TO CONTRACT FOR
PROFESSIONAL SERVICES
This City of Corpus Christi, Texas hereinafter called "CITY", and Maverick Engineering Inca
hereinafter called "CONSULTANT", agree to the following amendment to the Contract for
Professional Services for McNorton Channel Improvements, Phase 1 (Project No. 2214) as
authorized and administratively amended by:

Amendment No. 1 Aril 19, 2005 Motion No. 2005-116 $239,906.00
Amendment No. 2 October 4, 2006 Administrative A royal $24,867.00
Amendment No. 3 Janus 12, 2009 Administrative A royal $22,614.00
^ In the original contract, Section 1. SCOPE OF SERVICES, Part B, Additional Services shall be
amended as further described in the attached Exhibit "A":
Item No. 2 ROW Acquisition Survey shall be amended to include additional ROW
Acquisition Survey Services.
Item No. 6 Las Colonias ROW Acquisition Survey (Project No. 2268) shall be added to
Additional Services in order to complete the necessary property research, locate the
ROW/easements in the field and prepare metes and bounds description.
^ In the original contract, Section 3. FEES shall be modified as shown on the attached Exhibit "A"
for a revised fee not to exceed $7,600.00 (Seven Thousand Six Hundred Dollars and Zero
Cents , for a total restated fee not to exceed X319,983.00 (Three Hundred Nineteen
Thousand Nine Hundred Eis~hty-Three Dollars and Zero Cents).
All other terms and conditions of the Contract and Amendments between the City and Consultant
will remain in full force and effect.

Dear Mr. Anaya:
Maverick Engineering, Inc. (Maverick) is pleased to submit our fee proposal for providing additional
services for the McNorton Channel Improvements -Phase 1 (Project No. 2214) as outlined in the
attached Man Hour Estimate and my emails to Jerry Shoemaker on September 9t'' and September 21St
2009. The additional scope of services and corresponding fees are shown below:
Task 1: McNorton Channel ROW Relocation
The first step would be to determine whether or not the existing ditch is within the currently
dedicated ROW and then, if necessary prepare the meets and bounds description needed for the
property transfer required if in fact the ditch is not located within the currently dedicated ROW.
Our fee for this task will be $3,100.
Task 2: Las Colonias ROW Acquisition Survey
We have reviewed the property requirements associated with the City's Las Colonias Subdivision
Drainage Improvements and Drainage Channel Clearing and Stabilization projects (City Project
numbers 2268~'as designed by FNI. MEI will complete the necessary property research,
locate the ROW/easements in the field and prepare the metes and bounds description and Exhibit A
for the City's use in its acquisition process for the two parcels in_queston,
Our fee for this task will be $4,500.
The Total Proposed Fee for Amendment No. 4 is: $7,600.00

FILING REQUIREMENTS
If a person who requests official action on a matter knows that the requested action will confer an
economic benefit on any City official or employee that is distinguishable from the effect that the
action will have on members of the public m general or a substantial segment thereof, you shall
disclose that fact in a signed writing to the City official, employee or body that has been
requested to act in the matter, unless the interest of the City official or employee in the matter is
apparent. The disclosure shall also be made in a signed writing filed with the City Secretary.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
