SECOND AMENDMENT TO USE AGREEMENT WITH SOUTH TEXAS BOTANICAL
GARDENS & NATURE CENTER
THIS Amendment to the Use Agreement is made and entered into this Lq— of
2011, by the CITY OF CORPUS CHRISTI, and South Texas Botanical
Gaikens & NatAre Center (formerly ; Corpus Christi Botanical Society);."
Whereas, the parties previously entered into Use Agreement approved by City Council on March
17, 1992 under Ordinance No. 021348 which authorized Use Agreement for use of 180.85 acres
of park land adjacent to Oso Creek as a Botanical Garden, for sixty year term;
Whereas, in Ordinance No. 028366, effective October 20, 2009, the parties entered into an
Amendment to the Use Agreement, to allow use of additional property, to include additional
surface estate of 1.41 Acres, 61,537.10 square foot portion of land, which had been abandoned
and vacated as described Ordinance No. 027968;
Whereas, Ordinance 027968 was amended in Ordinance No. 028627, to correct the description
of the abandoned and vacated right of way to a 61,038 square foot portion;
Whereas, the Use Agreement must be amended to correctly identify the areas of use;
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1) Section 1 of the Amendment to Use Agreement between the parties, dated on October 20,
2009, is hereby corrected to accurately reflect the additional area of use to be a 61,03 8.00
square foot portion of the undeveloped and unsurfaced South Oso Parkway dedicated
public right of way, out of a portion of the Botanical Gardens Park Unit 4, Volume 53,
Pages 139 -140, Map Records of Nueces County, Texas, also being out of the Laureles
Farm Tracts, Section 31, Volume 3, Page 15, Map Records of Nueces County, Texas, and
as identified on the attached and incorporated Exhibit A.
2) All other terms and conditions of the previously executed Use Agreement, as amended,
which are not inconsistent herewith shall continue in full force and effect.
IN WITNESS WHEREOF, the parties hereto have themselves or through their duly authorized
officers executed this Agreement, to be effective sixty -one days after final approval by City
Council.
