KNOW ALL BY THESE PRESENTS:
THIS FIRSTAMENDMENT TOTHE Water Pipeline Easeme~#,and Right-of-Way Agreement
("Amendment") is made and entered into effective as of r/a~. ~8 , 2010, by and
between Allen Anthony Harkins (Grantor) and the CITY OF CORPUS CHRISTI, TEXAS
(Grantee).
RECITALS
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth
below, the parties, intending to be legally bound, agree as follows:
WHEREAS, Grantor has conveyed and granted to the NUECES RIVER AUTHORITY,
since assumed by the CITY OF CORPUS CHRISTI (Grantee) aright-of-way and
easement, described to herein as the "Memorandum of Water Pipeline Easement",
recorded as File No. 8570, County Clerk, Refugio County, Texas, and
WHEREAS, the existing purpose of the easement is to lay, construct, operate, inspect,
maintain, repair, replace, reconstruct, remove, and decrease the size of (herein collectively
called "Construct, Operate, and Maintain") one sixty-four inch (64") inner diameter fresh
water pipeline and associated underground communication cables, cathodic protections,
and other fixtures, below ground, usually associated with water pipelines on, under, and
across Grantor's Lands in Refugio County Texas.
WHEREAS, the "Water Pipeline Easement and Right-of-Way Agreement" in Section 21,
Part A, states that "Two-inch air release vacuum valves, corrosion test stations, and water
pipeline markers (collectively "Minor Appurtenances") may be installed on the Easement,
during the Initial Construction Period, as are reasonably necessary."; and
WHEREAS, Grantor and Grantee desire to amend this Section 21 of the Original
Easement to grant to the City the right to install one additional corrosion test station after
the Initial Construction Period, located at Station #3131+00 as shown on the attached and
incorporated "Exhibit A".
NOW THEREFORE, FOR TEN DOLLARS ($10) AND OTHER GOOD AND VALUABLE
CONSIDERATION, PAID BY THE CITY OF CORPUS CHRISTI (GRANTEE), RECEIPT
OF WHICH IS HEREBY ACKNOWLEDGED, THE PARTIE ~4GREE THAT THE

1. To Section 21 the following subsection "21.11" is added:
"21.11. The City of Corpus Christi (Grantee) is permitted to install one additional
corrosion test station located at Station #3131+00 as shown on the attached and
incorporated "Exhibit A -Subsection 21.11."
2. All terms and conditions of the Original Easement not changed herein remain the
same.
