TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY ", and MAVERICK ENGINEERING INC. hereinafter
called "CONSULTANT," agree to the following amendment to the Contract for Professional Services for North
Port Avenue from IH 37 to US 181 Project No. 6264 as authorized and amended by:

■ In the original contract, Section I. SCOPE OF SERVICES, Part A. Basic Services, 4. Construction

■ In the original contract, Section L SCOPE OF SERVICES, Part B. Additional Services, S. Construction
Observation Services shall be amended to include additional services as shown in the attached
Amendment No. 4, Exhibit "A."
■ In the original contract, Section III. FEES shall be modified as shown on the attached Exhibit "A -1" for a
revised fee not to exceed $24,765.00 (Twenty Four Thousand Seven Hundred Six Five Dollars and
Zero Cents) for a total restated fee not to exceed $2,820,017.26 Two Million Eight Hundred Twent
Thousand Seventeen Dollars and Twenty Six Cents)
All other terms and conditions of the original contract and amendments between the City and Consultant will
remain in full force and effect.

Dear Ms. Pyle:
Maverick Engineering, Inc. is pleased to submit our fee proposal for providing additional services for the
North Port Avenue Project (Project No. 6264). The additional scope of services and corresponding fees
are shown below:
Scope of Services:
1. On -site Construction Observation Services:
a. Full time daily inspection including daily construction progress reports and monthly
progress reports
b. Traffic Control Plan monitoring
c. Storm Water Pollution Prevention Plan monitoring
d. Measurements of quantities as. required
e. Oversee and review results of materials testing
f. Verification of contractor personnel pay rates and qualifications such as certified
flaggers, etc.
g. Conflict resolution during construction
h. Liaison and communication between city, contractor, adjacent property owners,
utilities, etc.
2. Construction Administration Services:
a. Review of contract submittals
b. Review of Requests for Information (RFI's)
c. Review Change Order Requests and prepare Change Orders for approval by the City
d. Review and make recommendations for payment of contractor's monthly progress
payment requisitions
e. Quantity verifications and calculations

Our fee is as follows:
Task 1— $ 12,240.00
Task 2 — $ 12,525.00
The Total Proposed Fee for Amendment No. 4 is: S24,765.00
It is anticipated that the construction phase of the project will continue until October, 2011. This
estimate is to cover construction observation and construction administration services from July,
2011 to October, 2011. Should the construction phase continue beyond (October,.2011 another
amendment will be submitted to the City to cover: the expected level of effort needed. to complete the job.

DEFINITIONS
a. `Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
C. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis, but not as an independent contractor.
d. "Finn." Any entity operated for economic gain, whether professional, industrial or commercial, and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation, joint
stock company, joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non -profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager,
Assistant City Managers, Department and Division Heads, and Municipal Court Judges of the City of
Corpus Christi, Texas.
f: "Ownership interest." Legal or equitable interest, whether actually or constructively held, in a
firm, including when such interest is held through an agent, trust, estate, or holding entity.
"Constructively held" refers to holdings or control established through voting trusts, proxies, or
special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of Corpus
Christi for the purpose of professional consultation and recommendation.
