TEXAS A & M UNIVERSITY -- CORPUS CHRISTI & THE CITY OF CORPUS CHRISTI
AMENDMENT N0.3
This amends the Interlocal Cooperation Agreement between the C1TY OF
CORPUS CHRISTI [City} and the TEXAS A&M UNIVERSITY -CORPUS CHRISTI
{TAMU-CC}, authorized by the Corpus Christi City Council by Resolution No. 027504 an
November 20, 2007 (the "Agreement") and incorporated here by reference.
WHEREAS, The Texas Commission on Environmental Quality {TCEQ} and the City are
amending the existing Grant Agreement Number 582-8-86230 in order tv supplement
the original worst plan, and increase the maximum amount reimbursable under the grant
to $1,142,87x.74 by adding Fiscal Year 24'#0 funds in an amount of $258,270.74, as
authorized by the General Appropriations Act, 81st Legislature, TCEQ Rider 8;
WHEREAS, the parties desire to amend their Agreement accordingly, to extend the
term tv end on August 31, 2x10, and to add an additional amount {$87,235.00} that the
City will reimburse TAMUCC for expenses authorized under the Grant;
WHEREAS, the parties desire to amend their Agreement under authority of Section 15,
which provides that the representatives who were authorized to sign this agreement are
authorized to execxrte minor amendments to this agreement, such as changes in deadlines and
minor changes in the scope of work;
NOW, THEREFORE, the parties hereto agree tv amend the Agreement as follows:
1. AMENDMENT TO THE TERM. The date that the term of the Agreement ends is
amended to replace "March 31, 2010" with August 37.2070.
2. AMENDMENT TO SECTION 2. Section 2 of the Agreement is amended as follows:
"2. STATEMENT OF WORK. TAMUCC agrees to use its hest efforts to
execute the Work Plan document that describes down to the task level {Task
t] the projects in support of the State Implementation Plan {SIP] development
process and other types of air quality planning activities and projects that the

Plan for a Corpus Christi Pollution Preen#ion Partnership and Educational

3. AMENDMENT TD SECTION 4. Section 4 of the Agreement is amended as follows:
"4. PERIOD OF PERFORMANCE. The program shall be conducted from the

4. AMENDMENT TG SECTION 5. Section 5 of the Agreement is amended as follows:
"5. PRICE AND PAYMENT. As compensation for the performance of the
agreement, the City agrees to reimburse TAMUCC up to Three Hundred Forty-
fi~e Thousand ^ollars ($345,QQQ] lus an additional amount of u to
$81,235.00, for expenses authorized under the Grant."
5. All other terms and conditions of the Agreement remain unchanged.
