HomeMy WebLinkAboutC2011-246 - 6/28/2011 - NADEED COVENANT TO BIND PROPERTY FOR PERIOD OF AFFORDABILITY STATE OF TEXAS COUNTY OF NUECES KNOW ALL BY THESE PRESENTS: Pursuant to an agreement entered into between the Corpus Christi Community Improvement Corporation ( "CCCIC ") and the Nueces County Community Action Agency ( "NCCAA "), executed in June, 2011, which agreement is incorporated in this instrument by reference ( "Agreement "), NCCAA accepted federal funds, in conjunction with the United States Department of Housing and Urban Development's Home Investment Partnership Program ( "HOME Program ") administered by the CCCIC, for the acquisition and rehabilitation of a four -unit residential building on the following property: Lot 38, Block 10, Carolyn Heights Unit 7, a subdivision in the City of Corpus Christi, Nueces County, Texas, as shown by the map or plat of record found in the official Map Records of Nueces County, Texas, and commonly known by its street address of 3609 Crestbrook Court, located in Corpus Christi, Nueces County, Texas (hereinafter referred to as the "Property "). Pursuant to the terms, conditions, and covenants contained within the Agreement, NCCAA, in consideration of receiving the construction funding, agrees to bind the Property with the affordability requirements specified in Title 24, Part 92.252, of the United States Code of Federal Regulations, for a period of not less than 15 years from the date of completion of the rehabilitation, such date of completion presently unknown but anticipated to be not later than January 31, 2012.
