The headings and outline designations rifer to those from the original contract. Amended sections retain the same number and letter designation; new sections append the sequencing of the original contract. EXHIBIT "A", PART 1. SCOPE OF SERVICES, SECTION B. ADDITIONAL SERVICES, ITEM NO.4 CONSTRUCTION OBSERVATION SERVICES shall be modified to include the following: Provide construction observation for the period of December 3, 2009 through February 2,~A99. ~~~ EXHIBIT "A" PART 3. SUMMARY OF FEES shall be modified and is attached as Exhibit "A" Summary of Fees for a revised fee not to exceed X49,000.00 (Forty Nine Thousand Dollars and Zero Cents), for a total restated fee not to exceed $1.059,863.18 (One Million Ten Thousand Eight Hundred Sixty Three Dollars and Eighteen Cents). All other terms and conditions of the May 31, 2005 contract and amendments between the City and Consultant will remain in full force and effect. This amendment authorized construction. administration and. construction observation services tluough October 2, 2009. On November 25, 2x09, we provided the City with a letter seeping compensation for construction observation services for the period of rJctobet• 2, 2009 through December 2, 2010 in the amount of $49,000. Amendment Nv. 6 is pendinl final City approval and execution. and ineiudes these SerVlces. At this time we are requesting compensation for construction observation services for the period of December 3, 200 through February 2, 2009 in the amount of $49,000. VVe will invoice the City on a time ,and material basis. not to exceed: this amount. As work progresses, we will evaluate the need for construction obsea~vation services for the upcoming months and request. authorization as appropriate. Pa e 1 of 1 a ~ Exhibit B Mandatory Requirements (Revised November, 2005) INDEMNIFICATION AND HOLD HARMLESS For non-professional services, Consultant agrees to indemnify, save harmless and defend the City of Corpus Christi, and its agents, servants, and employees, and each of them against and hold it and them harmless from any and all lawsuits, claims, demands, liabilities, losses and expenses, including court costs and attorney fees, for or on account of any injury to any person, or any death at any time resulting from such injury, or any damage to any property, which may arise or which may be alleged to have arisen out of or in connection with the work covered by this contract. For professional services, Consultant agrees to indemnify, save harmless and defend the City of Corpus Christi, and its agents, servants, and employees, and each of them against and hold it and them harmless from any and all lawsuits, claims, demands, liabilities, losses and expenses, including court costs and attorney fees, for or on account of any injury to any person, or any death at any time resulting from such injury, or any damage to any property, to the extent caused or alleged to have been caused by the Consultant's negligent acts, errors or omissions in the performance of professional services under this contract. The foregoing indemnity shall apply except if such injury, death or damage is caused by the sole or concurrent negligence of the City of Corpus Christi, its agents, servants or employees or any other person indemnified hereunder. A member of any board, commission, or committee appointed by the City Council of the City of Corpus Christi, Texas. b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to have an effect on that interest that is distinguishable from its effect on members of the public in general or a substantial segment thereof. c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-time basis, but not as an independent contractor. d. "Firm."
