AMENDMENT NO. 3
This amends the Interlocal Cooperation Agreement between the CITY OF
CORPUS CHRISTI {City} and the TEAS A&M UNIVERSITY - KINGSViLLE,
authorized by the Corpus Christi City Council by Resolution Nv. 027503 on November
20, 2007 {the "Agreement"} and incorporated here by reference.
WHEREAS, The Texas Commission on Environmental C~uality {TCEQ} and the City are
amending the existing Grant Agreement Number 582-8-8fi230 in order to supplement
the original work plan, and increase the maximum amount reimbursable under the grant
to $1,142,870.74 by adding Fiscal Year 2010 funds in an amount of $258,270.74, as
authorized by the General Appropriations Act, 81St Legislature, TCEC~ Rider 8;
WHEREAS, the parties desire to amend their Agreement accordingly, tv extend the
Agreement term tv end ^n August 31, 2010, and to add an additional amount
{$149,903.34} that the City will reimburse TAMUK for expenses authorized under the
Grant;
WHEREAS, the parties desire to amend their Agreement under authority of Section 15,
which provides that the representatives who were authorized to sign this agreement are
authorized to execute minor amendments to this agreement, such as GYtanges in deadlines and
minor changes in the scope of warlc;
NOW, THEREFORE, the parties hereto agree to amend the Agreement as fellows:
1. AMENDMENT TO THE TERM. Tt~e date that the term of the Agreement ends is
amended tv replace "March 31, 2010" with Au_aus# 31, 2090.
2. AMENDMENT TO SECTION 2. Section 2 of the Agreement is amended as follows:
"2. STATEMENT OF WORK. TAMUK agrees to use its best efforts to execute

projects in support of t#~e State Implementation Plan {SIP} development process
and other types of air quality planning activities and projects that the City, in

Christi Ozone Near Nan-Attainment Area Research Study, which is attached to
TCEi~ Contract No. 582-8-86230 as Attachment B {copy available upon

3. AMENDMENT TO SECTION 4. Section 4 of the Agreement is amended as follows:

4. AMENDMENT TC SECTION 5. Section 5 of the Agreement is amended as follows:
"5. PRICE AND PAYMENT. As compensation far the performance of the
agreement, the City agrees to reimburse TAMUK up to Four Hundred Fifty
Thousand 13vlkars {$450,000}, plus an additional amount of_, _ up to
~149,903,34~ for expenses authorized under the Grant."
5. All other terms and conditions of the Agreement remain unchanged.
