THAT KOSTORYZ PLAZA, INC., A TEXAS CORPORATION (GRANTOR) of 4601
Acushnet, Corpus Christi, Nueces County, 78413, in consideration of TEN DOLLAR ($10.00) and
other good and valuable consideration paid by the CITY OF CORPUS CHRISTI, (GRANTEE) of
1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby
acknowledged, have conveyed, and do convey to the City of Corpus Christi, a Texas Home Rule
municipal corporation, its successors and legal representatives, the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated
in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and
incorporated as Exhibit "A" ("Premises")
A map showing the location of the SIDEWALK EASEMENT is attached
and incorporated as Exhibit "B".
Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, for the
purpose of constructing a sidewalk across said property now occupied by Grantor and for the
purposes of maintaining, servicing, repairing and inspecting said public sidewalk on and along the
Premises.
SPECIAL PROVISIONS:
1. All construction is to be done in a prudent and workmanlike manner.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors and legal representatives, for use as a SIDEWALK
EASEMENT for so long as used for such purpose, and if the use of said easement is ever abandoned,
then the aforesaid rights and privileges shall cease.

KOSTORYZ ROAD
RIGHT OF WAY ACQUISITION
60 SQUARE FEET
BEING a 60 square foot tract of land out of Lot W-1, Lexington Place Subdivision, as recorded
in Volume 33, Page 16, Map Records, Nueces County, Texas.
This 60 square foot tract is more particularly described by metes and bounds as follows:
COMMENCING at a Texas Department of Transportation right of way monument
found at the northwest cutback line of a right of way known as S.P.I.D. (South Padre
Island Drive) and said Kostoryz Road (an 80 foot wide right of way) at the northeast
comer of Lot O, said Lexington Place;
THENCE: North 28° 37' 20" East, with the west line of said Kostoryz Road and the
east line of said Lexington Place, a distance of 1,117.30 feet to a point on the east line
of Lot W-1 of said Lexington Place the southerly right of way transition of McArdle
Road (a 60 foot wide right of way), and the beginning of a circular curve to the left
having a radius of 10.00 feet, a central angle of 38°33'36", an arc length of 6.73 feet, a
chord bearing of North 09° 19' 43" East, and a chord length of 6.60 feet to the point of
terminus of said curve and the beginning of a second circular curve to the left for the
southeast corner and POINT OF BEGINNING of the herein described tract;
THENCE: in a southwesterly direction with the said curve to the left, having a radius
of 14.00 feet, a central angle of 29°38'43", an arc length of 7.24 feet, a chord bearing of
North 47° 03' 48" West, and a chord length of 7.16 feet to the point of terminus of said
curve;
THENCE: North 61 ° 53' 10" West, a distance of 25.58 feet to a point for the
southwest corner of the herein described tract;
THENCE: North 28° 06' S0" East, a distance of 2.00 feet to a point on the existing
southerly right of way line of said McArdle Road for the northwest corner of the herein
described tract;
THENCE: South 61 ° 53' 10" East with said existing southerly right of way of
McArdle Road, a distance of 24.64 feet to a point for the beginning of a circular curve
to the right;
THENCE: in a southeasterly direction with the existing southerly line of said McArdle
Road and said curve to the right, having a radius of 10.00 feet, a central angle of
51 °55' 16", an arc length of 9.06 feet, a chord bearing of South 35° 55' 32" East, and a
chord length of 8.76 feet to the point of terminus of said curve and the POINT OF
BEGINNING of the herein described tract containing 60 square feet of land more or
less.
