(Project No. 6490), as authorized and amended by: Ori final Contract Aril 21, 2009 Motion No. 2009-095 $1,414,850.00 EXHIBIT "A", PART 1. SCOPE OF SERVICES, SECTION B. ADDITIONAL SERVICES, shall be amended as follows: ITEM N0.3 TOPOGRAPHICAL SURVEY: Additional survey time will be required to assist the utility contractors for a total additional fee in the amount of $7,500 ($5,000 and Phase 1 and $2,500 for Phase 2). ITEM N0.4 UTILITY LOCATIONS AND WASTEWATER LINE INSPECTION: • The original contract allowance, $75,000, ($50,000 for Phase 1 and $25,000 for Phase 2) for Utility Locations and Wastewater Line Inspections was an estimated amount prior to knowing how much utility and wastewater line inspection work would be required. Additional engineering costs will be required for Utility Locations and Wastewater Line Inspections to complete this task for a total additional fee in the amount of $85,400 ($49,090 for Phase 1 and $36,310 for Phase 2). EXHIBIT "A" PART 3. FEES SECTION C. SUMMARY OF FEES shall be modified and is attached as Exhibit "A" Summary of Fees for a revised fee not to exceed $92,900.00 (Ninety Two Thousand Nine Hundred Dollars and Zero Cents), for a total restated fee not to exceed $1,507,750.00 (One Million Five Hundred Seven Thousand Seven Hundred Fifty Dollars and Zero Cents). All other terms and conditions of the April 21, 2009 contract between the City and Consultant will remain in full force and effect. (Project No. 6490) AMENDMENT NO.1 Dear Mr. Anaya: Please accept this letter as our proposal to amend our original contract to increase the allowance for Utility Locations & Waste Water Line Inspections and Topographic Survey (Contract Exhibit "A", Part C -Summary of Fees). The current contractual allowance amount for Utility Locations & Waste Water Line Inspections is $75,000 for both phases ($50,000 for Phase 1 and $25,000 for Phase 2). This amount was an estimated amount prior to knowing how much utility location and waste water line inspection work would be required. Based on the fee estimates prepared by the contractors hired to perform this work and additional engineering costs to coordinate the work, an additional $85,400 ($49,090 for Phase 1 and $36,310 for Phase 2) is required to complete this task. Additional survey time will be required to assist these contractors by having a survey crew on site during the excavations. The current contractual authorized amount for Topographic Survey is $180,000 for both phases ($120,000 for Phase 1 and $60,000 for Phase 2). An additional $7500 ($5000 for Phase 1 and $2500 for Phase 2) is required to assist the utility contractors. As directed by the City's project manager, we hired the utility contractors to perform this work so we could receive the information in a timely manner in order to accelerate the project schedule as requested by the City's project manager. NO. 1 EXHIBIT "A" Pa e4of7 KOSTORYZ ROAD -STREET & DRAINAGE IMPROVEMENTS PHASES 1 & 2 City Project No. 6489 & Project No. 6490 The following factors contributed to the actual costs for Utility Locations and Waste Water Line Inspections being higher than the allowance provided in the original contract. 1. Original contract anticipated that the City's gas department would locate their own utilities. However, they instead elected to have an outside contractor locate the gas lines. 2. The Wastewater Department elected to CCTV all of the wastewater lines on this project, including those lines that had previously been rehabilitated by CIPP in 1997. This was necessary to determine the condition of the liner and to verify line sizes where there were disagreements between data sources.
