THAT D & E DEVELOPMENT CORPORATION, (GRANTOR) of 1038 Hill Country Road,
Edinb>arg, Hidalgo County, Texas, 78539-5810 in consideration of Ten Dollars ($10.00) and other
good and valuable consideration paid by the CITY OF CORPUS CHRISTI, (GRANTEE) 1201
Leopard Street, Corpus Christi, Nueces County, Texas 78469-9277 the receipt of which is hereby
acknowledged, has granted and conveyed, and does grant and convey to the City of Corpus Christi, a
Texas Home Rule municipal corporation, its successors and legal representatives, the free and
unintezrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain
tract of land situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and incorporated as
"Exhibit A". (Premises)
A map showing the location of the RIGHT-OF-WAY EASEMENT is
attached and incorporated as "Exhibit B". (Premises)
Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its
franchisees, to construct, operate, repair and maintain streets, sidewalks, curbs, gutters and
appurtenances upon said Premises for the public use by foot, with automobiles, carts, carriages and
all other vehicles and all other means of transportation necessary or convenient at all times and in all
seasons in, along and upon said Premises, as well as to lay, operate, inspect, replace, repair, service
and maintain public utility lines, storm sewers, and franchised utility lines in, on, over, under and
along said Premises.

TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of
Corpus Christi, Texas, its successors, legal representatives, franchisees and the public, for the proper
use as public streets and utility easements for so long as used for such purposes, and if the use for
said easements and rights of way is ever abandoned, then the aforesaid rights and privileges cease.

METES AND BOUNDS DESCRIPTION

ADDITIONAL AIRLINE ROAD R.p.W.
being 0.556 acres of land, more or less, for additional right-of-way for Airline Road, said 0.556 acre tract
being auk of a 40.733 acre tract recorded in Volume 2337, Page 334, Deed Records of Nueces County,
Texas, and said 40.773 acres of land being out of the East Half of Lot 4 and a!I of Lats 5 and 6, Section 20,
Flour Bluff & Enclnal Farm & Garden Tracts, and this 0.556 acre tract being more particularly described
by metes and bounds as follows:
Beginning at the northwest corner of this tract and said 40.733 acre tract, said corner having a
coordinate of N 17,135,940:73', E 1,351,861.67', Texas State Plane Grid, Texas South Zone, NAD'83, and
said corner being on the southeast cutback line of the present intersection of Airline Road with
Saratoga Boulevard;
Thence N 88-29-04 E with said cutback line being the north boundary of this tract and said 40.733 acre
tract, 23,90 feet, to the northeast corner of this tract;
Thence 5 00-45-40 W wlth the east boundary of this tract and entering said 40.733 acre tract, 231.96
feet, to a turning point of this tract;
Thence S 08-55-24 W and continuing with the east boundary of this tract, 94.98 feet, to a turning point
of this tract;
Thence S OZ-D6-28 W and continuing with the east boundary of this tract and, $98.15 feet, to the
southeast corner of this tract, said corner being on the south boundary of said 40.733 acre tract, the
same being the north boundary of an 80.00 foot wide drainage right-of-way recorded in Volume 1790,
Page 171, Heed Records of Nueces County, Texas;
Thence N 74-36-47 W with the south boundary of this tract and said 40.733 acre tract, the same being
the north boundary of Bald drainage right-of-way, 18.15 feet, to the southwest career of this tract and
said 40.733 acre tract, said corner being on the present east right-of-way line of Airline Raad;
Thence N 02-07-05 E with the west boundary of this tract and said 40.733 acre tract, the same being the
present east right-af-way line of Airline Road and running 30.00 feet fast of and parallel to the
