HomeMy WebLinkAboutC2011-170 - 5/16/2011 - NAAMENDMENT NO. 2 TO CONTRACT FOR PROFESSIONAL SERVICES The City of Corpus Christi, Texas hereinafter called "CITY ", and LNV ENGINEERING hereinafter called "CONSULTANT," agree to the following amendment to the Contract for Professional Services for Naval Air Station Corpus Christi NASCC Effluent Reuse Lift Station & Force Main Project No. 7407) as authorized and amended by: ■ In Amendment No. 1, EXHIBIT "A" ADDITIONAL SERVICES, shall be amended to include: 9. Allowance for Coordination Meetings with U.S. Navy to determine the force main tie -in point, lift station controls strategy, schedule for pump shutdowns, schedule for lift station testing, and other design criteria, as shown in the attached Amendment No. 2, Exhibit "A." ■ In Amendment No. 1, EXHIBIT "A ", FEES shall be amended as shown on the attached Amendment No. 2 E xhibit "A" for a revised fee not to exceed $14,560.00 (Fourteen Thousand Five Hundred Sixty Dollars and Zero Cents) for a total restated fee not to exceed $153,144.00 One Hundred Fi -Three Thousand One Hundred Fogy-Four Dollars and Zero Cents) All other terms and conditions of the April 29, 2008 contract and amendments between the City and Consultant will remain in full force and effect. Box 9277 Corpus Christi, TX 78469 -9277 Re: Amendment to Professional Services Contract BIAS Corpus Christi Effluent Reuse Lift Station & Force Main (City Project Flo. 7407) Amendment fro. 2 Dear Mr. Anaya: In response to the City's request, we are proposing the. following contract amendment for the NAS Corpus Christi Effluent Reuse Lift Station & force Main. Project Background: LNV, Inc began preliminary evaluation services under a small A/E contract in April 2008, by developing and submitting a Feasibility Study and Cost Estimate Engineering Letter Report for Naval Air Station Carpus Christi Roadway & Irrigation Improvements, at the request of the City. This study analyzed factors and casts related to: 1) conveying effluent from the Laguna Madre Wastewater Treatment Plant (LMWWTP) to Naval Air Station Corpus Christi (NASCC) & 2) storing and pumping the effluent into an irrigation system on NASCC. The contract was amended in February 2009 (Council Motion No. M2009 -048) and included basic services for design /bid /construction phases. Additional services for right -of -way acquisition survey and topographic survey were also authorized. An Engineering Letter Report was delivered in August 2'00.9. The goal of this report was to investigate alternatives and to provide recornmcindations for transferring Type II effluent from the LMWW TP to NASCC for the purpose of irrigating the NASCC golf course. Plans, Specifications, and Contract Documents were then prepared for bidding and subsequently a Construction Contract was awarded to J.J. Fox Construction Company, Inc. of Portland, Texas. The award was in the amount of $634,036.60 and Notice to Proceed was issued for the Contractor to begin construction on October 23, 2009 and construction is anticipated to be completed by May 2011. The United States Navy has recently awarded a designlbuild contract to complete the portion of the Work located on their property, which consists of a 12 -inch force main, lined effluent lake, pump station, and the installation of a city - provided radio transmitting AMID. As requested, this proposal involves all tasks associated with coordinating the City's project with the U. S. Navy's project, including but not necessarily limited to force main tie -in, force main hydraulics, pump controls, and operations. Scope of Services: The Scope of Services for this contract amendment is as follows: Basic Services 4. Provide extended Construction Phase Services to include the review field & laboratory tests, regular visits to the project site, review of the data and installations to assure compliance with the plans, specifications, and contract documents, review and prepare monthly construction pay estimates. The project duration will extend beyond the anticipated 270 days (9- months) to approximately 584 days (19.5 - months) and will require approximately 15 additional site visits, reviews, and inspections, beyond the scope of the original contract. The above services have been or will be performed, through to final acceptance. Additional Services 9. Provide Additional Services to include coordination meetings with the U. S. Navy, as indicated and authorized. In order to accomplish this task, the City plans to engage the Engineer to chair coordination meetings. Since the actual amount of coordination time required cannot be determined in advance, an allowance in the amount of 64 hours will be established for this purpose. The Engineer will coordinate, assist the City/U.S. Navy in chairing, attending and participate in coordination conferences, coordinate with the City/U.S. Navy to review and make recommendations and prepare documents regarding proposed field alterations, inspection, and other authorized services. The City will pay the Engineer from the established allowance, not to exceed 64 hours. Breakdown of Services: The small A/E Amendment No. 1 shall be modified to include the followings: • Basic Services (AUTHORIZED) 4. Construction Phase C. Fee for Basic Services Authorized. The City will pay the Engineer a fixed fee for providing all "Basic Services" authorized as per the table below. The fees for Basic Services will not exceed $4,000.00, as per the table below, and will be full and total compensation for all services outlined in Amendment No. 1, Section 1.A.4, and in Amendment No. 2, above, and for all expenses incurred In performing these services. For services provided in accordance with Amendment No. 2, Engineer will submit monthly statements for services rendered. City will make prompt monthly payments in response to Engineer's monthly statements. B. Fee for Additional Services Authorized. The City will pay the Engineer a lump sum fee, under this allowance, not to exceed $10,560.00, as per the table below, and will be full and total compensation for provided services specified in this contract, and authorized by the Director of Engineering.
