SIDEWALK EASEMENT

KNOW ALL BY THESE PRESENTS:
THAT MAJB INVESTMENTS LIMITED LIABILITY COMPANY (GRANTOR) of 4455
SPID Dr., Ste. 22, Corpus Christi, Nueces County, 78411-5148, in consideration of TEN DOLLAR
($10.00) and other good and valuable consideration paid by the CITY OF CORPUS CHRISTI,
(GRANTEE) of 1201 Leopard Street, Corpus Christi, i~ueces County, Texas 78401, the receipt of
which is hereby acknowledged, have conveyed, and do convey to the City of Corpus Christi, a Texas
Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted
use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and
incorporated as Exhibit "A" ("Premises")
A map showing the location of the SIDEWALK EASEMENT is attached
and incorporated as Exhibit "B".
Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, for the
purpose of constructing a sidewalk across said property now occupied by Grantor and for the
purposes of maintaining, servicing, repairing and inspecting said public sidewalk on and along the
Premises.
SPECIAL PROVISIONS:
1. All construction is to be done in a prudent and workmanlike manner.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors and legal representatives, for use as a SIDEWALK
EASEMENT for so long as used for such purpose, and if the use of said easement is ever abandoned,
then the aforesaid rights and privileges shall cease.

RIGHT OF WAY ACQUISITION
252 SQUARE FEET
PARCEL 2
BEING a 252 squaze foot tract of land out of Lot 23-C, Block 2, Mahan Acres, as recorded in
Volume 9, Pages 50-51, Map Records, Nueces County, Texas.
This 252 square foot tract is more particulazly described by metes and bounds as follows:
COMMENCING at a 5/8 inch iron rod found at the southeast corner intersection of
Mahan Drive (a 40 foot wide right of way), and the east line of Kostoryz Road (an 80
foot right of way), and the southwest comer of Lot 12, Block 1 of said Mahan Acres.
THENCE: South 28° 07' 22" West, with the east line of said Kostoryz Road and the
west line of said Mahan Acres, a distance of 2,156.84 feet to a point on'the east line of
Lot 23-C, Block 2, said Mahan Acres for the northwest corner and POINT OF
BEGINNING of the herein described tract;
THENCE: South 09° 17' 49" East, a distance of 33.66 feet to a point on the northerly
line of said McArdle Road (a 60 foot wide right of way) for the southeast corner of the
herein described tract;
THENCE: North 61 ° 52' 40" West with the northerly right of way of said McArdle
Road, a distance of 10.45 feet to a point at the beginning of a circulaz curve to the right;
THENCE: in a northwesterly direction with the northerly line of said McArdle Road
and said curve to the right, having a radius of 10.00 feet, a central angle of 90°00'02",
an azc length of 15.71 feet, a chord bearing of North 16°52'37"West, and a chord
length of 14.14 feet to a point on the easterly line of said Kostoryz Road;
THENCE: North 28° 07' 22" East, with said easterly line of Kostoryz Road, a distance
of 16.73 feet to the POINT OF BEGINNING of the herein described tract containing
252 square feet of land more or less.
