AMENDMENT NO.4
CONTRACT FOR PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "City ", and LNV. Engineering hereinafter called
"Engineer ", agree to the following amendments to the Contract for Engineering Services for Staples Street
(BOND ISSUE 2008_) Phase 1 from Brawner to Barracuda (Project No. 6468,) Phase 2 from Barracuda to
Gollihar (Project No. 64691 as authorized and administratively amended by:

Staples Street (BOND ISSUE 2008) Phase 2 from Barracuda to Gollihar (Project No. 6469) is amended as
follows:
BASIC SERVICES
2. Design Phase. The A/E will perform all of the Design Phase tasks, listed and described under the
"Scope of Services" in the original Contract for Professional Services signed on May 18, 2010, in an
expedited manner. This new expedited schedule will accelerate the completion of the original Design
Phase services by one month.
ADDITIONAL SERVICES
8. Subsurface Utility Investiciation. The A/E will perform all of the Subsurface Utility Investigation tasks,
listed and described under the "Scope of Services" in the original Contract for Professional Services
signed on May 18, 2010, in an expedited manner. This new expedited schedule will accelerate the
completion of the original Subsurface Utility Investigation services by one month.
9. Franchise Utili Coordination. The A/E will perform all of the Franchise Utility Coordination tasks,
listed and described under the "Scope of Services" in the original Contract for Professional Services
signed on May 18, 2010, in an expedited manner. This new expedited schedule will accelerate the
completion of the original Franchise Utility Coordination services by one month.
TIME OF PERFORMANCE
All work in this Amendment No. 4 will be completed one (1) month earlier than the original contract time stated
in the "Schedule" of the original Contract for Professional Services signed on May 18, 2010.
FEES
Summary of Fees is amended as specified in Exhibit "D" Summary of Fees.
All other terms and conditions of the May 18, 2010 contract between the City and Engineer, and of any
amendments to that contract which are not specifically addressed herein shall remain in full force and effect.

Please allow this letter to serve as our formal request to amend our Contract's Basic and Additional Services as
detailed in the attachments for the above referenced project. The fee for services associated with this
amendment is $25,176.00 for a total revised contract amount of $2,025,049.00.
This amendment consists of an expedited schedule to complete some of the basic and additional services
included in our original contract. The amended services include overtime pay rates, due to the expedited project
schedule for the Staples Street Project from Barracuda to Gollihar.

a. `Board member." A member of any board, commission, or committee appointed by the
City Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to
have an effect on that interest that is distinguishable from its effect on members of the public
in general or a substantial segment thereof.
c. "Employee." Any person employed by the City of Corpus Christi, Texas either on a full or
part-time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or
commercial, and whether established to produce or deal with a product or service, including
but not limited to, entities operated in the form of sole proprietorship, as self - employed
person, partnership, corporation, joint stock company, joint venture, receivership or trust, and
entities which for purposes of taxation are treated as non - profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City
Manager, Assistant City Managers, Department and Division Heads, and Municipal Court
Judges of the City of Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held,
in a firm, including when such interest is held through an agent, trust, estate, or holding
entity. "Constructively held" refers to holdings or control established through voting trusts,
proxies, or special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of
Corpus Christi for the purpose of professional consultation and recommendation.
