Home My WebLink AboutC2009-412 - 10/20/2009 - ApprovedAMENDMENT TO USE AGREEMENT WITH SOUTH TEXAS BOTANICAL GARDENS & NATURE CENTER H^ ~S~ mendment to the Use Agreement is made and entered into this ~~ ay of C~ , 2009, by the CITY OF CORPUS CHRISTI, a municipal corporation and political subdivision of the State of Texas, hereinafter referred to as "CITY," and South Texas Botanical Gardens & Nature Center (formerly Corpus Christi Botanical Society);." Whereas, the parties previously entered into Use Agreement approved by City Council on March 17, 1992 under Ordinance No. 021348 which authorized Use Agreement for use of 180.85 acres of park land adjacent to Oso Creek as a Botanical Garden, for sixty year term; NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1) Section II Premises of the Agreement is hereby amended to allow the use of additional surface estate of 1.41 Acres, 61,537.10 square foot portion of land, and as identified on the attached and incorporated Exhibit A. 2) Section II Premises of the Agreement is also hereby amended to allow the use of additional surface estate of 2.25 acres, 97,838 square feet identified as Lot One (1), Block Two (2), Botanical Gardens Park Unit 4, as .shown by the map or plat thereof, recorded in Volume 63, Pages 139 and 140, Map Records of Nueces County, Texas, and as identified on attached and incorporated Exhibit B. The City reserves an eighty (80) foot wide strip along the western boundary of this additional premise for future street construction. South Texas Botanical Gardens & Nature Society may not construct or allow any permanent structures to be located in this eighty foot wide reserved area. 3) South Texas Botanical Gardens & Nature Center shall pay all costs of newspaper publications regarding this amendment as required by the City Charter. 4) All other terms and conditions of the previously executed Agreement between the parties which are not inconsistent herewith shall continue in full force and effect.
