KNOW ALL BY THESE PRESENTS:
THAT SOUTH TEXAS ELECTRIC COOPERATIVE, INC., a Texas nonprofit corporation,
( "GRANTOR ") of 2849 F.M. 447, Nursery, Victoria County, Texas 77976, in consideration of ONE
DOLLAR ($1.00) paid by the CITY OF CORPUS CHRISTI, TEXAS, a Texas home -rule
municipal corporation ( "GRANTEE "), of 1201 Leopard Street, Corpus Christi, Nueces County,
Texas 78401, the receipt of which is hereby acknowledged, has granted, sold and conveyed, and does
hereby grant, sell and convey to Grantee, its successors and legal representatives, the free and
uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain
tract of land situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and
incorporated as "Exhibit A" and a map showing the location of the
RIGHT -OF -WAY EASEMENT attached and incorporated as "Exhibit
B" (the `Premises ").
Together with the free ingress, egress and regress to and for Grantee, and its franchisees, to construct,
operate, repair and maintain streets, sidewalks, curbs, gutters and appurtenances upon the Premises
for the public use by foot, with automobiles, carts, carriages and all other vehicles and all other
means of transportation necessary or convenient at all times and in all seasons in, along and upon the
Premises, as well as to lay, operate, inspect, replace, repair, service and maintain public utility lines,
storm sewers, and franchised utility lines in, on, over, under and along the Premises.
SPECIAL PROVISIONS:
1) Grantee agrees to replace Grantor's two existing driveways with two concrete
commercial driveways within the new right of way easement. The replacement
driveways will be constructed to the same widths, 50' and 30' as presently in use. New
drainage culverts will be constructed to current construction standards for commercial
driveway specifications.
2) Grantor will have access to the property at all times during construction.
3) Grantee agrees to repair any damage to the Premises caused by Grantee.
4) Grantee agrees to restore the land within the Premises to the same or better condition
as existed prior to construction hereunder. All construction is to be done in a prudent
and workmanlike manner.
TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to Grantee, its
successors, legal representatives, franchisees and the public, for the proper use as public streets and

- 1g as used for such purposes, and if the use for said easements and rights of 05/27/11 en the aforesaid rights and privileges cease.

0.3751 acres (16 sq. ft.) of land out of Farm Lot 8, Section 2, of the NUECES
RIVER IRRIGATION PARK Subdivision as recorded in Volume A, Page 54 of the Map
Records of Nueces County, Texas, also being a portion of that certain, called 4.408 acre
tract as described in Volume 1297, Page 498 of the Deed Records of Nueces County,
Texas, and being more fully described by metes and bounds as follows;
BEGINNING at a point at the intersection of the platted right-of-way of County Road 69
and County Road 52, for the southeast corner of this tract, from which the southeast
corner of said Farm Lot 8 bears S 09 °16'00" W - 15.04 feet and S 84 11 53'00" E — 20.05
feet.
THENCE: N 84 °53'00" W — 40.11 feet, with the north right -of -way line of said County
Road 52 (unopened), to a 5/8 inch iron rod with plastic cap set for the southwest corner of
this tract.
THENCE: N 09 ° 16'00" E — 408.49 feet to a 518 inch iron rod with plastic cap set in the
north line of said 4.408 acre tract for the northwest corner of this tract.
THENCE: S 84 0 53'00" E — 40.11 feet, with the north line of said 4.408 acre tract, to a
point in the west right-of-way of said County Road 69, for the northeast corner of this
tract.
THENCE: S 09 °16'00" W — 408.49 feet, with the west .right- of-way of said County Road
69, to the PLACE OF BEGINNING and containing 0.3751 acres (16,340 sq. ft.) of land.
