Water Pipeline Easement and Right-of-Way Amendment

KNOW ALL BY THESE PRESENTS:
THIS FIRST AMENDMENT TO THE Water Pipeline Easement nd fight-of-Way_
Agreement ("Amendment") is made and entered into effective as of ~.o (',~
?~89', by and between Martin O'Connor Ranch, Ltd., a Texas limited partnership (Grantor)
and the City of Corpus Christi, Texas (Grantee).
RECITALS
NOW, THEREFORE, inconsideration of the mutual promises and covenants set forth
below, the parties, intending to be legally bound, agree as follows:
WHEREAS, Grantor has conveyed and granted to the Nueces River Authority, since
assumed by the City of Corpus Christi (Grantee) aright-of--way and easement, referred to
herein as the "Water Pipeline Easement and Right-of-Way Agreement", recorded as File
No. 1338, County Clerk, Victoria County, Texas, and
WHEREAS, the existing purpose of the easement is to lay, .construct, operate, inspect,
maintain, repair, replace, reconstruct, remove, or decrease the size of (herein collectively
called "Construct, Operate, and Maintain") one 64 inch inner diameter fresh water pipeline
and above ground appurtenances (only as to the type and number set forth herein) and
below ground appurtenances, usually associated with water pipelines. (collectively the
"Pipeline Facilities") for the transportation of fresh water only.
WHEREAS, the "Water Pipeline Easement and Right-of-Way Agreement" in Section 1,
Part B, Subsection c has "up to but no more than 13 "Corrosion Test Stations", including
protective structures/housings associated therewith"; and
WHEREAS, Grantor and Grantee desire to amend this Section 1, Part B, Subsection c of
the Original Easement to grant to the City the right to install one additional corrosion test
station located at Station #1906+13, shown on the attached and incorporated "Exhibit A".
Now therefore, For Ten dollars ($10) and other good and valuable consideration, paid by
the City of Corpus Christi (Grantee), receipt of which is hereby acknowledged, the Parties
agree that the Original Easement is amended as follows:
1. To Section 1, Part B, Subsection c shall read:
up to but no more than 14 "Corrosion Test Stations", including protective
structures/housings associated therewith; and
