Drainage Easement THE STATE OF TEXAS § COUNTY OF NUECES § KNOW ALL BY THESE PRESENTS: THAT WE, DIANA THOMAS MORRISON, HUGHES CALDWELL THOMAS, RICHARD POWER THOMAS, JEAN THOMAS TALLEY, AND JANE- HAMILTON MCKEE, INDEPENDENT CO-EXECUTORS FOR THE ESTATE OF DIANA WELDER HAMII.TON, DECEASED, ("GRANTOR"), of P.O. Box 1099, Sintan, San Patricio County, Texas 7$387, in consideration of TEN DOLLARS ($10.00), and other good and valuable consideration, paid by the CITY OF CORPUS CHRISTI, {"GRANTEE") of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, has granted and conveyed, and does grant and convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description for the DRAINAGE EASEMENT attached and incorporated as "Exhibit A". (Premises} Map showing the location of the DRAINAGE EASEMENT TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as "Exhibit B". (Premises} The Temporary Construction Easement is further described as a 20 foot wide construction easement containing 8,278.36 square feet, south of and adjacent to the permanent drainage easement. Said temporary construction easement is to be used far working room and storage of materials and machinery during the construction phase. The Temporary Construction Easement automatically terminates upon completion and acceptance of the improvements of the Flour B1uffDrive, Ph.1 SPID - Graham Road project by the City Manager of the City of Corpus Christi, Texas. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees, to construct, operate, repair and maintain drainage utilities and related appurtenances for the public use in, on, over, under and along said premises. 2010-285 08/14/10 Morrison, Diana Thomas, et al ~~~~~ TO HAVE AND TO HOLD, akl and singular, the rights and privileges aforesaid to the City ofCorpus Christi, Texas, its successors, legal representatives, franchisees and the public, for the proper use as a drainage easement far so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights ~,nd privileges shall cease.
