AMENDMENT NO. 'I
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and LNV ENGINEERING hereinafter called
"Engineer", agree to the #ollowing amendments to the Contract for Engineering Services for Resaca Lift
Station Ups~rade (Project No. 7447}, as authorized and administratively amended by:

EXHIBIT "A", SECTION 1. SCOPE OF SERVICES, PART A. BASIC SERVICES, ITEM NO. 2 DESIGN
PHASE shall be modified to include the following:
• Design a -ton capacity Monorail System that consists of foundation improvements, steel beam
and frame, trolley, electric hoist, and associated electrical fee improvements, to be used in
removing pumps, motors, piping; and other equipment from the interior of the lift station. The
design will be in accordance with the site-specific geotechnical report and will comply with the
Texas department of Insurance (TDI} Windstorm Requirements and the International Building
Code 2006 (IBC 2006). r
• PerFarm the structural steel design of the beam and frame system rated for a.~8'--ton capacity
in accordance with the IBC 2006, ASCE 7-05 "Minimum Design Loads far Buildings or Other
Structures", and AISC Steel Design Guide 7 "Roofs to Anchor Rods."
• Foundation improvements will include the design of a spread footing or auger cast-in-place
pile foundation in accordance with the New Broadway Wastewater Treatment Plant
geotechnical report by Rock Engineering and Testing Laboratory, Inc. and IBC 2006.
• The new monorail foundation and structural frame system will be designed for 120-mph 3-
second gust wind velocity in accordance with the IBC 2006 in order to comply with the
windstorm requirements as required by the TDI. The windstorm compliance requirements
will be in accordance with "Inland" I-type construction which is designated for the first tier
counties along the coastal waters.
• Provide specifications, additional plan and detail drawings of the proposed Monorail System
including layouts and installation guidelines.
• Design the necessary electrical improvements associated with the electric hoist system.

CONSTRUCTION PHASE shall be modified to include the following:
All pertinent Construction Phase Services listed in the Original Contract will now, by this
Amendment, include the Monorail System components. These components include: steel frame,
trolley, electric hoist, and associated electrical feed improvements.

CONSTRUCTION OBSERVATION SERVICES shall be modified to include the following:
• All pertinent Construction Observation Services listed in the Original Contract will now, toy this
Amendment, include the construction and installation of the Monorail System. These
components include: steel frame, trolley, electric hoist, and associated electrical fieed
improvements.

DEFINITIONS
a. "Board member." A member of any board, commission, or committee ap}~ointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect an that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self-employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non-profit organizations.
"Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or Erin, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
