TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY ", and LNV ENGINEERING hereinafter called
"CONSULTANT," agree to the following amendment to the Contract for Professional Services for Oso
Infiltrationlinflow Related Collection System Enhancement Program and Programmed Wastewater
Line Lifec cle Replacement Project No. 74101 as authorized and amended by:

In Amendment No. 1, Exhibit "A", ADDITIONAL SERVICES, shall be amended to include the following
additional task (as shown in the attached Amendment No. 3. Exhibit "XI
Task No. 2. Construction Observation Services - To prepare and issue additional Delivery Order
documents. The additional services include the preparation of additional site exhibits and
detailed estimates of probable construction costs, additional site visits by the Engineer to
investigate system failures and develop recommended improvements, the provision of additional
needed information to aid in the City's review and decision making process, and observation of
the construction execution.
■ In Amendment No. 1, Exhibit "A ", FEES shall be amended as shown on the attached Amendment No. 3.
Exhibit "A" for a fee not to exceed $26.530.00 (Twenty Six Thousand Five Hundred Thirty Dollars and
Zero Cents), for a total restated fee not to exceed $345,530.00 (Three Hundred Forty Five Thousand
Five Hundred Thirty Dollars and Zero Cents).
All other terms and conditions of the June 2, 2008 contract and amendments between th City and Consultant
will remain in full force and effect.

Dear Mr. Anaya,
Please allow this letter to serve as our formal request to amend our Contract to include additional services for
preparing and issuing additional Delivery Order documents for the above referenced project, as detailed in the
attached Amendment No. 3.
The additional services that are included within the amendment are: the preparation of additional site exhibits
& detailed estimates of probable construction costs, additional site visits by the Engineer to investigate system
failures and develop recommended improvements, the provision of additional needed information to aid in
the City's review and decision making process, and observation of the construction execution.
The fee for Amendment No. 3 is $26,530.

Project Description and Task List:
The additional services that are included within the amendment are the preparation of additional
Delivery Order Documents.
The original contract and shall be modified to include the following paragraphs:
ADDITIONAL SERVICES
2. Construction Administrative Services.
a. Issue Delivery Orders (approximately 6 total) on an as needed basis for the Engineering
Department. In each case, the Engineer will visit the site, meet with the City to discuss known
issues and potential solutions, review utility base maps, prepare delivery order exhibits, short
narrative, and provide an estimate of anticipated construction quantities.
b. Additional Delivery Order Documents:
Prepare & Issue additional Delivery Order Documents. This work includes additional site exhibits
& detailed estimates of probable construction costs, additional site visits by the Engineer to
investigate system failures and to develop recommended improvements, the provision of
additional needed information to aid in the City's review and decision making process, additional
review meetings & submittals, observation of the construction execution, and coordination with
Contractor & City Personnel (Construction Services & Wastewater Department).

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self - employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non - profit organizations.
