Box 9277, Corpus Christi, Texas 78469-9277 (City} acting through its duly authorized City Manager or Designee (Director of Engineering Services} and Chiang, Patel, and Yerby, lnc., a Texas corporation, 1820 Regal Row, Suite 200, Dallas, Texas 75235, (ArchitectlEngineer--Consultant), hereby agree to the amendment of the contract administratively approved December 21, 20D7 and amended by Motion 2008-005, January 8, 2008 and amended administratively by amendment January 3, 2008 and administratively approved February 10, 2008 and administratively approved March 24, 2008 October 14, 20D8 and administratively amended November 20, 2008 and administratively amended January 2009 and amended by Motion 2009-DD3, January 13, 2009 and administratively amended on May 23, 2409, and amended by Motion 2009-169 on June 16, 2049 and administratively amended on October 16, 2009 and administratively amended January 22, 2009 (processing delayed), and administratively amended January 13, 2010, and Amendmen# No. 14 administratively amended March 24, 2010, and Amendment No. 15 in process hereby agree to the amendment as follows Section II. A. Basic Services is amended to add the following: II,E.B Additional Services - Analysis of Landfill Liquid Requirements and Leachate System. The Consultant will: 1. Identify the physical conditions for the conveyance system design under the current permit requirements for Unit 1. 2. Establish the anticipated quantities to be recirculated or managed as part of the liquids conveyance system for Unit 1, 3. Prepare conceptual designs showing alignment and locations of the conveyance system and future installations or modifications to the existing permitted leachate management system for this portion of the Landfill. 4. Prepare hydraulic model and pertorm hydraulic analysis of the conceptual conveyance system to identify preliminary sizing of conveyance piping. The services to be provided under this amendment are more fully discussed and set forth by the proposal letter attached as Exhibit A-17. Section III Fees Authorized is amended to read: II. FEES AUTHORIZED The City will pay the Consultant a total not to exceed fee of $932,532.00. Consultant will be compensated far airfare, ground transportation, lodging, and per diem meal expenses incurred due to out-of-town travel on a not to exceed basis as set forth in the Summary of Fees. Travel wiff be will be documented by photocopies of receipts and invoices. Per Diem will be at the GSA rate. The table "Summary of Fees" shall be used when calculating the fee due for the proportion of services completed. The City shall make prompt payments in response to Consultant's statements far Professional Services. Billing for services provided in Section I1 A, B, D, and E will be based on the Consultant's estimate of the percent of services complete at the time of billing. The fee for additicnal services (Section I LE) is included as part of the fee fisted for Design, Bid and Construction phase services Fisted in the table "Summary of Fees". However, in no case will the billing exceed 90% of the fee for each phase until the delivery of documents associated with each phase has been reviewed and accepted by the City. Billing for services provided in Section ILC.1 will be based on the amount of construction completed. Billing for services provided in Section II.C.2 shall be payable upon delivery of the record drawings to the City Engineer. Billing for services provided in Section I1.C will be payable upon performance of inspections and delivery of all materials to the City. Survey worn will be invoiced at the billing rate of the sub-consultant performing the survey without markup. Consultant will submit monthly statements far work authorized by the City Engineer and performed by the Consultant. The statement will be based upon Consultant's estimate and concurrence by the City of the proportion of the total services actually completed at the time of billing. The City will make prompt monthly payments in response to Consultant's monthly invoices. All invoices shall be accompanied by a cover letter summarizing the fee in accordance with the Summary Schedule of Fees. Invoices will be sequentially numbered for each project and state the project name, The fetter shall state the number of the current invoice, the contract fee for each task, the amount previously invoiced for each task, and the current amount due. Invoices will be organized to accommodate funding sources. During the construction phase, the ArchitectlEngineer will also submit a brief letter/memo summarizing observations during the site visit, khe work of the contractor, construction progress for the billing period, and any pending items. Valenzueia Landfill, Disposal Cell 1 A - Project -5aa~ Dear Mr. Stowers; CP&Y, Inc, is respectfully requesting approve! of Amendment No. 17 to our contract for the above referenced project. The current design of the. Cefe F. Valenzueia !_andfill will ultimately require installation of eleven {ii) leachate collection sumps in Unit 1. At the present time two Leachate Collection sumps have been installed in two of the three landfill cells that have been constructed at the Cefe 1=, Valenzueia Landfill since late 2007. As the landfill develops sequentially, it will become more difficult to adequately control, monitor and. manage the iandfdl conveyance systems and ether landfill systems overall. The Landfill footprint perimeter of Unit 1 is approximately 12,000 feet in length and the grade differential around the site is minimal.. This limited grade differential and the long distance around the site is expected to require considerable design attention to properly manage the movement of landfill liquids around this perimeter. The currently constructed perimeter leachate collection system consists of a 4" forcemain along the north end of the site, connecting sumps 3D and ~4A, that discharges into a main discharge line near cell 3D. This discharge line is a buried 4" diameter MDPE pipe that branches east of the landfill and discharges into the two evaporation ponds constructed on the site. The 4" diameter HDPE perimeter leachate forcemain connecting sumps 3D and 4A will be extended and connected to leachate sumps 1-A1and 1A2 for Cell 1A. Work to be performed under this Amendment 17 will consist of the following: 1. iden#ify the physical conditions far the conveyance system design under the current permit requirements for Unit 1. 2. Establish the anticipated quantities to be recirculated or managed as part of the liquids conveyance system for Unit 1. 3. Prepare conceptual designs showing alignment and locations of the conveyance system and future installations or modifications to the existing permitted leachate management system for this portion of the Landfill. 1824 tf 5 214.638.4 P 1 www.epyi.cvm 4. Prepare hydraulic model and perform hydraulic analysis of the conceptual conveyance system to identify preliminary sizing of conveyance piping. A separate portion of the ieachate collection system will eventually be required for the southern portion of Unit 1, to convey ieachate from Cells 2A, 2B, 2C, 3A, 3B and 3C eastward and tie-in to the ieacha#e evaporation pond system. Development of these cells requires consideration of the future pumping requirements and demands for maintaining proper levels for compliance in all teachate collection sumps. Work under this amendment will be performed to address-these additional cells and the need to increase the quanti#y and duration of the pumping of ieachate. This may require resizing the currently constructed system or this portion of the system to serve the southern cells. The resizing wilt be determined based on anticipated conveyance and production rate of ieachate for the completed landfill. The quantities of these liquids may be significant and may influence the required design features. An estimated quantkty wil! be developed-for each Cefl and will be used to establish a basis far development of the conveyance liquids management system, This task wilt focus on determining the most viable alternatives, and establishing the technicai requirements and conceptual designs as the s[ie development progresses into adjacent sectors. The overall ieachate conveyance system will be designed far the required management of liquids that are pumped or generated during the operation of the facility: The work described under this amendment does not include system design or evaluation far recirculation of liquids or potential liquids, such as groundwater water or condensate, to the working face or interior landfill areas. Construction drawings for installation of any ieachate conveyance piping system are not included in this scope of work. Focus of these work efforts is limited ko estimating the quantities of liquids to be conveyed, alignment and sizing of the conveyance system, and proper operation to meet future Heads of the landfill liquids management.
