TO CONTRACT FOR
PROFESSIONAL SERVICES
The City of Corpus Christi, Texas hereinafter called "CITY ", and RVI PLANNING +
LANDSCAPE ARCHITECTURE + GRAPHIC DESIGN hereinafter called "CONSULTANT ",
agree to the following amendment to the Contract for Professional Services for Oso Creek 1
Oso Bay Area Park Master. Plan Project No. 3380 as authorized and administratively
amended by:
Original Large A/E Contract January 11, 2011 Motion No. M2011 -•013 $264,180.00
➢ In the original contract, Section 2. SCOPE OF WORK shall be modified by the addition of
the following scope: Scope . of Work is revised to include additional Design
Development, Construction Documents Bid Phase Construction Phase surve
services asspecified in Exhibit "A"
➢ Summary of Fees is amended as described in the attached Exhibit "B" revised fee not to
exceed $22,800.00 (Twenty-Two Thousand Ei ht Hundred Dollars and Zero Cents), for
a total restated fee not to exceed $2286,980.00 (Two Hundred Eighty -Six Thousand Nine
Hundred Eighty Dollars and Zero Cents)
All other terms and conditions of the Contract and Amendments between the City and
Consultant will remain in full force and effect.

This Amendment to Landscape Architectural Design Services Agreement (the
"Amendment ") is entered into as of this 26th day of October 201 by and between (voice) 512.480.0032

1. RECITALS
A. Client and Consultant have entered into that certain Agreement
for Landscape Architectural Design Services for Oso Creek 1
Oso Bay Area Park Master Plan dated as of January 11, 2011
(the "Original Agreement ") and desire to amend the Original
Agreement.
B. Except as expressly modified by this Amendment, the Original
Agreement remains unchanged and in full force and effect.
II. AGREEMENT
A. The parties agree that the SCOPE, of the Original Agreement, is
hereby amended by adding the following:
Structural Engineering for the Hawk Walk Boardwalk.
B. The parties agree that the BASIC SERVICES, of the Original
Agreement, is hereby amended by adding the following:
1. Preparation structural design development, construction
drawings, and technical specifications for Hawk Walk
Boardwalk.
2. Structural Bidding Phase services for Hawk Walk
Boardwalk.
3. Structural Construction Phase services (2 site visits) for
Hawk Walk Boardwalk.
C. The parties agree that the DATA PROVIDED BY CLIENT of the
Original Agreement, is hereby amended by adding the following:
The Client will provide geotechnical / testing per requirements
specified by RVE.

D. The parties agree that the COMPENSATION of the Original
Agreement, is hereby amended by adding the following:
I. The Client agrees to pay the Consultant the following lump
sum fees for each phase of the Project described in the Basic
Services section. Fees for Basic Services will be billed
monthly based on percent of work complete for each phase
of the Project plus reimbursable costs. The fees assume no
substantial change in scope of the Project or services.
Design Development $ 4,300
Construction Documents $ 15,000
Bid Phase Services $ 1,500
Construction Phase Services $ 2,000
III. APPROVED AND ACCEPTED
This Amendment to Land Planning and /or Landscape Architectural Design
Services Agreement is approved and accepted by the Client and Consultant
upon both parties signing and dating the Amendment, and returning a
signed copy to the Consultant. The effective date of the Amendment shall
be the last date entered below.

FILING REQUIREMENTS
If a person who requests official action on a matter knows that the requested action will confer an
economic benefit on any City official or employee that is distinguishable from the effect that the action
will have on members of the public in general or a substantial segment thereof, you shall disclose that fact
in a signed writing to the City official, employee or body that has been requested to act in the matter,
unless the interest of the City official or employee in the matter is apparent. The disclosure shall also be

DEFINITIONS
a. `Board member." A member of any board, commission, or committee appointed by the City
Council of the City of Corpus Christi, Texas.
b. "Economic benefit ". An action that is likely to affect an economic interest if it is likely to have an
effect on that interest that is distinguishable from its effect on members of the public in general or a
substantial segment thereof.
C. `Employee." Any person employed by the City of Corpus Christi, Texas either on a full or part-
time basis, but not as an independent contractor.
d. "Firm." Any entity operated for economic gain, whether professional, industrial or commercial, and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self - employed person, partnership, corporation, joint
stock company, joint venture, receivership or trust, and entities which for purposes of taxation are
treated as non -profit organizations.
e. "Official." The Mayor, members of the City Council, City Manager, Deputy City Manager,
Assistant City Managers, Department and Division Heads, and Municipal Court Judges of the City of
Corpus Christi, Texas.
f. "Ownership Interest." Legal or equitable interest, whether actually or constructively held, in a
firm, including when such interest is held through an agent, trust, estate, or holding entity.
"Constructively held" refers to holdings or control established through voting trusts, proxies, or
special terms of venture or partnership agreements."
g. "Consultant." Any person or firm, such as engineers and architects, hired by the City of Corpus
Christi for the purpose of professional consultation and recommendation.
