AMENDMENT N0.2
TO CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY", and URBAN ENGINEERING, hereinafter called
"Consultant," agree to the following amendment to the Contract for Professional Services for Flour Bluff
Drive: Phase 1 from SPID to Graham and Phase 2 from Graham to Don Patricio -BOND ISSUE 2008
[Proiect Nos. 6498 & 64991, as authorized and administratively amended by:
Ori final Contract Aril 28, 2009 Motion No. 2009-117 $1,256,500.00
Amendment No. 1 Au ust 18, 2009 Motion Na. 2009-230 $82,500,00
In the original contract, Exhibit "A", Section 1. SCOPE OF SERVICES, Part A. Basic Services and
Par# B. Additional Serrrices far Flour Bluff Drive, Phase 2 from Graham to Don Patricio (Project No.
6499) are amended as shown in the attached Amendment Na. 2. Exhibit "A" far additional design phase
work, right-of-way acquisition and topographic survey for the following addition to the project:
- To provide a bid alternative to overlay Flour Bluff Drive from Don Patricio Road to Yorktown
Boulevard.
- To provide street widening at the Purdue Road and Glenoak Boulevard intersections to add
left turn lanes.
- Plans wit! include some pavement rehabilitation in specific areas identified by Engineer and
restriping and tra#fic control will be included as required.
• In the original contract, Exhibit "A", Section 2. SCHEDULE is amended as shown in the attached
Amendment Na 2, Exhibit "A,"
^ In the original contract, Section 3. FEES shall be modified as shown on the attached Exhibit "B" for a
revised fee not to exceed $44,500.00 f Fortv-Four Thousand Five Hundred Dollars and Zero Centsl,
for a total restated fee not to exceed 1 383 500.00 One Million Three Hundred Ei ht -Three
Thousand Five Hundred Dollars and Zero Cents).
AI! other terms and conditions of the April 28, 2009 contract and amendments between the City and
Consultant will remain in full force and effect.

Subject: Flour Bluff Drive, Phase I (Project No. 6498 & 6499)
Dear Mr. Anaya:
Pursuant to request from the City we are proposing an Amendment No. 2 to our contract
to provide additional services as follows. Provide a bid alternative to overlay Flour Bluff Drive from
Don Patricio Road to Yorktown Blvd. and provide street widening at the Purdue Raad and
Glenoak Boulevard intersections to add left turn lanes. Plans will include some pavement
rehabilitation in specific areas identified by Engineer. Also included will be restriping and traffic
control as required. Additional topographic survey information will be required to identify right of
way and other elements that could impact street widening.
Also attached is a revised design services spreadsheet far combined services- detailing
fee changes. We are available to meet and discuss these proposals at your convenience. Please
call if you have any questions or need additional information.

In addition to previously requested Contract Amendment No. 2 we will require additional
design time per attached revised Proposed Project Schedule.
The reasons for this schedule extension are as follows:
1. Original Phase I hydraulic design assumed a shared outfall with proposed Wal-Mart. Wal-
Mart subsequently has indicated they no longer desire a shared outfall and as a result we
have revised the outfall location to better serve the City and land owner. We will need to
revise hydraulic modeling and plan and profiles sheets in the plans. We also need to
acquire topographic information of the proposed route to accurately estimate excavation
volumes and perform design.
2. Contract Amendment No. 2 also requires additional topographic survey work at two
locations where the City has requested the addition of left turn lanes to the Flour Bluff
Drive section. Street widening will require design of alignment and traffic control planning
among other items.
The revised Proposed Project Schedule reflects the total requested schedule extension to
date. All cost associated with above design changes have been accounted for in contract
amendment No.'s 1 & 2. We do not believe the additional work items will affect the construction
schedule. Please call if you have any questions or need additional information.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Finn." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
3udges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a f nn, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
