FOSS, III AND WIFE, LINDA N. FOSS ("GRANTOR"), of P.O. Box 951, Ingleside, San Patricio County, Texas 78362, in consideration of TEN DOLLARS ($10.00), and other good and valuable consideration, paid by the CITY OF CORPUS CHRISTI, ("GRANTEE") of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description for the DRAINAGE EASEMENT attached and incorporated as "Exhibit A". (Premises) Map showing the location of the DRAINAGE EASEMENT is attached and incorporated as "Exhibit B". (Premises) Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees, to construct, operate, repair and maintain drainage utilities and related appurtenances for the public use in, on, over, under and along said premises. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, franchisees and the public, for the proper use as a drainage easement for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges shall cease. O. Simmons & Assoc., Inc. to Benjamin S. Foss III, dated 12/03/85 and recorded in Vol. 1992, Pg. 904 of the Deed Records of Nueces County, Texas, and being more fully described by metes and bounds as follows; BEGINNING at a 5/8 inch iron rod set at the intersection of the west line of Calle Las Colonias {60' ROW) and the north line of Saratoga Blvd. (variable ROW), for the most southerly corner of said 17.9945 acre tract and the most southerly comer of this tract. THENCE: N 80°26'08" W - 53.02 feet, with the north line of Saratoga Blvd., to a point for the west corner of this tract.
