Street Imps, Ph. 2 -Project #6490, Parcel 3 SIDEWALK EASEMENT JAN 2 2 2010 THE STATE OF TEXAS § ~ CITY SECRETARY'S OFFICE KNOW ALL BY THESE PRESENTS: COUNTY OF NUECES § THAT KOSTORYZ PLAZA, INC., A TEXAS CORPORATION (GRANTOR) of 4601 Acushnet, Corpus Christi, Nueces County, 78413, in consideration of TEN DOLLAR ($10.00) and other good and valuable consideration paid by the CITY OF CORPUS CHRISTI, (GRANTEE) of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, have conveyed, and do convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description attached and incorporated as Exhibit "A" ("Premises") A map showing the location of the SIDEWALK EASEMENT is attached and incorporated as Exhibit "B". Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, for the purpose of constructing a sidewalk across said property now occupied by Grantor and for the purposes of maintaining, servicing, repairing and inspecting said public sidewalk on and along the Premises. SPECIAL PROVISIONS: 1. All construction is to be done in a prudent and workmanlike manner. TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives, for use as a SIDEWALK EASEMENT for so long as used for such purpose, and if the use of said easement is ever abandoned, then the aforesaid rights and privileges shall cease. 2010-052 Ol/10/10 Kostoryz Plaza INDEXED Grantor KOSTORYZ PLAZA, INC. This 60 square foot tract is more particularly described by metes and bounds as follows: COMMENCING at a Texas Department of Transportation right of way monument found at the northwest cutback line of a right of way known as S.P.I.D.
