply to all operational personnel, equipment, and operations of the participating agencies, where such provisions do not conflict with statute, policy, standard operating procedures (SOP), or other written directives. The delineated frequencies shall be used for emergency events or preplanned events, as agreed upon by the participating agencies. 2009-371 08/20/09 ~N~~~ Wrp~p~ D~ MOA 09697-2008-00216-03-28 Subj: AUTHORIZATION TO UTILIZE EMERGENCY RADIO FREQUENCIES a. NASCC (1) Accept loan of/responsibility for operating the Enhanced Digital Access Communication System (EDACS) radios provided by CCPD. (2) Establish internal SOP to ensure compliance with network policies. (3) Provide equipment to ensure compatibility with 4-wire E&M connections for two external radios. (4) Provide two operational directional antennas with TNC connectors. Antennas are to be located onboard NASCC, on Building 7 ELMR Tower. Antennas are to be directed toward the CCPD Shoreline Plaza Radio Site. (5) Participate, to the greatest extent possible, in exercises sponsored by CCPD. b. CCPD (1) Grant NASCC the authority to use the designated radio frequencies for the purpose of interoperable communications. (2) Loan two EDACS radios and a 110-volt power supply for EDACS radios to NASCC. (3) Provide guidance and SOP on proper utilization of the designated frequencies. (4) Provide notice of pending exercises and request NASCC to participate, as appropriate and desired. 5. Duration. Duration of this MOA is not to exceed three (3) years from the effective date of approval (upon signature of all parties). 6. Financial Considerations. No cost items have been identified in this MOA. 7. Modification. This agreement can be modified by mutual agreement of all parties. Requests for modification must be in writing and sent to the other parties at least 120 days prior to the requested changes. 8. Review. This agreement will be reviewed annually to verify and determine continuing need. 9. Unresolved Disputes. In the event of an inability to resolve disputes to the mutual satisfaction of both parties, the matter will be forwarded to each party's respective chain of command for resolution or either party may terminate this MOA. 2 MOA 09697-2008-00216-03-28 Subj: AUTHORIZATION TO UTILIZE EMERGENCY RADIO FREQUENCIES 10. Confidentiality. To the extent consistent with applicable state and federal laws, the information below must be kept confidential by the Navy, NASCC, CCPD, and their employees, agents, and attorneys. This confidentiality shall survive the termination of this MOA for a period of two (2) years. a. The terms of this MOA. b. Any confidential information disclosed in connection with the MOA, whether before or after the effective date of this MOA, including during negotiations or mediation related to the MOA. c. Any proprietary, non-public information regarding frequencies, the Navy, NASCC, CCPD, or City of Corpus Christi business. 11. Termination. This MOA may be terminated by any party hereto with 60 days notice. Upon termination of this MOA, NASCC will return any and all equipment belonging to CCPD. 12. Points of Contact a. To accommodate the city, county, and Regional Transit Authority 800 MHz Trunked Radio (the City) system connection, the ELMR equipment will provide connections for two external radios. These connections will be 4-wire E&M connections. The City will provide two EDACS Enclosure (1) MOA 09697-2008-00216-03-28 radios set on separate talk groups, to allow two simultaneous emergency conversations. Each radio will be mounted on a 3.5" rack shelf with a 110-volt power supply; therefore, 7" of rack space will be required. The radios will require a TNC male antenna connection. The ELMR Project will include two Yagi Antennas directed at the City's Shoreline Plaza Radio Site (Downtown Corpus Christi). The frequencies involved can be found on FCC license KNNY532, Location 1. The talk groups for the links will be provided at the time of installation and will only be used for the links described herein. The City will be responsible for maintenance of the radios and power supplies provided for the links. 3. The CCPD's Metrocom Center will monitor two radio talk groups which will be assigned to NASCC for interoperability. These talk groups will be labeled "CCPD-NAS" (Police/Security) and "CCFD-NAS" (Fire). in the Metrocom Center consoles. These talk groups will be monitored at the Metrocom Fire Desk 24 hours a day, 7 days a week. The "Call Channel" for all NASCC communications will be the "CCFD-NAS" talk group. If a Police connection is needed, NASCC will call on the "CCFD-NAS" talk group and request communications on the "CCPD-NAS" talk group. The Metrocom Dispatcher will then connect the "CCPD-NAS" talk group to the appropriate Metrocom Dispatcher. NASCC will assign like named-ports to their console system to avoid confusion when using these .talk groups. To avoid confusion when talking between entities, 10-codes should be avoided and plain English should be used because of the differences between the military and civilian phonetic alphabets. 4. A monthly test of the system will be initiated from NASCC on the first of every month, between 0800/8:00 AM and 1200/12:00 PM. If the test is unsuccessful, NASCC should call the Metrocom Supervisor at (361) 886-2802.
