HomeMy WebLinkAboutC2010-189 - 6/8/2010 - ApprovedPage'! of 3 INTERLOCAL COpPERATION AGREEMENT BETWEEN THE CITY OF CORP€15 CHRI3T# AND CORPUS CHRISTI INDEPENDENT SGHpQL D#STRICT This agreement (Agreement} is entered into between the City of Carpus Christi, a Texas home-rule municipal corporation (City}, and the Corpus Christi Independent School District (District} for purposes of the Inferlocal Cooperation Act, Texas Government Cade, Chapter 7'9'f, as amended, to achieve efficiency in meeting intergovernmental responsibilities. WHEREAS, the City is sponsoring summer recreational programs far children from June 't4, 26'14, to August B, 24~ 0, at which food will he served (Summer Favd Program}; and WHEREA5, the District agrees to provide unitized !ranch and snack meals, inclusive of milk and juice {hereinafter c^llec#ively referred tv as Meats}, to the City for a fixed fee. NOW, THEREFORE, the City and the District, in cansideratian of fhb mutual covenants contained herein, agree as follows: 9. Term. This Agreement begins .tune ~4, 2D'f 6 and ends August fi, 2016. 2. Consideration. The City shat! pay the ^istriot $2.5U per lunch meal and $.65 per snack meat. 3. Billing. The District shall bill the City on a monthly basis far all Meals provided to the City. The City stroll pay the bill within two Fridays offer receipt of the bill out of current City revenue. 4. Nutritlanal Assurances. The District assures t#tat each Meal Witt meet the minimum nutrition value and content requirements, in accordance with the Texas ^epartmenf of Agriculture FY 2i]14 Summer Food Service Program regulations. tea. Recardkeeping. A. The District must maintain full and accurate records including, but not limited ta, the following: 1. Menu retards (Menu Records), including the amount of food prepared; and 2. Meal records (Meal Records}, including the daily number of Meals delivered by type. B. The District must retain the Menu Records and Meat Records far S years and 9[} days, or sa tong as an audit is in progress. The district must malts all records and accounts pertaining to this Summer Food Program available to representatives of the United 5#ates ^epartment of Agricu#ture and the General Accounting Office far audit ar administrative review at a reasonable time and place. B. Food Service Dlaeratians. The District will maintain its food service operations at fits ^lstrict's facility during the term of this Agreement as a part of the consideration. T. Workers. The food service workers wil! continue to be the District's employees for the term of this Agreement and, therefore, subject to the District's board policies and regulations. Their salaries and benefits, if any, will be paid out of the City's consideration payments set out abpve. 8. Cnordit~atlon. The City'$ Director of Parks and Recreation, or designee, shall plane a weekly orderwith Jody Houston, the District's appointed representative, or designee, far the number of Meals by type needed, the sites at which the Meals are needed, and the time at which the Meals must arrive at each site. 9. Gvvernmer~tal Service, This Agreement is between the City and the ^istrlct far the purpose of providing Meals far the Summer i=vvd Program sites and acfivity sites and is not for the beneft of any third party or individual. 'IS3, Curren# Revenue. Ali money spent far this Summer Food Program through this Agreement must be spent out of currently available revenue of the City and the district. 'I'I. Entirety Clause. This Agreement expresses the entire agreement between the parties. Any modification, amendment, or addition to this Agreement is net binding upon the parties unless in writing and signed by persons authorized to malts these agreements on behalf of the respective party.
