HomeMy WebLinkAboutC2010-424 - 10/11/2010 - NARATIFICATION AND AMENDMENT No. 6 CONTRACT FOR PROFESSIONAL SERVICES The City of Corpus Christi, a Texas home rule municipal corporation, P.O. Box 9277, Corpus Christi, Nueces County, Texas 78469-9277 (City) acting through its duly authorized City Manager, or Designee (Director of Engineering Services), and Gignac Associates LLP, 416 Starr Street, Corpus Christi, Texas 7$401, {ArchitectlEngineer - AIE}, hereby agree to the following amendment to the Contract for Architectural I Engineering Services for the Bayfront Park Phase 1 as authorized by Motion No. 2005-264, passed August, 23, 2005, and Motion No. 2006-038, passed February 21, 2006 and administratively passed July 27, 2006 and as authorized by Motion 2007-082, passed March 27, 2007 and administratively approved June 14, 2010: Section 6.5 Additional Services, Construction Observation and Management is amended to add authorize two additional months of services. The AIE is authorized by Amendment No. 4 to proceed with additional Construction Phase services through September 14, 2010. The Consultant will complete Basic Phase and Additional Services as authorized by this Amendment and the Tasks listed in the Original Contract and Amendments. Exhibit A-6, Section C. Summary of Fees is amended by the addition of fees for Additional Services as authorized by this Amendment. All other terms and conditions of the August 23, 2005 contract, as amended, between the City and Consultant will remain in full force and effect. A member of any board, commission, or committee appointed by the City Council of the City of Corpus Christi, Texas. b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to have an effect on that interest that is distinguishable from its effect on members of the public in general or a substantial segment thereof. c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-time basis, but not as an independent contractor. d. "Finn." Any entity operated for economic gain, whether professional, industrial or commercial, and whether established to produce or deal with a product or service, including but not limited to, entities operated in the form of sole proprietarship, as self-employed person, partnership, corporation, joint stock company, joint venture, receivership or trust, and entities which for purposes of taxation are treated as non-profit organizations. e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager, Assistant City Managers, Department and Division Heads, and Municipal Court Judges of the City of Corpus Christi, Texas. f. Any person or firm, such as engineers and architects, hired by the City of Corpus Christi for the purpose of professional consultation and recommendation.
