Line, Proj # 7426, Parcel 1 UTILITY EASEMENT THE STATE OF TEXAS COUNTY OF NUECES KNOW ALL BY THESE PRESENTS: THAT, the GRACE PRESBYTERIAN CHURCH OF CORPUS CHRISTI, TEXAS, a Texas Non-Profit Corporation, by and through its duly authorized Board of Trustees, herein called "GRANTOR" of 6301 Yorktown, Corpus Christi, Nueces County, Texas 7$414 in consideration of TEN DOLLARS ($10.00) and other good and valuable consideration, paid by the City of Corpus Christi, herein called "GRANTEE", of 1201 Leopard Street, Corpus Christi, Nueces County, Texas 78469-9266, the receipt of which is hereby acknowledged, has granted, sold and conveyed and does hereby grant, sell and convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representaiives, the free and uninterrupted use, liberty, pxivilege, and easement of going in, an, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description attached and incorporated as Exhibit A. ("Premises"} Map showing the location of the Utility Easement TOGETHER .WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as Exhibit B. ("Premises") The Temporary Construction Easement is further described as a 5' wide and adjacent to the permanent Utility Easement. Said Temporary Construction Easement is to be used for working space during construction. This Temporary Construction Easement automatically terminates upon: i) 45 days from the start of construction on the premises, or ii) one year from the recording date of this instrument, whichever occurs first. SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land within the easement area to the same or better condition as existed prior to construction. The City agrees to backfill and grade the trenched area. Any damage to existing water sprinkler lines will be repaired at Grantee's expense. All construction is to be done in a workmanlike manner which is deemed appropriate by professional industrial standards far the type of work being accomplished. Together with the free ingress, egress and regress, to and for the City of Corpus Christi, Texas, and its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility lines under, an and along said Premises. 2010-430 10/13/10 Grace Presbyterian Church of CC ~~~~~ TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City of Cozpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT and right-of--way far so long as used far such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges cease.
