E10168) Dear Mr. Anaya, Thank you for the . opportunity to submit 'this request ,.for . Amendment No. 4 to ' provide ' construction administration and construction observation services. for the City's planned maintenance dredging at Packery Channel. The dredged sand will be. placed as beach nourishment on North Padre Island along,the seawall. Having already assisted the City - during the regulatory, design, and bidding phases- of this project, we feel well, qualified to help. i As we understand the project, the City is planning on issuing a Notice to 'Proceed to the j construction contractor by mid •October 2011. The construction contract time is 120 days 'for the . Base Bid work plus an additional 15 days for Additive Alternate No. 1. To prevent interference with Spring Break, it is very important to the City for construction to be completed by'Marcli 2. To assist the City with the construction administration and observation phase of this •project, we propose to provide the Scope of Services described below. We recommend the level of effort described in this scope based on successful construction -phase services HDR has provided to other clients on similar dredging and beach nourishment projects. SCOPE OF SERVICES HDR's services will consist of the following: - 1. ' Construction Administration a.. Participate in pre - construction conference and provide a recommended agenda for key construction-activities and elements of the. Project. b'. Review .shop and worldrig drawings, materials, acceptance .'surveys, and other submittals for general conformance with contract documents. Provide interpretations - and clarifications of the contract documents 'for the contractor and authorize required changes which do not affect the contractor's price and are not contrary to the general interest of the City under the contract. & Perform day -to. -day project management. As we have discussed considering the nature of construction required on .this project, we propose to perform' periodic construction observation rather than having a full -time onsite inspector (described in more' detail under "Construction Observation" below). To supplement the periodic construction observation, HDR will maintain communication with the Contractor and City on an approximate .daily basis (frequency and extent of communication may vary depending on the nature and progress of construction activities), This will help HDR and the City remain current on the.progress of work, and allow HDR to schedule site visits when key work is being performed. Daily 'communications wit be be through telephone and email. e. Review Contractor's monthly .payment applications. Provide recommendations to City for payments to Contractor. f, Prepare change orders as authorized by the City (coordinate with the City's Construction Division). g. Make final inspection with City ',staff acid provide the City with a Certificate of Completion for the Project. h. Review construction "red -'line" drawings, prepare record. drawings of the Project as constructed (from the "red - line drawings, inspection, and the contractor provided plans) and deliver to the Engineering Services a reproducible set. As we discussed previously, project specifications for this project require Contractor to provide detailed surveys of the completed work that will be signed /sealed by an RPLS. Therefore, - irather than develop a comprehensive set of stand -alone record drawings in Autocad, record drawing package will consist of an assembly of hand - marked set of. engineering plans plus .appendices consisting of compilation of Contractor's acceptance surveys, DVD containing AutoCAD files will be included for Contractor's surveys.. The City staff will: a. Designate an individual to have responsibility, authority, and control for coordinating activities far the construction phase. b. Conduct the final acceptance inspection with HDR. c... Contract directly with a third parry as needed for any independent quality assurance surveying or other verification of Contractor's acceptance surveys. 2: Construction Observation HDR will endeavor to:provide protection for the'City against defects and deficiencies in the Work by performing periodic site observation. HDR' § services will be as follows: a, General: Endeavor to protect the City in providing construction observation services; however, it is understood that HDR does not guarantee the Contractor's performance, nor is HDR responsible for supervision of the Contractor's operations and employees. HDR will not be responsible for-the.acts or omissions of any person (except its own employees or agents) at, the Project site or. otherwise performing any of the work of the Project. b. Conference and Meetings: Attend meetings with Contractor, such as pre - construction conferences, progress meetings, job conferences and other Project-related meetings as required by the City, and prepare and circulate copies of minutes thereof. c. Liaison: Serve as liaison with Contractor, working principally through Contractor's superintendent, and assist in understanding the. intent of the Contract Documents. d. Interpretation of Contract Documents: Issue to Contractor. clarifications and interpretations as needed. e. Process shop Drawings and Samples: i. Receive Samples furnished at the site by Contractor. ii. Record date of receipt of Samples and approved Shop Drawings. iii. Advise Contractor. of the .commencement of any portion of -the Work requiring a Shop Drawing or Sample submittal -for which HDR believes that the submittal has not been approved. f. Review of Work and Rejection -of Defective Work: i. Conduct periodic (approximately three times per month) on -site observations of Contractor's work -in- progress and determine if such Work is in general accordance with the Contract Documents-Site visits will be scheduled. to occur more frequently when key aspects of work are underway (for example, when active dredging and beach nourishment are occurring) and less .frequently when little or no work has occurred. ii. Report whenever HDR believes that any part of Contractor's work in progress will not produce a completed Project that conforms to the Contract Documents or will . . prejudice the integrity of the design concept of the completed Project, or has been damaged, or does not meet the requirements of any inspection, test or approval required to be made; and advise City of that part of work in progress that HDR believes should be corrected or rejected.or should be uncovered for observation, or requires special testing, inspection or approval. iii. Observe whether Contractor has arranged for inspections generally required by Laws and Regulations, including but not'limited to those to be performed by public agencies'having'jurisdiction over the Work. g. Records and Reports: i. . Maintain orderly files for correspondence, reports of job conferences, reproductions of original Contract Documents including all Change Orders, Field Orders, Work Change Directives, Addenda, additional Drawings issued subsequent -to the Contract, `HDR's clarifications and interpretations of the Contract Documents, - progress-reports, Shop Drawing and Sample subrnittals.received from and delivered to Contractor, and other Project related documents. ii. For each site visit, prepare a construction observation report utilizing approved City format, recording Contractor's presence on the site, weather conditions, data relative to questions of Change Orders, Field .Orders, Work .Change Directives, or HDR Engineering, Inc. PW151670 changed conditions, site visitors, daily activities, decisions., observations in general, and specific observations in more detail as in the case of observing test procedures; and send copy to the City. iii. Construction observation .reports will include photographic documentation as required to document progress of the Work and of Contractor's compliance with the . progress schedule and schedule of Shop Drawing .arid Sample submittals. iv.' Report immediately to the City the occurrence of any known site accidents, any . :Hazardous Environmental .Conditions, emergencies, or acts -of God endangering the Work, and property damaged by fire or', other causes. h. - Completion: i. - Before the issue of .Certificate of Completion, submit to Contractor a list of observed items requiring completion or correction. ii. Participate in a final inspection in the company of the City and Contractor and prepare a final list of items to be completed or corrected. iii. Observe whether all items on final list have been completed or corrected and make recommendations concerning acceptance and issuance of . the Notice of . Acceptability of the Work. PROPOSED FEE AND REQUESTED ACTION Thalik - again for the opportunity to, submit this proposal to assist with this important City project: We propose to provide the Scope of Services described above on a lump sum basis in accordance with Table I - Summary of Scope and Fees. We estimate that our total fee for construction phase services will be $39,970. If additional. services become necessary, we will acquire authorization from the City and bill for these services in accordance with an agreed -to lump sum fee. We propose that all work be performed as Amendment No. 4 to our existing agreement for professional services for Project No. E10168 (dated November 3, 2010). Refer to Table 2, "Summary of Fees," for a summary of the authorized and proposed fees under our .existing contract, As shown, the proposed fee for Amendment No. 4 °would bring our total contract amount to $232,470.
