In the original contract, Section III. FEES shall be modified as shown on the attached Exhibit "B" for a
revised fee not to exceed $9,400.00 (Nine Thousand Four Hundred Dollars and Zero Cents) for a total
restated fee not to exceed $192,500-00 One Hundred Ninety-Two Thousand Five Hundred Dollars
and Zero Cents)
All other terms and conditions of the original contract and amendments between the City and Consultant will
remain in full force and effect.

nourishment on North Padre. Island along; the seawall, Having- already assisted the City during
fthe regulatary and design phases of tbi.s project, we feel well qualified. to help.
As ive undmuind the proiect, the City is planning on. advertising the dredging and beach
nourishn cnt for construction bids in early June 2011. :bending successful receipt of a Section.
10/404 permit froni the U.S. Army Corps of Engineers, project construction is targeted to
commence in the fall of 2011 and be.coniplete prior to Spring Break (early March) 2012. To
assist the City with tlxe bidding, construction administration, and construction observation phases
of this project, we propose to provide the following Scope of $ervices:

To support the City during the construction bidding phase, HDR will:
a. Participate in. the pre- bid conference and provide a recommended agenda to the Cit for
key construction activities and elements of the project.
b. Assist the City in solicitation of bids by identification of prospective bidder's.
c. Review pre -bid questions aid submissions from prospective bidders concerning the bid
documents and prepare, in the Ci.ty's forn�afi, for the City's Engineering S"er�rices'
approval, any addenda or Other revisions necessary to inform .contractors of approved:
changes prior to bidding.

d. Attend bid opening, analyze bids, prepare bid. tabulation, and. make raeonimendation to
City concerning award of the contract.
The City staff will:
a. Arrange and pay for printing of all . documents and addenda to be distributed to
prospective bidders.
b. Advertise the Project for bidding, mabltai.n the list of prospective bidder's, receive and
documents, deposits for all bid docuents, issue (with the assistance of HDR) any addenda,
prepare and sapply bid tabulation forms, and conduct bid opening.
c. Deceive HDR's recommendations concerning bid evaluation and ativard, -and prepare
agenda materials for the City Council concerning bill awards.
d. Prepare.-review, and provide copies of the contract for execution between the City and
the contractor.

e. Prepare change orders as authorized by the City (coordinate with the City's
Construction, Division).

g. Review construction "red drawings prepare record drawings of tlae Project as
constructed (from the "red - line" drawings, inspection, and the contractor provided
plans) and deliver to the i n-gineering Services a reproducible set and electronic file
(AutoCAD r.14 or later) of the .record drawings. All drawings will be CADD drawn
using Awg format in AutoCAD, and graphics data will be in .dxf format, with each
layer being provided in a separate file.. Attribute data will. be provided in ASCII formal
in tabular form.

activities for the construction phase.

d. Contract directly with a third party as needed .for any independent quality assurance
surveying or other verification of Contractor's acceptance surveys,
3. Construction Observation
HDR will endeavor to provide protection for the City against defects and deficiencies in. the
Work by performing periodic site observation.. HDR's services will be as follows:
a. General: Endeavor to protect the City in providing construction observation services;
however, it is understood that HDR. does not guarantee the C.ontl•actor's perform. ance,
nor is 1IDR responsible for supervision of the Contractor's operations and employees.
IIDR will not be responsible for the means, inethods, techniques, sequences or
procedures of construction selected by the Contractor, or any safety precautions and
programs relating in any way to the condition of the premises the work of the
Contractor or any subcontractor. IIDR will not be respo.nsiblr for the acts or oraissions
of any person (except its .own. employees or agents) at the Project site or othle'Twisc
performing a>'iy of�the work of the. Project.
b. Conference and. Meetings: Attend meetings with Conti actor, such as pie - construction
conferences, progress meetings, jab conferences. and other Project - related meetings as
required by the City, and prepare and. circulate copies of minutes thereof..
c. Liaison: Serve a-,, liaison with Contractor, working principally tli ough Contractor's
superintendent .and assist ift under, tanding:the intent of the Contract Documents,
d. interpretation of Contract Documents: Issue to Contractor clarifications and
interpretations as needed.
c. Process shop "Drmvings and Samples
i. Receive Samples furnished at the site by Contractor.
i.'i, Record date of receipt of Samples and approved Shop Drawings.
iii. Advise Contractor of the commencement of any portion of the Wol:k requiring a
Shop Drawing or Sample submittal for which HDR believes that the submittal has
not been: approved,
f. Review of Work alrad Rejection of 'Defective Work:
i. Conduct periodic (approximately two to four times per-naojaffi) on -site observations
of Contractor's work -in- progress and determine if such Work is in general
accordance with the Contract Documents. Site visits will be scheduled to occur
more frequently when key aspects of work are underway (for example, when active .
dredging and beach nourishment are occurring) and less frequently when little or no
wolf. has occurred.
ii. -Report whenever IIDR believes that any part of Contractor's work in progress will
not produce a completed Project that cornfo.rms to the Contract Documents or will
prejudice the integrity of the design concept of the connxpleted Project, or .has been
damaged, or does not meet the requirements of any inspection, test or approval
required to L"ae made;. and advise City of that pail of work in progress that .HDR
balievt_�s should be corrected or rejected or should be uncovered for observation, or

Laws and Regulations, including but not limited to those to be performed by public

Format, recording Contractor's presence on the site, weather conditions, data
relative to Questions of Change Ordei,s, Field Orders, Work Change Directives, or
changcd conditio17s, site visitors, daily activities, decisions, observations in general,
and specific observations in nipre detail as in the case of observing test procedures,
and send copy to die City.
iii. Construction observation reports will. include photographic documentation as
required to document progress of the Work and of Corrtractor's cornphance with the,
progress schedule and schedule of Shop Drawing and Sample sLi inittals,
.iv. Repott hunediately to the City the occurrence of any known site accidents, any
Hazardous. 1- 1n.vironniental Conditions, emergencies, or acts of God endangering the
Work. and property damaged by fire or other causes.
h. Completion:
i, Before 'the issue of Certificate of Completion, submit to Contractor a list of
observed items reclrlir.i.ng completion. or correction,
ii. participate in a final inspection: in the company of the City and Contractor and
Prepare a. final list of items to be completed. or corrected.
iii. Observe whether all items on final list have been completed or corrected and make
recommendations concerning acceptance and issuance of the Notice of
Acceptability of the Work.

project. We propose to provide the Scope of Services described above on. a lunap sum basis in

DEFINITIONS
a. "Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self - employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non - profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
