TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY", and GOLDSTON ENGINEERING INC., a CH2M
Hill Company, hereinafter called "CONSULTANT," agree to the following amendment to the Contract for
Professional Services for Southmoreland Addition Street Improvements Phases 3B ~ 46• Part 2 Part 3
Part 4 & Part 5 (Proiect Nos. 6522.6525. 6526 8 65271 as authorized and amended by:

^ In the original contract, Section II. SCOPE OF SERVICES shall be amended to include professional
services to design sanitary sewer line improvements along Naples Street from Norton Street to Richard
Street for Part 5 (Proiect No. 65271 as shown in the attached Amendment No. 3, Exhibit "A."
^ In the original contract, Section IV. FEES shall be modified as shown on the attached Exhibit "A-1"for a
revised fee not to exceed $41.600.00 (Forty-One Thousand Six Hundred Dollars and Zero Centsl, for
a total restated fee not to exceed $381.711.00 (Three Hundred Eighty-One Thousand Seven Hundred
Eleven Dollars and Zero Cents).
All other terms and conditions of the February 25, 2003 contract and amendments between the City and
Consultant will remain in full force and effect.

AMENDMENT NO 3. to Part 5 (Proiect No. 6527)
Dear Mr. Anaya:
Please accept this letter as our proposal to amend our original and amended contract to include
sanitary sewer line improvements along Naples Street from Norton Street to Richard Street.
Southmoreland Addition Street Improvements Phases 3B & 4B, Part 1 (Project No. 6172)
included all of Fannin Street and Lewis Street from Fannin Street to Norton Street.
Amendment No. 2 included professional services to repackage the bid documents proposed for
Southmoreland Addition Street Improvements Phases 3B & 4B (Project No. 6172), into 5 parts
in order to accommodate available funding. The remaining portions of the Southmoreland
Addition Street Improvements include:
• Part 2 (Proiect No. 6522) -Norton Street from Ayers Street to Naples Street, and Lewis
Street from Norton Street to Watson Street
• Part 3 (Proiect No. 6525) -Watson Street from Ayers Street to 770 LF southeast of
Ayers Street
• Part 4 (Proiect No. 6526) -Watson Street from 770 LF southeast of Ayers Street to
Naples Street, and Lewis Street from Watson Street to Clemmer Street, and
• Part 5 (Proiect No. 6527) -Naples Street from Norton Street to Richard Street.
Amendment No. 3 includes professional services to design sanitary sewer line improvements
along Naples Street from Norton Street to Richard Street. The elevation of the existing line is too
high, resulting in a reverse grade for the sanitary sewer connection from Norton Street. The
reverse grade causes the system along Norton Street to be surcharged, which causes
objectionable odor problems and backups into homes. This problem cannot be corrected without
improvements to the sanitary system along Naples Street.

The following are the proposed changes to the original executed contract and amended executed
contracts:
1. Scope of Services: Professional services to design removal of approximately 815 LF of
existing 12" VCP sanitary sewer line, removal of two (2) existing sanitary sewer
manholes, install approximately 815 LF of proposed 18" sanitary sewer line, install two
(2) new 4' sanitary sewer manholes and rehab one (1) existing sanitary sewer manhole.
The proposed sanitary sewer line improvements will be incorporated into Southmoreland
Part 5 (Project No. 6527) design and construction.

DEFINITIONS

a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
"Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
